1997 A BILL FOR An Act to facilitate certain aspects of an agreement about the establishment of a mine and other facilities on certain land in north-west Queensland

 


 

4 Century Zinc Project Parliament's reasons for enacting this Act are-- 1 1. Century Zinc Limited is developing a project involving preparing for 2 and operating a base metal mine to recover zinc, lead and silver from a 3 deposit at Lawn Hill, processing and concentrating the ore, transporting the 4 concentrate slurry by pipeline to Karumba on the Gulf of Carpentaria, 5 dewatering the ore, barging and shipping it for export and other related 6 activities. 7 2. After negotiations under the right to negotiate provisions of the Native 8 Title Act 1993 (Cwlth), the parties to the negotiations have made the 9 agreement allowing certain acts do be done. 10 3. The project will better provide infrastructure and services for people 11 and businesses in the area known as the Carpentaria-Mount Isa mineral 12 province. 13 4. The project will provide employment for Queenslanders and in 14 particular the people of the mineral province. 15 5. The project will improve the economy of Queensland and Australia. 16 6. The project will result in social and other benefits for all people of the 17 mineral province. 18 7. It is important that any native title should not be extinguished by the 19 grant of a right to mine or acquisition of land or interests in land affected by 20 the project and it is not intended to prevent native title claims being pursued. 21 8. It is in the national and State interest that the project start without delay. 22

 


 

s1 5 s3 Century Zinc Project The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short 1. This Act may be cited as the Century Zinc Project Act 1997. 4 5 Commencement 2.(1) This Act commences on a day to be fixed by proclamation. 6 (2) The Acts Interpretation Act 1954, section 15DA does not apply to 7 this Act. 8 of Act 9 Purpose 3. The purpose of this Act is to facilitate certain aspects of the agreement 10 made under the right to negotiate provisions of the Native Title Act 1993 11 (Cwlth) relating to-- 12 (a) the proposed development by Century Zinc Limited of a mine for 13 mining zinc, lead and other minerals; and 14 (b) the establishment of a corridor for use for miscellaneous transport 15 infrastructure, including for the construction, operation and 16 maintenance of a slurry pipeline from the mine site to the port of 17 Karumba; and 18 (c) the establishment by Century Zinc Limited of facilities at the port 19 of Karumba for processing (including dewatering), storage and 20 transport of mineral concentrates; and 21 (d) the construction of associated works for the purposes mentioned 22 in paragraphs (a), (b) and (c); and 23 (e) development proposed to be undertaken on land held by the 24 Bidunggu Aboriginal Land Trust. 25

 


 

s4 6 s6 Century Zinc Project 1 Dictionary 4. The dictionary in schedule 6 defines terms used in this Act. 2 ART 2--TAKING OF NATIVE TITLE AND 3 P EASEMENT 4 5 Taking 5.(1) Native title in land described in schedule 1, part 1, items 1 to 6 is 6 taken. 7 (2) Native title in land described in schedule 1, part 1, item 7 may be 8 taken by proclamation. 9 (3) Also, the following interests in land described in schedule 1, part 2 10 may be taken by proclamation-- 11 (a) native title; 12 (b) an easement. 13 (4) A proclamation under subsection (3) must state the rights and 14 obligations to be conferred or imposed by the easement. 15 (5) A proclamation under subsection (2) or (3) is not subordinate 16 legislation. 17 (6) Interests in land taken under this section vest in the State. 18 (7) This section has effect despite any other Act. 19 (8) This section applies subject to section 18. 20 of Land Act 1967 21 Acquisition 6.(1) The Acquisition of Land Act 1967 applies to a resumption under 22 section 5 with any necessary changes, including those mentioned in this 23 section. 24 (2) The provisions of the Acquisition of Land Act 1967 stated in 25 schedule 2 do not apply to the resumption under section 5. 26

 


