An Act to amend the Criminal Code

The Legislative Assembly of the Northern Territory enacts as follows:

1 Short title

This Act may be cited as the Criminal Code (Unlawful Assault Causing Death) Amendment Act 2011.

2 Act amended

This Act amends the Criminal Code.

3 Section 189B inserted

After section 189A

insert

189B Unlawful assault causing death

(1) A person is guilty of the crime of unlawful assault causing death if:

(a) the person unlawfully assaults another person; and

(b) the assault causes the death of the other person.

Maximum penalty: Imprisonment for 16 years.

(2) Despite section 31, a person is criminally responsible under subsection (1) even if the person does not intend or foresee the death of the other person and even if the death was not reasonably foreseeable.
