STATES GRANTS (PRIMARY AND SECONDARY EDUCATION ASSISTANCE) AMENDMENT BILL (NO. 2) 2002


OUTLINE


The purpose of the Bill is to amend Schedules 3 and 5 to the States Grants (Primary and Secondary Education Assistance) Act 2000 (the Act) to insert maximum capital grant funding amounts for government and non-government schools for the calendar years 2005, 2006 and 2007. Schedules 3 and 5 to the Act currently set out maximum funding amounts for the capital grants program, for government and non-government schools respectively, for the years 2001 to 2004.

This amendment is foreshadowed in the Act in Note 1 to Schedules 3 and 5, which states “Amounts for 2005, 2006 and 2007 will be inserted by an amending Act.” The Bill will permit approval of capital grant funding amounts for future program years beyond the four year funding period 2001-2004, extending to the years 2005, 2006 and 2007, in keeping with program administrative arrangements.

Maximum grant amounts for program years beyond 2004 need to be inserted in the Act because capital grants for schools are approved up to three years in advance of the current calendar year. At present there is no legislative authority to approve capital projects submitted for approval that include a funding allocation from the Program year 2005 or beyond.



FINANCIAL IMPACT


The Bill provides funding for school capital works of $897.783 million over the program years 2005-2007. This is made up of $666.963 million for government schools and $230.820 million for non-government schools. These amounts are subject to supplementation as prescribed in the Act.

NOTES ON CLAUSES


Clause 1 - Short title

Provides for the Act to be cited as the States Grants (Primary and Secondary Education Assistance) Amendment Act (No. 2) 2002.


Clause 2 - Commencement

Provides for the Act to commence on the day on which it receives the Royal Assent.


Clause 3 - Schedule(s)

Provides that each Act that is specified in a Schedule is amended or repealed as set out in the applicable items in the Schedule and that any other item in a Schedule has effect according to its terms.



Schedule 1 – Amendments

States Grants (Primary and Secondary Education Assistance) Act 2000


Section 54 enables the Minister to authorise payments to the States for capital expenditure in connection with government schools and/or government rural school hostels. Total payments to the States must not exceed the amounts in column 2 of Schedule 3 for the respective program years (the maximum capital grant funding amounts).

Section 73 enables the Minister to authorise payments to the States for capital expenditure to individual non-government schools or rural student hostels, or groups of non-government schools or rural student hostels, or block grant authorities. Total payments to the States must not exceed the amounts in column 2 of Schedule 5 for the respective program years (the maximum capital grant funding amounts).

Item 1

Amends column 2 of the table in Schedule 3 to insert the maximum capital grant funding amounts for government schools for 2005, 2006 and 2007.


Item 2

Repeals Note 1 to reflect the amendments made by Item 1.

Item 3


Renames Note 2 to reflect the repeal of Note 1 by Item 2.


Item 4

Amends column 2 of the table in Schedule 5 to insert the maximum capital grant funding amounts for non-government schools for 2005, 2006 and 2007.


Item 5

Repeals Note 1 to reflect the amendments made by Item 4.


Item 6

Renames Note 2 to reflect the repeal of Note 1 by Item 5.
