1999 A BILL FOR An Act to amend the Criminal Law Amendment Act 1945 and other Acts

 


 

s1 4 s4 Criminal Law Amendment The Parliament of Queensland enacts-- 1 ART 1--PRELIMINARY 2 P title 3 Short Clause 1. This Act may be cited as the Criminal Law Amendment Act 1999. 4 5 Commencement Clause 2. This Act commences on a day to be fixed by proclamation. 6 ART 2--AMENDMENT OF CRIMINAL LAW 7 P AMENDMENT ACT 1945 8 amended by pt 2 9 Act Clause 3. This part amends the Criminal Law Amendment Act 1945. 10 of s 19 (Sexual offender to report address) 11 Amendment Clause 4.(1) Section 19, heading, after `report'-- 12 insert-- 13 `name and' 14 (2) Section 19(1)(c), after `offender's'-- 15 insert-- 16 `current name and'. 17

 


 

s5 5 s5 Criminal Law Amendment (3) Section 19(1)(d), after `change of'-- 1 insert-- 2 `name or'. 3 (4) Section 19(1)(d), `commissioner of police'-- 4 omit, insert-- 5 `commissioner of the police service'. 6 (5) Section 19(5)-- 7 omit. 8 of s 20 (Disclosure of offences of sexual nature) 9 Amendment Clause 5.(1) Section 20, heading, after `nature'-- 10 insert-- 11 `and other relevant information'. 12 (2) Section 20(1) and (2)-- 13 omit, insert-- 14 `20.(1) This section applies to the following information-- 15 (a) information that a person is subject to an order made under 16 section 19; 17 (b) details of any offence of a sexual nature of which the person 18 subject to the order has been convicted; 19 (c) any other relevant information about the person. 20 `(1A) The Queensland Community Corrections Board (the "board") 21 may release the information on application by-- 22 (a) a police officer; or 23 (b) a corrective services officer; or 24 (c) a person claiming a legitimate and sufficient interest in having the 25 information. 26 `(1B) The information may be given only to-- 27

 


 

s6 6 s6 Criminal Law Amendment (a) a person nominated in the application, if the board is satisfied the 1 person has a legitimate and sufficient interest in having the 2 information; or 3 (b) another person, if the board, on considering the application, 4 identifies the person as someone who has a legitimate and 5 sufficient interest in having the information. 6 `(1C) The board may give the information to the person on conditions 7 the board considers appropriate. 8 `(1D) In relation to the conviction mentioned in subsection (1)(b), the 9 following are immaterial-- 10 (a) whether or not the conviction was the conviction for which the 11 order was made; 12 (b) whether the conviction was recorded before or after the order; 13 (c) whether the offence for which the conviction was recorded was 14 committed before or after the order.'. 15 (3) Section 20(4), `or (b)'-- 16 omit, insert-- 17 `, (b) or (c)'. 18 (4) Section 20(1A) to (1D), as inserted, and section 20(3) and (4)-- 19 renumber as section 20(2) to 20(7). 20 (5) Section 20(6) as renumbered, `pursuant to subsection (2)'-- 21 omit, insert-- 22 `under subsection (4)'. 23 of new s 22 24 Insertion Clause 6. s7 7 s7 Criminal Law Amendment with Criminal Law (Rehabilitation of Offenders) Act 1 `Relationship 1986 2 `22.(1) Subsection (2) applies if a rehabilitation period is capable of 3 running under the Criminal Law (Rehabilitation of Offenders) Act 1986 in 4 relation to a conviction mentioned in section 19(1). 5 `(2) The expiration of the rehabilitation period mentioned in 6 subsection (1) has no effect on-- 7 (a) the power to make an order; or 8 (b) the effect of an order; or 9 (c) the obligation of an offender to comply with an order; or 10 (d) the provision of information under section 20 because the 11 offender is subject to an order. 12 `(3) Subsection (4) applies if a rehabilitation period is capable of running 13 under the Criminal Law (Rehabilitation of Offenders) Act 1986 in relation to 14 a conviction for a sexual offence mentioned in section 20(1)(b). 15 `(4) The expiration of the rehabilitation period mentioned in 16 subsection (3) has no effect on the provision of information under 17 section 20 about the conviction mentioned in subsection (3). 18 `(5) This section applies despite the Criminal Law (Rehabilitation of 19 Offenders) Act 1986. 20 `(6) In this section-- 21 "order" means an order under section 19(1).'. 22 of new pt 5 23 Insertion Clause 7. After section 22-- 24 insert-- 25 ART 5--TRANSITIONAL PROVISIONS 26 `P provision for Criminal Law Amendment Act 1999 27 `Transitional `23.(1) For section 20, the following is immaterial-- 28

 


 

s8 8 s8 Criminal Law Amendment (a) whether the order, to which an offender is subject, was made 1 before or after the commencement of the Criminal Law 2 Amendment Act 1999, section 5; 3 (b) whether the conviction mentioned in section 20(1)(b) was 4 recorded before or after the commencement of the Criminal Law 5 Amendment Act 1999, section 5; 6 (c) whether the offence, for which the conviction mentioned in 7 section 20(1)(b) was recorded, was committed before or after the 8 commencement the Criminal Law Amendment Act 1999, 9 section 5. 10 `(2) For section 22, in relation to an order, it is immaterial whether-- 11 (a) the order was made; or 12 (b) the conviction, for which the order was made, was recorded; or 13 (c) the conviction mentioned in section 22(3) was recorded; or 14 (d) the offence, for which a conviction mentioned in paragraph (b) or 15 (c) was recorded, was committed; 16 before or after the commencement of the Criminal Law Amendment Act 17 1999, section 6. 18 `(3) In this section-- 19 "order" means an order under section 19(1).'. 20 PART 3--AMENDMENT OF CORRECTIVE 21 SERVICES ACT 1988 22 amended by pt 3 23 Act Clause 8. This part amends the Corrective Services Act 1988. 24
