2007 A Bill for An Act to amend the Criminal Code

 


 

s1 4 s3 Criminal Code (Assaults Against Police and Others) Amendment Bill 2007 The Parliament of Queensland enacts-- 1 Clause 1 Short title 2 This Act may be cited as the Criminal Code (Assaults Against 3 Police and Others) Amendment Act 2007. 4 Clause 2 Code amended 5 This Act amends the Criminal Code. 6 Clause 3 Amendment of s 340 (Serious assaults) 7 (1) Section 340(2), `corrective services officer'-- 8 omit, insert-- 9 `ambulance officer, corrective services officer or fire service 10 officer'. 11 (2) Section 340-- 12 insert-- 13 `(2B) Subsection (2C) applies if-- 14 (a) a court convicts a person of an offence against 15 subsection (1)(b) or (2); and 16 (b) the act or omission constituting the offence occurred 17 after the commencement of this subsection. 18 `(2C) The court must make an order sentencing the person to a 19 period of imprisonment for the offence that includes a period 20 of detention in custody for a minimum of 3 months, unless the 21 person is released sooner under an exceptional circumstances 22 parole order.'. 23 (3) Section 340(3)-- 24 insert-- 25 `ambulance officer see the Ambulance Service Act 1991, the 26 schedule. 27
