1993 A BILL FOR An Act to amend certain Acts administered by the Deputy Premier, Minister for Emergency Services and Minister for Rural Communities and Consumer Affairs, and to repeal certain Acts

 


 

6 Consumer Law (Miscellaneous Provisions) The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short This Act may be cited as the Consumer Law (Miscellaneous 4 Clause1. Provisions) Act 1993. 5 6 Commencement Clause2.(1) Section 8 commences on a day to be fixed by proclamation. 7 (2) The following amendments in Schedule 1 also commence on a day to 8 be fixed by proclamation-- 9 (a) amendments 3, 4, 8, 9, 36 and 38 of the Funeral Benefit 10 Business Act 1982; 11 (b) amendments 2, 3, 5 and 6 of the Retirement Villages Act 1988. 12 Acts--Schedule 1 13 Amended Each Act mentioned in Schedule 1 is amended as set out in the 14 Clause3. Schedule. 15 2 16 Repeals--Schedule Clause4. The Acts mentioned in Schedule 2 are repealed. 17

 


 

7 Consumer Law (Miscellaneous Provisions) ART 2--AMENDMENT OF AUCTIONEERS AND 1 P AGENTS ACT 1971 2 Act 3 Amended The Auctioneers and Agents Act 1971 is amended as set out in this 4 Clause5. Part. 5 of s.5 (Interpretation) 6 Amendment Section 5 (definitions "approved bank", "bank", "building 7 Clause6.(1) society" and "credit union")-- 8 omit. 9 (2) Section 5-- 10 insert-- 11 ` "approved financial institution" means a financial institution that-- 12 (a) has been prescribed by regulation to be a financial institution to 13 which section 96 applies; and 14 (b) has entered into an agreement under the section;'. 15 of s.6 (Auctioneers and Agents Committee) 16 Amendment Section 6(2C)-- 17 Clause7. omit `order in council', insert `the Governor in Council'. 18 of s.16 (Classes of licences) 19 Amendment Clause8.(1) Section 16(4)(a)(ii)-- 20 omit. 21 (2) Section 16(4)(a)(iii)-- 22 renumber as subparagraph (ii). 23

10 Consumer Law (Miscellaneous Provisions) of s.26 (How stock to be described in mortgage etc.) 1 Amendment Section 26-- 2 Clause16. omit all words from `some brand' to `of identification', 3 insert `the brand, earmark or other mark on them, or in another way that 4 reasonably allows them to be identified'. 5 PART 4--AMENDMENT OF CLASSIFICATION OF 6 PUBLICATIONS ACT 1991 7 Act 8 Amended The Classification of Publications Act 1991 is amended as set out 9 Clause17. in this Part. 10 of long title 11 Amendment Clause18. Long title (after `publications,')-- 12 insert `certain photographs,'. 13 of s.3 (Interpretation) 14 Amendment Clause19.(1) Section 3 (heading)-- 15 omit, insert-- 16 `Definitions'. 17 (2) Section 3-- 18 insert-- 19 ` "child abuse photograph" means a photograph or any other image or 20 material (however produced or reproduced) that-- 21 (a) depicts or describes in pictorial or other form a minor (whether or 22 not engaged in sexual activity) who is, or is apparently, under the 23 age of 16 years in a way that is likely to cause offence to a 24

After section 6-- 4 insert-- 5 by publications classification officer 6 `Delegation `6A. 14 Consumer Law (Miscellaneous Provisions) of s.37 (Exemptions) 1 Amendment Clause30.(1) Section 37(1) (after `specified publications')-- 2 insert `or child abuse photographs'. 3 (2) Section 37(2)-- 4 omit, insert-- 5 `(2) An exemption may only be given for publications or photographs 6 that are-- 7 (a) of a medical, educational or scientific character; or 8 (b) intended to be used by the person or body for a medical, 9 educational or scientific purpose.'. 10 (3) Section 37(3)(a) and (b) (after `publications')-- 11 insert `or photographs'. 12 PART 5--AMENDMENT OF HIRE-PURCHASE ACT 13 1959 14 Act 15 Amended The Hire-Purchase Act 1959 is amended as set out in this Part. 16 Clause31. of s.2 (Interpretation) 17 Amendment Clause32. Section 2(1) (definition "Hire-purchase agreement")-- 18 insert-- 19 `(d) that is a contract for the hiring of goods that is excluded from the 20 effect of section 15 of the Credit Act 1987 under section 21 of that 21 Act;'. 22

 


 

