AN ACT
to amend the Interpretation Act
1. Short title
This Act may be cited as the Interpretation Amendment Act 2004.
2. Commencement
This Act comes into operation on the date fixed by the Administrator by notice in the Gazette.
3. Repeal and substitution of section 55
Section 55 of the Interpretation Act is repealed and the following substituted:
"55. Headings, schedules, examples and notes
"(1) The following are parts of an Act:
(b) schedules to the Act;
(c) examples in the Act;
(d) notes in the text of the Act.
(b) marginal notes, footnotes, endnotes and any other notes that are not in the text of the Act.".
"62C. Changes in drafting practice do not affect meaning
"If –
(b) a provision of the Act enacted later appears to express the same idea in different words for the purpose of implementing a different legislative drafting practice,
"62D. Examples
"If an Act includes an example –
(b) the example must not be taken to limit or extend the meaning of the provision of the Act to which it relates; and
(c) if the example is inconsistent with that provision, the provision prevails to the extent of the inconsistency.".
