2000 A BILL FOR An Act to make further amendments consequential on the matters dealt with by the Federal Courts (State Jurisdiction) Act 1999 or by Commonwealth legislation relating to federal courts and tribunals

 


 

s1 6 s3 Federal Courts (Consequential Amendments) The Parliament of Queensland enacts-- 1 ART 1--PRELIMINARY 2 P title 3 Short Clause 1. This Act may be cited as the Federal Courts (Consequential 4 Amendments) Act 2000. 5 ART 2--AGRICULTURAL AND VETERINARY 6 P CHEMICALS (QUEENSLAND) ACT 1994 7 amended in pt 2 8 Act Clause 2. This part amends the Agricultural and Veterinary Chemicals 9 (Queensland) Act 1994. 10 of s 3 (Definitions) 11 Amendment Clause 3.(1) Section 3, definition "Commonwealth administrative laws", 12 paragraph (a)(i), after `1975'-- 13 insert-- 14 `, excluding part IVA'. 15 (2) Section 3, definition "Commonwealth administrative laws", 16 paragraph (a)(ii)-- 17 omit. 18 (3) Section 3, definition "Commonwealth administrative laws", 19 paragraphs (a)(iii) to (v)-- 20 renumber as paragraphs (a)(ii) to (iv). 21

s8 8 s 11 Federal Courts (Consequential Amendments) ART 3--AMENDMENT OF COMPETITION POLICY 1 P REFORM (QUEENSLAND) ACT 1996 2 amended in pt 3 3 Act Clause 8. This part amends the Competition Policy Reform (Queensland) Act 4 1996. 5 of pt 5, div 3 6 Omission Clause 9. Part 5, division 3-- 7 omit. 8 of s 29 (Definition) 9 Amendment Clause 10.(1) Section 29, definition "Commonwealth administrative laws", 10 paragraph (a)(i), after `(Cwlth)'-- 11 insert-- 12 `, excluding part IVA'. 13 (2) Section 29, definition "Commonwealth administrative laws", 14 paragraph (a)(ii)-- 15 omit. 16 (3) Section 29, definition "Commonwealth administrative laws", 17 paragraph (a)(iii) to (v)-- 18 renumber as paragraph (a)(ii) to (iv). 19 of new s 33A 20 Insertion Clause 11. s 12 9 s 13 Federal Courts (Consequential Amendments) that Act is taken to be a reference to the whole or any part of that part as it 1 has effect as a law of the Commonwealth.'. 2 ART 4--AMENDMENT OF CORPORATIONS 3 P (QUEENSLAND) ACT 1990 4 amended in pt 4 5 Act Clause 12. This part amends the Corporations (Queensland) Act 1990. 6 of s 3 (Definitions) 7 Amendment Clause 13.(1) Section 3(1), definition "Family Court"-- 8 omit. 9 (2) Section 3(1)-- 10 insert-- 11 ` "Commonwealth authority" means an authority or body (whether 12 incorporated or not) that is established or continued in existence by or 13 under an Act of the Commonwealth. 14 "officer of the Commonwealth" has the same meaning as in section 75(v) 15 of the Constitution of the Commonwealth.'. 16 (3) Section 3(1), definition "Commonwealth administrative laws", 17 paragraphs (a) and (b)-- 18 omit, insert-- 19 `(a) the Administrative Appeals Tribunal Act 1975 (Cwlth), excluding 20 part IVA;'. 21 (4) Section 3(1), definition "Commonwealth administrative laws", 22 paragraphs (c) to (e)-- 23 renumber as paragraphs (b) to (d). 24

 


 

s 14 10 s 16 Federal Courts (Consequential Amendments) of new s 36A 1 Insertion Clause 14. After section 36-- 2 insert-- 3 of references to part IVA of Commonwealth AAT Act 4 `Construction `36A. For the purposes of sections 35 and 36, a reference in a provision 5 of the Administrative Appeals Tribunal Act 1975 (Cwlth) (as that provision 6 applies as a law of this jurisdiction) to the whole or any part of part IVA of 7 that Act is taken to be a reference to the whole or any part of that part as it 8 has effect as a law of the Commonwealth.'. 9 of s 40 (Operation of division) 10 Amendment Clause 15. Section 40(1)-- 11 insert-- 12 `(c) the jurisdiction of courts in respect of matters arising under the 13 Administrative Decisions (Judicial Review) Act 1977 (Cwlth) 14 involving or related to decisions made under the Corporations 15 Law of a State or the Capital Territory by Commonwealth 16 authorities and officers of the Commonwealth; and 17 (d) the jurisdiction of courts in civil matters in respect of decisions 18 made by officers of the Commonwealth to prosecute persons for 19 offences against the Corporations Law of a State or the Capital 20 Territory and related criminal justice process decisions;'. 21 of s 41 (Interpretation) 22 Amendment Clause 16.(1) Section 41(1), definition "superior court"-- 23 omit. 24 (2) Section 41(1)-- 25 insert-- 26 ` "superior court" means the Supreme Court of a State or Territory or a 27 State Family Court.'. 28

