The Legislative Assembly of the Northern Territory enacts as follows:

1. Short title

This Act may be cited as the Criminal Code Amendment (Assaults on Police Officers) Act 2006.

2. Act amended

This Act amends the Criminal Code.

3. Repeal and substitution of section 189A

Section 189A

189A.  Assaults on police officers

(1) A person is guilty of an offence if the person assaults a police officer who is performing duties as a police officer.

(2) The minimum penalty that must be imposed on a person on being found guilty of an offence against subsection (1) is imprisonment for 6 months.

(3) The maximum penalty that may be imposed on a person on being found guilty of an offence against subsection (1) is:

(a) imprisonment for 2 years if the person is found guilty summarily; or

(b) otherwise – imprisonment for 5 years.

(4) A person is guilty of an offence if:

(a) the person assaults a police officer who is performing duties as a police officer; and

(b) the police officer suffers bodily harm because of the assault.

(5) The minimum penalty that must be imposed on a person on being found guilty of an offence against subsection (4) is imprisonment for 2 years.

(6) The maximum penalty that may be imposed on a person on being found guilty of an offence against subsection (4) is:

(a) imprisonment for 3 years if the person is found guilty summarily; or

(b) otherwise – imprisonment for 7 years.

(7) A person is guilty of an offence if:

(a) the person assaults a police officer who is performing duties as a police officer; and

(b) the police officer suffers grievous harm because of the assault.

(8) The minimum penalty that must be imposed on a person on being found guilty of an offence against subsection (7) is imprisonment for 5 years.

(9) The maximum penalty that may be imposed on a person on being found guilty of an offence against subsection (7) is imprisonment for 16 years.
