Financial assistance scheme for respondents to applications brought under the Family Law (Child Abduction Convention) Regulations 1986

To fund a scheme to provide for respondents to applications for orders under the Family Law (Child Abduction Convention) Regulations 1986 to:

(a) obtain legal representation and advice for the purposes of those proceedings, including any appeal and any associated alternative dispute resolution processes; and

(b) pay for any necessary expenses incurred in responding to those applications (such as court fees, expert witness fees and other expenses of a kind ordinarily incurred in litigation).

This objective has the effect it would have if it were limited to measures:

(a) in connection with divorce and matrimonial causes, including in relation to parental rights or the custody and guardianship of infants; or

(b) with respect to external affairs (within the meaning of paragraph 51(xxix) of the Constitution).
