The Legislative Assembly of the Northern Territory enacts as follows:

1. Short title
This Act may be cited as the Criminal Code Amendment Act 2004.

2. Commencement
This Act comes into operation on the date fixed by the Administrator by notice in the Gazette.

3. Common assault
Section 188 of the Criminal Code is amended –

(a) by inserting after subsection (2)(f) the following:

"(fa) is an emergency worker and is acting in the execution of his or her duty or is acting in the aid of the person or another person;"; and

(b) by inserting after subsection (3) the following:

"(4) In subsection (2)(fa) –

'emergency worker' means a person who works (whether paid or unpaid) for an emergency relief organisation and includes an ambulance officer and a volunteer member of the Fire and Rescue Service.".
