1996 A BILL FOR An Act to amend the Criminal Justice Act 1989 and the Commissions of Inquiry Act 1950

 


 

s1 4 s3 Criminal Justice Legislation Amendment The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short Clause 1. This Act may be cited as the Criminal Justice Legislation Amendment 4 Act 1996. 5 ART 2--AMENDMENT OF CRIMINAL JUSTICE 6 P ACT 1989 7 amended in pt 2 8 Act Clause 2. This part amends the Criminal Justice Act 1989. 9 of new s 132A 10 Insertion Clause 3. After section 132-- 11 insert-- 12 of Inquiry Act 1950 prevails over this Act 13 `Commissions `132A.(1) The Commissions of Inquiry Act 1950 prevails over this Act. 14 `(2) Without limiting subsection (1), the commission or a person who is, 15 or was, a commissioner, a commission officer or member of the 16 commission's staff or other person engaged under section 66 must comply 17 with any summons or requirement of an inquiry chairperson under the 18 Commissions of Inquiry Act 1950, section 5. 19 `(3) For the Commissions of Inquiry Act 1950, section 5, 10(4) or 20 14(1)(b), it is not a reasonable excuse for the commission or anyone else to 21 fail to comply with the summons or requirement-- 22

 


 

s3 5 s3 Criminal Justice Legislation Amendment (a) that compliance would disclose anything that is required not to be 1 disclosed under this Act or would otherwise contravene this Act; 2 or 3 (b) that compliance would disclose anything that should not be 4 disclosed because of its particular nature, content or subject 5 matter. 6 `(4) This section applies despite another provision of this or another Act. 7 `(5) In this section-- 8 "inquiry chairperson" means the chairperson of any commission of 9 inquiry under the Commissions of Inquiry Act 1950.'. 10 for CJC inquiry 11 `Provisions `132B.(1) This section applies to the commission of inquiry established 12 under the Commissions of Inquiry Act 1950 under the order in council 13 published in the gazette on 7 October 1996 at pages 475 and 476 (the "CJC 14 inquiry"). 15 `(2) A person is not liable, civilly, criminally or under an administrative 16 process for helping the CJC inquiry. 17 `(3) Without limiting subsection (2)-- 18 (a) in a proceeding for defamation the person has the defence of 19 absolute privilege for disclosing anything in good faith to the CJC 20 inquiry; and 21 (b) if the person would otherwise be required under an Act, oath, rule 22 of law or practice to maintain confidentiality about anything 23 disclosed by the person to the CJC inquiry--the person-- 24 (i) does not contravene the Act, oath, rule of law or practice for 25 making the disclosure; and 26 (ii) is not liable to disciplinary action for making the disclosure. 27 `(4) A person must not, other than for the CJC inquiry or as required by 28 law, disclose information that comes to the person's knowledge because the 29 person is, or was-- 30 (a) a commissioner of the CJC inquiry; or 31

 


 

s4 6 s5 Criminal Justice Legislation Amendment (b) a person appointed, engaged or seconded to help the inquiry or 1 who otherwise helped the inquiry.'. 2 ART 3--AMENDMENT OF COMMISSIONS OF 3 P INQUIRY ACT 1950 4 amended in pt 3 5 Act Clause 4. This part amends the Commissions of Inquiry Act 1950. 6 of s 5 (Power to summon witness and require production 7 Amendment of books etc.) 8 Clause 5.(1) Section 5(1)(b), `such person to produce to the commission'-- 9 omit, insert-- 10 `any person to produce to the commission at a specified time and place'. 11 (2) Section 5(1)-- 12 insert-- 13 `(c) require any person to attend at a specified time and place to give 14 information to, and answer questions asked by, a person 15 authorised in writing by the chairperson; and 16 (d) require any person to give to the commission within a specified 17 time and in a specified way written information verified as 18 specified.'. 19 © State of Queensland 1996
