An Act to amend the Criminal Code

The Legislative Assembly of the Northern Territory enacts as follows:

1 Short title

This Act may be cited as the Criminal Code Amendment (Assaults on Public Sector Employees, Ambulance Officers and Drivers of Commercial Passenger Vehicles) Act 2008.

2 Act amended

This Act amends the Criminal Code.

3 Amendment of section 188 (Common assault)

(1) After section 188(2)

insert

(2A) A person found guilty of an assault must be sentenced to imprisonment for at least 2 weeks if the person assaulted:

(a) is a public sector employee, a paid or unpaid ambulance officer or a driver of a commercial passenger vehicle; and

(b) is assaulted while acting in the execution of duty.

(2) After section 188(3)

commercial passenger vehicle, see the Commercial Passenger (Road) Transport Act.
