An Act to amend the Medical Services Act

The Legislative Assembly of the Northern Territory enacts as follows:

1 Short title

This Act may be cited as the Medical Services Amendment Act 2015.

2 Act amended

This Act amends the Medical Services Act.

3 Section 11 amended

(1) Section 11(1)(c)

omit, insert

(c) for medical treatment that is a surgical treatment – the treatment is given in a hospital; and

(ca) for medical treatment that requires the dispensing of a drug – the drug is dispensed by a suitably qualified medical practitioner or a suitably qualified pharmacist; and

(2) Section 11(2)

omit

all words from "must" to "examine"

insert

must be a suitably qualified medical practitioner unless it is not reasonably practicable in the circumstances to get a suitably qualified medical practitioner to examine

(3) Section 11(7)

omit

, in giving medical treatment

insert

or pharmacist, in giving medical treatment or dispensing a drug,

(4) Section 11(8)

insert (in alphabetical order)

pharmacist means a person registered under the Health Practitioner Regulation National Law to practise in the pharmacy profession (other than as a student).

suitably qualified medical practitioner means a medical practitioner who:

(a) is an obstetrician or gynaecologist; or

(b) has completed training that is designed to train the medical practitioner to provide advice in the area of fertility control; or

(c) has a valid credential prescribed by regulation.

suitably qualified pharmacist means a pharmacist who has a valid credential prescribed by regulation.

4 Expiry of Act

This Act expires on the day after it commences.
