1994 A BILL FOR An Act to amend certain Acts administered by the Deputy Premier, Minister for Emergency Services and Minister for Rural Communities and Consumer Affairs of Queensland, and to repeal certain Acts

 


 

s1 4 s6 Consumer Law (Miscellaneous Provisions) The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short Clause 1. This Act may be cited as the Consumer Law (Miscellaneous 4 Provisions) Act 1994. 5 6 Commencement Clause 2. This Act commences on a day to be fixed by proclamation. 7 Acts--Sch 1 8 Amended Clause 3. Schedule 1 amends the Acts mentioned in it. 9 Acts--Sch 2 10 Repealed Clause 4. Schedule 2 repeals the Acts mentioned in it. 11 ART 2--AMENDMENT OF AUCTIONEERS AND 12 P AGENTS ACT 1971 13 Act 14 Amended Clause 5. The Auctioneers and Agents Act 1971 is amended in this Part. 15 of s 5 (Interpretation) 16 Amendment Clause 6. Section 5-- 17 insert-- 18

 


 

s7 5 s7 Consumer Law (Miscellaneous Provisions) ` "security interest certificate" means a security interest certificate under 1 the Motor Vehicles Securities Act 1986.'. 2 of s 57 (Guarantee of title) 3 Replacement Clause 7. Section 57-- 4 omit, insert-- 5 of title 6 `Guarantee `57.(1) This section applies if a used motor vehicle is sold by or for a 7 motor dealer to someone else (a "buyer"). 8 `(2) The motor dealer must ensure the buyer gains clear title to the motor 9 vehicle at the time of sale. 10 Maximum penalty--20 penalty units. 11 `(3) It is a defence for the motor dealer to prove that the dealer took all 12 reasonable steps to ensure subsection (2) is complied with. 13 `(4) The motor dealer must on the day of, and before, the sale-- 14 (a) give the buyer a security interest certificate for the vehicle issued 15 on the day of sale; and 16 (b) give the buyer an approved form stating-- 17 (i) particulars about the vehicle, including its identity and 18 odometer reading at the time of sale; and 19 (ii) that the dealer has ensured that the buyer will gain clear title 20 to the vehicle at the time of sale; and 21 (c) ask the buyer to sign an approved form acknowledging receipt of 22 the documents mentioned in paragraphs (a) and (b); and 23 (d) give the original of the form mentioned in paragraph (b) to the 24 buyer and keep a copy of the form. 25 Maximum penalty--20 penalty units. 26 `(5) In this section-- 27 "sell" includes sale by auction.'. 28

 


 

s8 6 s8 Consumer Law (Miscellaneous Provisions) of new ss 59A and 59B 1 Insertion Clause 8. After section 59-- 2 insert-- 3 with odometers 4 `Tampering `59A.(1) A person must not tamper with a motor vehicle's odometer 5 with intent to falsely represent that, at a particular time, the vehicle had not 6 travelled more than a specified distance. 7 Maximum penalty--100 penalty units. 8 `(2) If a court finds a person guilty of an offence against subsection (1), 9 the court may, on its own initiative or on the application of a person who 10 has suffered loss, order the person who committed the offence to 11 compensate for loss resulting from the commission of the offence. 12 `(3) In any proceeding, the distance shown at any time on the odometer 13 tampered with is evidence of a false representation by the person who 14 tampered with the odometer that the vehicle had not travelled more than the 15 distance shown on the odometer. 16 `(4) Subsection (2) does not limit a court's powers under the Penalties 17 and Sentences Act 1992 or any other law. 18 of tampering by a motor dealer 19 `Evidence `59B.(1) Evidence that a motor vehicle's odometer was tampered with 20 when the vehicle was in a dealer's possession is evidence that the dealer 21 contravened section 59A(1).1 22 `(2) Evidence that a motor vehicle's odometer reading shortly after a 23 dealer had possession of the vehicle was less than its reading when the 24 dealer took possession of the vehicle is evidence the dealer contravened 25 section 59A(1). 26 `(3) In this section-- 27 "possession" of a motor vehicle includes custody and control of the 28 vehicle.'. 29 1 Section 59A (Tampering with odometers).

 


 

s9 7 s 11 Consumer Law (Miscellaneous Provisions) of s 99 (Claims against the Fund) 1 Amendment Clause 9. Section 99-- 2 insert-- 3 `(2B) If a person recovers from the Fund more than the person is entitled 4 to recover from the Fund under subsection (2) (including an amount the 5 person must notify the Committee of under subsection (2A))-- 6 (a) the amount to which the person is not entitled is a debt owing to 7 the Fund; and 8 (b) the Committee may bring a civil action in a court of competent 9 jurisdiction to recover the debt for the Fund; and 10 (c) the Committee must pay any amounts recovered under 11 paragraph (b) to the Fund.'. 12 ART 3--AMENDMENT OF MOTOR VEHICLES 13 P SECURITIES ACT 1986 14 Act 15 Amended Clause 10. The Motor Vehicles Securities Act 1986 is amended in this Part. 16 of s 6 (Register) 17 Amendment Clause 11.(1) Section 6(1), `registrar'-- 18 omit, insert-- 19 `chief executive'. 20 (2) Section 6(2)(c)-- 21 omit, insert-- 22 `(c) the day and time the interest is registered;'. 23 (3) Section 6-- 24 insert-- 25

 


 

s 12 8 s 12 Consumer Law (Miscellaneous Provisions) `(3) The time of registration stated in the register must be expressed as 1 the relevant time in New South Wales.'. 2 of ss 22-24 3 Replacement Clause 12. Sections 22 to 24-- 4 omit, insert-- 5 interest certificate 6 `Security `22.(1) The chief executive must give a person a security interest 7 certificate for a vehicle if the person-- 8 (a) asks the chief executive, in the approved form, for the certificate; 9 and 10 (b) pays the fee prescribed under the regulations. 11 `(2) A security interest certificate for a motor vehicle must-- 12 (a) if security interests are registered for the vehicle--state particulars 13 about the security interests; and 14 (b) if no security interest is registered for the vehicle--state that fact. 15 `(3) The certificate must also state-- 16 (a) the day and time it is issued; and 17 (b) other particulars the chief executive considers appropriate. 18 `(4) The chief executive may issue the certificate in the way the chief 19 executive considers appropriate. 20 21 Example of the way the certificate may be issued-- 22 The chief executive may issue the certificate by electronic means from the 23 department's computer to a motor dealer's computer and printed by the dealer's 24 printer. `(5) The time of issue stated in the certificate must be expressed as the 25 relevant time in New South Wales. 26 the register 27 `Inspecting `23.