 

s7 7 s8 Century Zinc Project (3) A person whose interest in land is taken has the right to claim 1 compensation under the Acquisition of Land Act 1967, section 12(5A) 2 and (5B) and part 4.1 3 (4) Subsection (3) applies subject to the agreement and the Native Title 4 (Queensland) Act 1993. 5 (5) A reference in a provision of the Acquisition of Land Act 1967 that 6 applies to a resumption under section 5, to a proclamation that takes land, is 7 taken to be a reference to section 5 or a proclamation under section 5. 8 of Acquisition of Land Act 1967 9 Application 7. In applying the Acquisition of Land Act 1967, part 4 under sections 5 10 and 6-- 11 (a) the State is the constructing authority; and 12 (b) a reference in the part to an owner of land includes a lessee of a 13 lease affected by a resumption under section 5; and 14 (c) the compensation claimant refers the claim for compensation to 15 the Land Court by filing in the office of the registrar of the 16 court-- 17 (i) copies of the claim given by the claimant to the State; and 18 (ii) a statement identifying the provisions of this Act or any 19 instrument under this Act that effected the taking. 20 ART 3--TITLES 21 P of ss 9-10 22 Purpose 8.(1) The main purpose of sections 9 and 10 is to remove any doubt 23 about the validity of the leases mentioned in the sections because of the 24 native title Acts and in the light of certain decisions of the High Court of 25 1 Part 4 (Compensation)

 


 

s9 8 s 10 Century Zinc Project Australia.2 1 (2) In this section-- 2 "native title Acts" means-- 3 · the Native Title Act 1993 (Cwlth); and 4 · the Native Title (Queensland) Act 1993. 5 and grant of term lease 6 Cancellation 9.(1) Term lease 205674 of lot 6 on CP892041, county of Gregory, 7 parish of Bulmung, issued to the company (the "former lease") is 8 cancelled. 9 (2) A term lease of lot 6 on CP892041, county of Gregory, parish of 10 Bulmung (the "new lease") is granted to the company. 11 (3) The new lease is taken to have been granted under the Land Act 1994 12 on the same terms as the former lease. 13 (4) However, the term of the new lease starts on the commencement of 14 this section. 15 (5) Also, the new lease is granted in full satisfaction of any rights arising 16 out of or in relation to the former lease. 17 (6) Anything done under the former lease is taken to have been validly 18 done under the new lease. 19 and grant of mining leases 20 Cancellation 10.(1) Mining leases 90045 and 90058 (the "former leases") granted 21 under the Mineral Resources Act 1989 are cancelled. 22 (2) Mining leases 90045 and 90058 (the "new leases") are granted to the 23 company. 24 (3) The Mineral Resources Act 1989, section 318 does not apply to the 25 2 North Ganalanja Aboriginal Corporation & Anor v. State of Queensland & Ors. 185 CLR 595, and The Wik Peoples v. State of Queensland & Ors. 187 CLR 1

 


 

s 11 9 s 12 Century Zinc Project former leases only because of their cancellation under subsection (1).3 1 (4) Each new lease is taken to be have been granted under the Mineral 2 Resources Act 1989 on the same terms as the corresponding former lease. 3 (5) However, the term of each new lease starts on the commencement of 4 this section. 5 (6) Also, each new lease is granted in full satisfaction of any rights 6 arising out of or in relation to the corresponding former lease. 7 (7) Anything done under the former leases is taken to have been validly 8 done under the new leases. 9 of certain port land 10 Vesting 11.(1) The land described in schedule 3 is vested in the Ports Corporation 11 of Queensland and is taken to be strategic port land under an approved land 12 use plan under the Transport Infrastructure Act 1994, section 171. 13 (2) For subsection (1) and schedule 3, item 3, lease SL 34/38495 of 14 lot 72 on NM 54 is taken. 15 (3) Compensation for the resumption under subsection (2) is payable to 16 The Far North Queensland Electricity Board by the Ports Corporation of 17 Queensland. 18 (4) The amount and conditions of compensation under subsection (3) are 19 to be decided by the Governor in Council. 20 about easement resumed under s 5(3)(b) 21 Declaration 12.(1) Despite the Transport Infrastructure Act 1994, it is declared that 22 the easement described in schedule 1, part 2, whether it is taken under 23 section 5 or in another way-- 24 (a) is a public utility easement under the Land Act 1994; and 25 (b) is a miscellaneous transport infrastructure corridor under the 26 Transport Infrastructure Act 1994. 27 3 See the Mineral Resources Act 1989, section 318 (Rehabilitation of land covered by mining lease).

