The Legislative Assembly of the Northern Territory enacts as follows:
This Act may be cited as the Disasters Amendment Act 2007.
This Act amends the Disasters Act.
(1) Section 40(1)(a)(i), at the end
insert
or
(2) Section 40(1)(a) and (c)(i), at the end
insert
and
(3) Section 40(1)(c)(iii)
omit
area.

(4) After section 40(1)(c)
insert
(d) sections 37 and 38 apply as if the references in those sections to a state of disaster were references to a state of emergency.
(5) Section 40(2) and (3)
omit, substitute
(2) If a tropical cyclone watch or warning is issued for a part of the Territory by the Bureau of Meteorology, sections 37(1)(e)(iii) and 38 apply in relation to that part of the Territory while the watch or warning is current as if the watch or warning were a declaration of a state of emergency.
(3) In this section:
"Bureau of Meteorology" means the Commonwealth Bureau of Meteorology established by the Meteorology Act 1955 (Cth).

Maximum penalty: 200 penalty units or imprisonment for 2 years.
Section 45, penalty provision

Maximum penalty: 500 penalty units.
