2008 A Bill for An Act to amend the Criminal Code to provide for the offence of giving false evidence before Parliament and to make a particular consequential amendment to the Parliament of Queensland Act 2001

 


 

Criminal Code (Truth in Parliament) Amendment Bill 2008 Part 1 Preliminary [s 1] The Parliament of Queensland enacts-- 1 Part 1 Preliminary 2 Clause 1 Short title 3 This Act may be cited as the Criminal Code (Truth in 4 Parliament) Amendment Act 2008. 5 Part 2 Amendment of Criminal Code 6 Clause 2 Code amended in pt 2 7 This part amends the Criminal Code. 8 Clause 3 Insertion of new s 57 9 After section 56B-- 10 insert-- 11 `57 False evidence before Parliament 12 `(1) A person who, during an examination before the Legislative 13 Assembly or a committee of the Legislative Assembly, 14 knowingly gives a false answer to a lawful and relevant 15 question put to the person during the examination commits a 16 crime. 17 Maximum penalty--7 years imprisonment. 18 `(2) The offender can not be arrested without warrant. 19 `(3) A person can not be convicted of the offence defined in this 20 section on the uncorroborated testimony of 1 witness.'. 21 Page 4

 


 

Criminal Code (Truth in Parliament) Amendment Bill 2008 Part 3 Amendment of Parliament of Queensland Act 2001 [s 4] Part 3 Amendment of Parliament of 1 Queensland Act 2001 2 Clause 4 Act amended in pt 3 3 This part amends the Parliament of Queensland Act 2001. 4 Clause 5 Amendment of s 47 (Other proceedings) 5 Section 47-- 6 insert-- 7 `(3) However, if a person's conduct is both a contempt of the 8 Assembly and an offence against the Criminal Code, section 9 57, the person may only be proceeded against for the offence. 10 Note-- 11 Criminal Code, section 57 (False evidence before Parliament)'. 12 Page 5
