1999 A BILL FOR An Act to amend the Forestry Act 1959

 


 

s1 4 s4 Forestry Amendment Bill The Parliament of Queensland enacts-- 1 title 2 Short Clause 1. This Act may be cited as the Forestry Amendment Act 1999. 3 amended 4 Act Clause 2. This Act amends the Forestry Act 1959. 5 of s 5 (Definitions) 6 Amendment Clause 3. Section 5-- 7 insert-- 8 ` "native forest hardwood sawlogs" means native hardwood timber for 9 use for sawmilling. 10 "native forest sawlog allocation system" see section 69A. 11 "sales permit" means a permit granted under section 56.'. 12 of s 46 (Corporation may sell forest products or quarry 13 Amendment material the property of the Crown) 14 Clause 4.(1) Section 46(2), from `permit'-- 15 omit, insert-- 16 `sales permit for getting the forest products or quarry material'. 17 (2) Section 46-- 18 insert-- 19 `(3) Without limiting subsection (2), a sales permit for getting native 20 forest hardwood sawlogs under the native forest sawlog allocation system 21 for south-east Queensland may-- 22 (a) be granted for a period of not more than 25 years; and 23 (b) provide for compensation payable to the permittee in stated 24

 


 

s5 5 s7 Forestry Amendment Bill circumstances; and 1 (c) require the permittee to give the State the first right of refusal to an 2 assignment or transfer of the permit.'. 3 of s 58 (Power to cancel, suspend, permit, licence etc.) 4 Amendment Clause 5. Section 58-- 5 insert-- 6 `(8) Subsection (7) does not prevent the payment of compensation for 7 suspension or cancellation of a sales permit in particular circumstances if the 8 permit provides for compensation to be paid in the circumstances.'. 9 of s 69C (Specific authorisation for grant of permit to get 10 Amendment native forest sawlogs) 11 Clause 6. Section 69C(2)-- 12 insert-- 13 `(f) the payment of compensation to the permittee in stated 14 circumstances; 15 (g) the State's first right of refusal to an assignment or transfer of the 16 permit.'. 17 of s 69D (Expiry of pt 7A) 18 Amendment Clause 7.
