The Legislative Assembly of the Northern Territory enacts as follows:

1. Short title

This Act may be cited as the Sentencing Amendment (Aboriginal Customary Law) Act 2005.

This Act amends the Sentencing Act.

(1) Section 5(2) –

substitute

a court must, subject to subsection (2A),

(2) After section 5(2) –

insert

(2A) A court must not have regard to any aspect of Aboriginal customary law in sentencing an offender.
