The Legislative Assembly of the Northern Territory enacts as follows:

1. Short title

This Act may be cited as the Sentencing Amendment (Cultural Practice and Customary Law) Act 2006.

2. Act amended

This Act amends the Sentencing Act.

3. Amendment of section 5 (Sentencing guidelines)

(1) Section 5(2)

a court shall have regard to –

(5) A court must not have regard to any of the following matters in sentencing an offender:

(a) a cultural practice of a community of which the offender is a member;

(b) a customary law to which the offender may be subject as a member of a community.
