The Legislative Assembly of the Northern Territory enacts as follows:


1. Short title
This Act may be cited as the Police Administration Amendment Act 2004.

2. Commencement
This Act comes into operation on the date fixed by the Administrator by notice in the Gazette.

3. Repeal and substitution of section 163
Section 163 of the Police Administration Act is repealed and the following substituted:

"163. Protection from civil liability

"(1) This section applies to a person who is or has been a member of the Police Force.

"(2) The person is not civilly liable for an act done or omitted to be done by the person in good faith in the performance of his or her duties as a member.

"(3) Subsection (2) does not affect any liability the Territory would, apart from that subsection, have for the act or omission.

"(4) The person alleging the act or omission was not in good faith has the onus of proving it on the balance of probabilities.".
