2011 A Bill for An Act to amend the Charitable and Non-Profit Gaming Act 1999 for particular purposes

 


 

Charitable and Non-Profit Gaming (Two-up) Amendment Bill 2011 [s 1] The Parliament of Queensland enacts-- 1 Clause 1 Short title 2 This Act may be cited as the Charitable and Non-Profit 3 Gaming (Two-up) Amendment Act 2011. 4 Clause 2 Act amended 5 This Act amends the Charitable and Non-Profit Gaming Act 6 1999. 7 Clause 3 Insertion of new pt 8A 8 After part 8-- 9 insert-- 10 `Part 8A Two-up on designated day 11 `178 Meaning of two-up 12 `(1) For the purposes of this part, two-up means two-up conducted 13 in a ring controlled by a ringkeeper in which-- 14 (a) a spinner standing within the ring uses a kip to toss two 15 or three coins in the air; and 16 (b) players wager on the outcome of the coin toss before the 17 spinner tosses the coins. 18 `(2) In this section-- 19 kip means a wooden bat, or similar instrument, from which 20 the coins are thrown. 21 ring means the area inside boundaries drawn or identified by 22 the ringkeeper. 23 ringkeeper means the person who controls the spinner and 24 administers the rules. 25 Page 4

 


 

Charitable and Non-Profit Gaming (Two-up) Amendment Bill 2011 [s 3] spinner means a player who has elected to toss the coins and 1 has entered the centre of the ring. 2 `179 Lawful two-up 3 `(1) Two-up that complies with this section is lawful. 4 `(2) For subsection (1), two-up complies with this section if it 5 complies with the following-- 6 (a) it is conducted by-- 7 (i) an RSL or Services Club on premises for which the 8 RSL or Services Club is the licensee under the 9 Liquor Act 1992; or 10 (ii) a person approved in writing by an RSL 11 sub-branch at a function on premises which are 12 licensed under the Liquor Act 1992; 13 (b) it is played on a designated day as part of the 14 commemoration of the designated day; 15 (c) it is not played by a minor; 16 (d) either of the following makes the rules readily available 17 for players to read before playing-- 18 (i) the RSL or Services Club mentioned in paragraph 19 (a)(i); 20 (ii) the person approved in writing under paragraph 21 (a)(ii); 22 (e) if it is played with rules in addition to those mentioned 23 in the definition in section 178(1)--those rules are in the 24 spirit of the traditional rules of two-up; 25 (f) the RSL or Services Club mentioned in paragraph (a)(i) 26 or person approved in writing under paragraph (a)(ii)-- 27 (i) does not charge an entry fee for playing; or 28 (ii) charges an entry fee that is paid to the RSL or an 29 RSL sub-branch to be used to support ex-service 30 men and women and their families; 31 Page 5

 


 

Charitable and Non-Profit Gaming (Two-up) Amendment Bill 2011 [s 4] (g) the proceeds derived from it, other than an amount from 1 an entry fee mentioned in paragraph (f)(ii), are returned 2 to the players as winnings. 3 `180 Two-up not category 1, 2, 3 or 4 game 4 `To remove doubt, it is declared that two-up under section 179 5 is not a category 1, 2, 3 or 4 game. 6 `181 Interaction with Casino Acts 7 `(1) The State may permit or approve the conduct or playing of 8 two-up on a designated day under this part despite the 9 provisions of the Casino Acts which grant casinos the 10 exclusive right to conduct or play two-up. 11 `(2) To remove doubt, it is declared that a provision of the Casino 12 Acts includes a provision of an agreement made under the 13 Casino Acts. 14 `(3) In this section-- 15 Casino Acts means the following Acts-- 16 (a) Breakwater Island Casino Agreement Act 1984; 17 (b) Brisbane Casino Agreement Act 1992; 18 (c) Cairns Casino Agreement Act 1993; 19 (d) Jupiters Casino Agreement Act 1983.'. 20 Clause 4 Amendment of sch 2 (Dictionary) 21 (1) Schedule 2-- 22 insert-- 23 `designated day means-- 24 (a) 25 April; or 25 (b) 11 November; or 26 (c) another day that is-- 27 Page 6