 


 

s 13 10 s 13 Century Zinc Project (2) If the easement is taken under section 5, for subsection (1)(b) the 1 easement is taken to have been acquired by the chief executive for the State 2 under the Transport Planning and Coordination Act 1994. 3 (3) Also, for ensuring the construction, operation and maintenance of 4 miscellaneous transport infrastructure in the corridor-- 5 (a) a licence under the Transport Infrastructure Act 1994 in relation 6 to the infrastructure has the effect of a contract under seal between 7 the licensee and any person having an interest in land affected by 8 the easement; and 9 (b) the licensee may enforce rights granted under the licence against 10 the person. 11 roads, reserves, watercourses etc. 12 Crossing 13.(1) This section applies to the parts of reserves, roads, watercourses 13 and land of other tenure mentioned in schedule 1, part 1, item 7 (the 14 "land"). 15 (2) This section applies only for ensuring miscellaneous transport 16 infrastructure can be constructed, operated and maintained across the land. 17 (3) The rights and obligations conferred or imposed by the easement 18 apply to the land. 19 (4) However, the rights and obligations can not be exercised or 20 performed because of this section unless the entity responsible for the land 21 gives to a licensee under the Transport Infrastructure Act 1994 consent to 22 the exercise or performance of the rights and obligations. 23 (5) If the responsible entity fails to give the consent under subsection (4), 24 the licensee may apply to the Premier for the consent. 25 (6) The consent of the Premier under subsection (5) is taken for all 26 purposes to be the consent of the responsible entity. 27 (7) In this section-- 28 "responsible entity" means the following-- 29 (a) for a non-tidal watercourse--the chief executive of the department 30 through which the Water Resources Act 1989 is administered; 31 (b) for a tidal watercourse--the chief executive of the department 32

 


 

s 14 11 s 16 Century Zinc Project through which the Transport Infrastructure Act 1994 is 1 administered; 2 (c) for a reserve--the trustee of the reserve; 3 (d) for a road--the local government for the area in which the road is 4 located or, if the road is a State controlled road, the chief executive 5 of the department through which the Transport Infrastructure Act 6 1994 is administered; 7 (e) otherwise--the chief executive of the deparment through which 8 the Land Act 1994 is administered. 9 PART 4--GREGORY OUTSTATION 10 of part 11 Application 14. This part applies only in relation to the use or development proposed 12 to be undertaken under a development application made to the Burke Shire 13 Council (the "council") by the Bidunggu Aboriginal Land Trust in relation 14 to lot 13 on CP855144 (the "Gregory outstation proposal"). 15 call-in power 16 Ministerial 15. The Minister may call in the development application for the Gregory 17 outstation proposal whether or not the council has decided the application. 18 of exercise of call-in power 19 Notice 16.(1) The Minister may call in the development application by written 20 notice given to the council and-- 21 (a) if the application has not been decided by the council--assess and 22 decide the application; or 23 (b) if the application has been decided by the council--reassess and 24 re-decide the application. 25 (2) The notice must state the reasons for calling in the application. 26

 


 

s 17 12 s 17 Century Zinc Project (3) The Minister must give a copy of the notice to the applicant and 1 anyone else whose concurrence to the development application is required. 2 of call-in 3 Effect 17.(1) If the Minister calls in the development application before the 4 council makes a decision on the application, the Minister-- 5 (a) must continue the process from the point at which the application 6 is called in; and 7 (b) has the powers of the council for the application from the time the 8 application is called in. 9 (2) If the Minister calls in the development application after the council 10 makes a decision on the application-- 11 (a) the process starts again from a point in the process the Minister 12 decides; and 13 (b) the Minister has the powers of the council for the application 14 from that point in the process. 15 (3) Also, if the application is called in-- 16 (a) an entity whose concurrence is required may give advice about 17 the application; and 18 (b) if an appeal has been made--the appeal is of no further effect; and 19 (c) a person may not appeal against the decision of the Minister 20 under the Act or law under which the application is made (the 21 "relevant law"). 22 (4) The council must provide the Minister with all reasonable assistance 23 required by the Minister to decide the application, including giving the 24 Minister-- 25 (a) all relevant material about the application the council had before 26 the application was called in; and 27 (b) any relevant material received by the council after the application 28 was called in. 29 (5) When the Minister gives notice of the decision to the applicant, the 30 Minister must also give a copy to the council. 31

 


