Australian Wine and Brandy Corporation Act 1980

Australian Wine and Brandy Corporation (Annual General Meeting of the Industry) Regulations 1999

Section 46 of the Australian Wine and Brandy Corporation Act 1980 (the AWBC Act) provides that the Governor-General may make regulations necessary or convenient to be prescribed for carrying out or giving effect to the Act.

The Regulations replace the Australian Wine and Brandy Corporation (Annual General Meeting of the Industry) Regulations 1987.

The purpose of the Regulations is to set out the rules and procedures governing the Annual General Meeting (AGM) of the industry convened by the Australian Wine and Brandy Corporation (AWBC). These rules and procedures encompass the requirements for motions and special motions, proxies, voting, the appointment of tellers and general meeting procedures.

The AWBC recommended changes to the Regulations to ensure the original intention of the Wine Export Charge Act 1997 (now incorporated in the Primary Industries (Customs) Charges Act 1999), to enable payers of the Wine Export Charge to vote at AWBC AGMs, was fulfilled. The new Regulations will ensure that all levy payers, both those paying the Wine Grapes Levy and the Wine Export Charge, are able to vote at the AWBC AGM.

When the Wine Export Charge was introduced in 1997 it was intended that those paying this charge would be able to vote at an AWBC AGM. However, while consequential amendments were made to the Act, the Regulations were inadvertently not amended.

The Regulations give effect to the Corporation's recommendations.