15 Consumer Law (Miscellaneous Provisions) ART 6--AMENDMENT OF LAND SALES ACT 1984 1 P Act 2 Amended The Land Sales Act 1984 is amended as set out in this Part. 3 Clause33. of s.6 (Interpretation) 4 Amendment Section 6(1)-- 5 Clause34. insert-- 6 ` "agreement" means-- 7 (a) a written contract of sale, or another instrument, under which a 8 sale or purchase is entered upon; or 9 (b) an oral contract of sale-- 10 (i) under which a sale or purchase is entered upon; and 11 (ii) that is enforceable because of a memorandum or note 12 satisfying section 59 of the Property Law Act 1974;'. 13 of s.7A (Part not to apply to large transactions) 14 Replacement Section 7A-- 15 Clause35. omit, insert-- 16 not to apply to large transactions 17 `Part `7A.(1) This Part does not apply to the sale or purchase of a 18 subdivisional portion, or proposed subdivisional portion, of relevant land if 19 the sale or purchase is part of a large transaction. 20 `(2) In subsection (1)-- 21 "large transaction" means the sale or purchase of 6 or more subdivisional 22 portions, or proposed subdivisional portions, of relevant land if-- 23 (a) the vendor of each portion is the same person; and 24 (b) the purchaser of each portion is the same person; and 25 (c) the sale or purchase is the subject of-- 26

 


 

16 Consumer Law (Miscellaneous Provisions) (i) a single agreement; or 1 (ii) 2 or more agreements entered into within 24 hours.'. 2 of s.31 (Contracting out of Act void) 3 Replacement Section 31-- 4 Clause36. omit, insert-- 5 out of Act void 6 `Contracting `31.(1) In this section-- 7 "avoidance provision" means a covenant, condition or other provision-- 8 (a) entered into, or imposed, in or for an agreement intended to bind 9 a person for the sale or purchase of relevant land or a proposed 10 lot; and 11 (b) under which it is agreed or acknowledged that a provision of this 12 Act does not apply to the agreement or a transaction under the 13 agreement. 14 `(2) An avoidance provision is void.'. 15 ART 7--AMENDMENT OF MOBILE HOMES ACT 16 P 1989 17 Act 18 Amended The Mobile Homes Act 1989 is amended as set out in this Part. 19 Clause37. of s.4 (Particulars of agreement) 20 Amendment Clause38.(1) Section 4(1) and (2) (at the end)-- 21 insert-- 22 `Maximum penalty--90 penalty units or imprisonment for 6 months.'. 23 (2) Section 4-- 24

 


 

17 Consumer Law (Miscellaneous Provisions) insert-- 1 `(1A) The owner of the site must not charge a fee for giving the 2 statement. 3 Maximum penalty--90 penalty units or imprisonment for 6 months.'. 4 of new s.11A 5 Insertion Clause39. After section 11-- 6 insert-- 7 of site must comply with clause 6(2A) of implied terms 8 `Owner `11A.(1) An owner of a site who does not comply with clause 6(2A) of 9 the implied terms of a relevant agreement mentioned in Part 1 of Schedule 1 10 commits an offence. 11 Maximum penalty--90 penalty units or imprisonment for 6 months. 12 `(2) An owner does not commit an offence against subsection (1) if-- 13 (a) the owner reasonably asked the occupier concerned for 14 information about the proposed assignee to help the owner to 15 make a decision to which clause 6(2A) applies; and 16 (b) the occupier did not comply with the request.'. 17 of Schedule 1 18 Amendment Clause40. Schedule 1, Part 1 (clause 6(2))-- 19 omit, insert-- 20 `(2) The owner must not unreasonably refuse to approve a proposed 21 assignee. 22 `(2A) If the occupier gives the owner a written request to approve a 23 proposed assignee, the owner must, within 1 month of receiving the 24 request-- 25 (a) give the occupier written notice of the owner's decision; and 26 (b) if the owner refuses the request--give written reasons for the 27 refusal.'. 28

 


 

18 Consumer Law (Miscellaneous Provisions) ART 8--AMENDMENT OF MOTOR VEHICLES 1 P SECURITIES ACT 1986 2 Act 3 Amended The Motor Vehicles Securities Act 1986 is amended as set out in 4 Clause41. this Part. 5 of s.28 (Compensation for loss etc. by holder of security 6 Amendment interest) 7 Section 28(1)-- 8 Clause42.(1) omit `Minister', insert `accountable officer'. 9 (2) Section 28(2) and (3)-- 10 omit, insert-- 11 `(2) The accountable officer may make a payment to the applicant under 12 section 106 of the Financial Administration and Audit Act 1977. 13 `(3) The accountable officer may make a payment for loss suffered after 14 the cancellation of a registration under section 20 only if the officer is 15 satisfied that the applicant did not show sufficient cause under the section 16 why the registration should not be cancelled-- 17 (a) because of circumstances beyond the applicant's control; or 18 (b) for reasons that ought reasonably to be excused.'. 19 (3) Section 28(5)-- 20 omit, insert-- 21 `(5) In this section-- 22 "accountable officer" means the accountable officer of the department 23 under the Financial Administration and Audit Act 1977.'. 24 of s.30 (Compensation for loss, etc. by purchaser) 25 Amendment Section 30(1)-- 26 Clause43.(1) omit `Minister', insert `accountable officer'. 27
