2013 A Bill for An Act to amend the Criminal Code to protect integrity in sport by prohibiting cheating at gambling in sport

 


 

Criminal Code (Cheating at Gambling) Amendment Bill 2013 [s 1] The Parliament of Queensland enacts-- 1 Clause 1 Short title 2 This Act may be cited as the Criminal Code (Cheating at 3 Gambling) Amendment Act 2013. 4 Clause 2 Act amended 5 This Act amends the Criminal Code. 6 Clause 3 Insertion of new ch 43 7 After chapter 42A-- 8 insert-- 9 Chapter 43 Cheating at gambling 10 443 Definitions 11 In this chapter-- 12 betting, on an event, includes-- 13 (a) accepting, placing or withdrawing a bet on 14 the event; and 15 (b) causing the acceptance, placement or 16 withdrawal of a bet on the event. 17 causing financial disadvantage-- 18 (a) means causing financial disadvantage 19 whether permanently or temporarily; and 20 (b) includes-- 21 (i) causing financial disadvantage to 22 another person; and 23 Page 4

 


 

Criminal Code (Cheating at Gambling) Amendment Bill 2013 [s 3] (ii) inducing a person to do an act or make 1 an omission causing financial 2 disadvantage to another person. 3 corrupt betting conduct, in relation to an event, 4 means an act or omission that-- 5 (a) affects, or if engaged in would be likely to 6 affect, the outcome of betting on the event; 7 and 8 (b) is contrary to the standards of integrity that a 9 reasonable person would expect of a person 10 in a position to affect the outcome of betting 11 on the event. 12 encourage includes incite, induce, persuade, 13 pressure, threaten or urge. 14 event-- 15 (a) means an event on which betting under a 16 law of the Commonwealth or a State is 17 lawful; and 18 (b) includes an event contingency. 19 event contingency, for an event, means a 20 contingency for the event on which betting under 21 a law of the Commonwealth or a State is lawful. 22 obtaining financial advantage-- 23 (a) means obtaining financial advantage 24 whether permanently or temporarily; and 25 (b) includes-- 26 (i) obtaining financial advantage for 27 another person; or 28 (ii) inducing a person to do an act or make 29 an omission resulting in obtaining 30 financial advantage for another person. 31 Page 5

 


 

Criminal Code (Cheating at Gambling) Amendment Bill 2013 [s 3] 443A Engaging in corrupt betting conduct 1 A person who knowingly or recklessly engages in 2 corrupt betting conduct in relation to an event with the 3 intention of obtaining financial advantage, or causing 4 financial disadvantage, in relation to betting on the 5 event commits a crime. 6 Maximum penalty--10 years imprisonment. 7 443B Facilitating corrupt betting conduct 8 (1) A person who knowingly or recklessly offers to 9 engage in, or encourages another person to 10 engage in, corrupt betting conduct in relation to 11 an event with the intention of obtaining financial 12 advantage, or causing financial disadvantage, in 13 relation to betting on the event commits a crime. 14 Maximum penalty--10 years imprisonment. 15 (2) A person who knowingly or recklessly enters into 16 an agreement or arrangement in relation to 17 corrupt betting conduct in relation to an event 18 with the intention of obtaining financial 19 advantage, or causing financial disadvantage, in 20 relation to betting on the event commits a crime. 21 Maximum penalty--10 years imprisonment. 22 443C Concealing corrupt betting conduct, 23 agreement or arrangement 24 (1) A person who knowingly or recklessly 25 encourages another person to conceal from a 26 relevant authority corrupt betting conduct, or an 27 agreement or arrangement in relation to corrupt 28 betting conduct, in relation to an event with the 29 intention of obtaining financial advantage, or 30 causing financial disadvantage, in relation to 31 betting on the event commits a crime. 32 Maximum penalty--10 years imprisonment. 33 Page 6

 


 

Criminal Code (Cheating at Gambling) Amendment Bill 2013 [s 3] (2) In this section-- 1 relevant authority means-- 2 (a) a police officer; or 3 (b) a body having the official function of 4 controlling, regulating or supervising-- 5 (i) an event, other than an event 6 contingency; or 7 (ii) the betting on an event, other than an 8 event contingency. 9 443D Using information in relation to event 10 (1) A person who knowingly or recklessly uses 11 information about corrupt betting conduct in 12 relation to an event for betting on the event 13 commits a crime. 14 Maximum penalty--10 years imprisonment. 15 (2) A person who knowingly or recklessly uses 16 information about corrupt betting conduct in 17 relation to an event to encourage another person 18 (the second person) to bet on the event in a 19 particular way commits a crime. 20 Maximum penalty--10 years imprisonment. 21 (3) A person (the first person) who knowingly or 22 recklessly communicates, or causes to be 23 communicated, information about corrupt betting 24 conduct in relation to an event to another person 25 (also the second person) who the first person 26 knows, or ought reasonably to know, would be 27 likely to bet on the event commits a crime. 28 Maximum penalty--10 years imprisonment. 29 (4) In a proceeding for an offence against subsection 30 (2) or (3), it is immaterial whether the second 31 person bets on the event. 32 Page 7

 


 

Criminal Code (Cheating at Gambling) Amendment Bill 2013 [s 3] 443E Evidentiary provision 1 (1) This section applies for a proceeding for an 2 offence under this chapter. 3 (2) A person is taken to have intended obtaining 4 financial advantage, or causing financial 5 disadvantage, only if it is proved that the 6 person-- 7 (a) intended obtaining financial advantage, or 8 causing financial disadvantage, in relation to 9 betting on an event; or 10 (b) was aware another person intended 11 obtaining financial advantage, or causing 12 financial disadvantage, in relation to betting 13 on an event resulting from the act or 14 omission that is the subject of the charge for 15 the proceeding. 16 (3) It is immaterial whether financial advantage is 17 obtained or financial disadvantage is caused. 18 © State of Queensland 2013 Authorised by the Parliamentary Counsel Page 8
