2007 A Bill for An Act to amend the Criminal Code

 


 

s1 4 s4 Criminal Code (Assault Causing Death) Amendment Bill 2007 The Parliament of Queensland enacts-- 1 Clause 1 Short title 2 This Act may be cited as the Criminal Code (Assault Causing 3 Death) Amendment Act 2007. 4 Clause 2 Code amended 5 This Act amends the Criminal Code. 6 Clause 3 Insertion of new s 341 7 After section 340-- 8 insert-- 9 `341 Unlawful assault causing death 10 `(1) Any person who unlawfully assaults another causing the death 11 of the other person is guilty of a crime, and is liable to 12 imprisonment for 7 years. 13 `(2) The person is not excused from criminal responsibility for the 14 death of the other person because the offender does not intend 15 or foresee or can not reasonably foresee the death.'. 16 Clause 4 Replacement of s 544 (Accessories after the fact to 17 crimes) 18 Section 544-- 19 omit, insert-- 20 `544 Accessories after the fact to crimes 21 `Any person who becomes an accessory after the fact to a 22 crime is guilty of a crime, and is liable, if no other punishment 23 is provided, to the same punishment as if the person had 24 committed the crime committed by the principal offender.'. 25