 

s 18 13 s 20 Century Zinc Project (6) The decision of the Minister is taken to be the decision of the council 1 under the relevant law for all purposes other than appeal. 2 PART 5--NATIVE TITLE 3 of resumption and grant of rights in relation to native title 4 Effect interests 5 18. It is Parliament's intention that-- 6 (a) this Act and anything done under this Act does not extinguish and 7 has not extinguished any native title in land; and 8 (b) the non-extinguishment principle under the Native Title Act 1993 9 (Cwlth) applies to anything done under this Act. 10 of Native Title (Queensland) Act 11 Application 19. For the Native Title (Queensland) Act 1993, the taking of an interest 12 in land under section 5 is taken to be an acquisition of land under a State 13 Compulsory Acquisition Act.4 14 of interest taken to include certain words 15 Grant 20. s 21 14 s 21 Century Zinc Project ART 6--MISCELLANEOUS 1 P power 2 Regulation-making 21.(1) The Governor in Council may make regulations under this Act. 3 (2) A regulation may, in relation to any interest taken under a 4 proclamation under this Act, describe the boundaries of the land affected by 5 the proclamation. 6 (3) The boundaries described are taken-- 7 (a) to be the boundaries of the land affected by the proclamation; and 8 (b) to be included, from the date of assent of this Act, within the 9 boundaries referred to in schedule 1, part 1, item 7 and 10 schedule 1, part 2. 11 (4) Subsection (3) applies whether or not the boundaries described 12 would, if this section had not been passed, be included within the 13 boundaries referred to in the proclamation or in schedule 1, part 1, item 7 14 and schedule 1, part 2. 15 (5) A regulation under subsection (2) must be made within 2 years after 16 the first proclamation made under section 5. 17 (6) The power under subsection (2) to (4) may only be used for the 18 following purposes-- 19 (a) to enable the land mentioned in those subsections to be surveyed; 20 (b) to make necessary adjustments of the description of the 21 boundaries after consideration of concerns for cultural heritage 22 and geological impediments. 23 24

19 Century Zinc Project CHEDULE 4 1 ¡S TATEMENT TAKEN TO BE INCLUDED IN 2 S INTERESTS GRANTED UNDER THIS ACT 3 section 20 4 `If any native title exists in the land and the grant of this [Title] would 5 validly affect it in some way, then the grant of this [Title] is wholly 6 inconsistent with the native title, but it is intended that (without in any way 7 affecting any of the [Grantee's] rights during the term of the grant, including 8 the [Grantee's] right of exclusive possession)-- 9 (a) the native title in the land should nevertheless continue to exist 10 and not be extinguished by the grant of this [Title] or the exercise 11 of any of the rights granted hereunder; 12 (b) the native title should never have any effect upon or in relation to 13 this [Title] or any act or right of the [Grantee]; 14 (c) the persons who are entitled in accordance with any traditional 15 laws and customs, as applying from time to time, to possess the 16 native title should continue to be native title holders; 17 (d) if this [Title] or any act done under this [Title] ceases to have 18 effect to an extent, the native title rights and interests should again 19 have effect to that extent; 20 (e) if this [Title] or its effects are wholly removed or otherwise 21 wholly cease to operate, the native title rights and interests again 22 have full effect.' 23

21 Century Zinc Project CHEDULE 6 1 ¡S ICTIONARY 2 D section 4 3 "company" means Century Zinc Limited A.C.N. 006 670 300, its 4 successors in title and permitted assigns. 5 "council", for part 4, see section 14. 6 "development application", for part 4, means an application for approval 7 under any of the following for the use or development to which part 4 8 applies-- 9 (a) the Local Government (Planning and Environment) Act 1990; 10 (b) the Building Act 1975; 11 (c) the Standard Water Supply Law; 12 (d) the Standard Sewerage Law; 13 (e) a local law of the council. 14 "miscellaneous transport infrastructure" means miscellaneous transport 15 infrastructure under the Transport Infrastructure Act 1994. 16 "the agreement" means the agreement under the right to negotiate 17 provisions of the Native Title Act 1993 (Cwlth) made on 7 May 1997 18 between the following-- 19 · Henry Aplin, Peter Bell, Shirley Chong, Don George, Peter 20 O'Keefe and Beryl Willetts for themselves and the Waanyi 21 people 22 · Stella Diamond and Jane Karkadoo for themselves and all 23 persons descended from Ned Lorraine, Hislop Jacob, Harry 24 (Father of Bonny Pedro) and Trooper Campbell and on behalf of 25 any other Aboriginal people of the claim and neighbouring region 26 to the north and south of the claim area, whose old people were 27 also traditional owners, and customary users, of the claim area, 28 some of those people identifying as Mingginda people 29
