1999 A BILL FOR An Act to amend the Defamation Act 1889

 


 

s1 4 s3 Defamation Amendment The Parliament of Queensland enacts-- 1 title 2 Short Clause 1. This Act may be cited as the Defamation Amendment Act 1999. 3 amended 4 Act Clause 2. This Act amends the Defamation Act 1889. 5 of new s 15A 6 Insertion Clause 3. After section 15-- 7 insert-- 8 to Minister, member of Legislative 9 `Protection--communications Assembly or staff member 10 `15A.(1) It is lawful for a constituent to publish defamatory matter to a 11 member of the Legislative Assembly or to a person who is a member of the 12 member's staff (a "staff member") if the publication is made without 13 malice. 14 `(2) It is lawful for a staff member to publish the defamatory matter to 15 the member if the publication is made without malice. 16 `(3) It is lawful for the member to publish the defamatory matter to a 17 Minister or to a staff member if the publication is made without malice. 18 `(4) In any proceeding about the publication of defamatory matter 19 mentioned in subsection (1), (2) or (3), the onus of proving the publication 20 was made with malice is for the party alleging it was made with malice. 21 `(5) In this section-- 22 "constituent" means a person ordinarily entitled to vote in the State.'. 23
