A Bill for

An Act to amend the Annual Reports (Government Agencies) Act 2004













The Legislative Assembly for the Australian Capital Territory enacts as follows:



1 Name of Act

This Act is the Annual Reports (Government Agencies) Amendment Act 2005.

2 Commencement

This Act commences on the day after its notification day.

Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

3 Legislation amended

This Act amends the Annual Reports (Government Agencies) Act 2004.

4 Annual report of chief executive

5 New section 5A

5A Annual report—former administrative unit etc

(1) This section applies if—

(a) either—

(i) an administrative unit ceases to exist during a financial year; or

(ii) there is not a chief executive of an administrative unit available to prepare a report about the operations of the administrative unit during a financial year; and

(b) arrangements have not been made for a chief executive annual report to be prepared under this Act about the operations of the administrative unit during the year.

Example of arrangements

An Act provides for the annual report to be prepared by the chief executive of another administrative unit.

Note An example is part of the Act, is not exhaustive and may extend, but does not limit, the meaning of the provision in which it appears (see Legislation Act, s 126 and s 132).

(2) The chief executive of the administrative unit responsible for this section must prepare, or arrange for the preparation of, a chief executive annual report for the administrative unit mentioned in subsection (1) for the financial year.

(3) For subsection (2), the chief executive of the administrative unit mentioned in subsection (2) is taken to be the chief executive of the administrative unit mentioned in subsection (1).

6 Annual report of public authority

6A Annual report—former public authority

(1) This section applies if—

(a) a public authority ceases to exist during a financial year; or

(b) arrangements have not been made for a public authority annual report to be prepared under this Act about the operations of the public authority during the year.

Example of arrangements

An Act provides for the public authority to continue in existence for reporting purposes only.

Note An example is part of the Act, is not exhaustive and may extend, but does not limit, the meaning of the provision in which it appears (see Legislation Act, s 126 and s 132).

(2) The chief executive of the administrative unit responsible for this section must prepare, or arrange for the preparation of, a public authority annual report for the public authority for the financial year.

(3) For subsection (2), the chief executive of the administrative unit mentioned in subsection (2) is taken to be the public authority.