 


 

s 17 11 s 17 Federal Courts (Consequential Amendments) (3) Section 41(2)(a)(viii)-- 1 omit. 2 (4) Section 41(2)(a)(ix)-- 3 renumber as section 41(2)(a)(viii). 4 of s 42 (Jurisdiction of Federal Court and State and 5 Amendment Territory Supreme Courts) 6 Clause 17.(1) Section 42, heading, `Federal Court and' 7 omit. 8 (2) Section 42(1), `as it applies as a law of Queensland,'-- 9 omit. 10 (3) Section 42-- 11 insert-- 12 `(1A) Despite section 9 of the Administrative Decisions (Judicial Review) 13 Act 1977 (Cwlth), jurisdiction is conferred on the Supreme Court of 14 Queensland and of each other State and the Capital Territory with respect to 15 matters arising under that Act involving or related to decisions made, or 16 proposed to be made, under the Corporations Law of a State or the Capital 17 Territory by a Commonwealth authority or an officer of the 18 Commonwealth. 19 `(1B) Subsection (1A) applies to a decision made, or proposed or 20 required to be made-- 21 (a) whether or not in the exercise of a discretion; and 22 (b) whether before or after the commencement of this subsection.'. 23 (4) Section 42(2), after `subsection (1)' 24 insert-- 25 `or (1A)'. 26 (5) Section 42(3)-- 27 omit, insert-- 28 `(3) This section has effect subject to section 42AA.'. 29

 


 

s 18 12 s 19 Federal Courts (Consequential Amendments) of s 42A (Jurisdiction of Family Court and State Family 1 Amendment Courts) 2 Clause 18.(1) Section 42A, heading, `Family Court and'-- 3 omit. 4 (2) Section 42A(1)-- 5 omit. 6 (3) Section 42A(2), `as it applies as a law of Queensland,'-- 7 omit. 8 (4) Section 42A-- 9 insert-- 10 `(4) This section has effect subject to section 42AA.'. 11 of new s 42AA 12 Insertion Clause 19. After section 42A-- 13 insert-- 14 of Supreme Court in relation to certain decisions made 15 `Jurisdiction by Commonwealth officers 16 `42AA.(1) If a decision to prosecute a person for an offence against the 17 Corporations Law of Queensland has been made by an officer or officers of 18 the Commonwealth and the prosecution is proposed to be commenced in a 19 court of Queensland, jurisdiction is conferred on the Supreme Court with 20 respect to any matter in which a person seeks a prerogative order or an 21 injunction against the officer or officers in relation to that decision. 22 `(2) At any time when-- 23 (a) a prosecution for an offence against the Corporations Law of 24 Queensland is before a court of Queensland; or 25 (b) an appeal arising out of such a prosecution is before a court of 26 Queensland; 27 jurisdiction is conferred on the Supreme Court with respect to any matter in 28 which the person who is or was the defendant in the prosecution seeks a 29 prerogative order or an injunction against an officer or officers of the 30

 


 

s 20 13 s 21 Federal Courts (Consequential Amendments) Commonwealth in relation to a related criminal justice process decision. 1 `(3) Subsections (1) and (2) have effect despite anything in this Act or in 2 any other law. 3 `(4) In this section-- 4 "appeal" includes an application for a new trial and a proceeding to review 5 or call in question the proceedings, decision or jurisdiction of a court or 6 judge. 7 "prerogative order" means an order the relief or remedy under which is in 8 the nature of, and to the same effect as, a writ of mandamus or 9 prohibition. 10 "related criminal justice process decision", in relation to an offence, 11 means a decision, other than a decision to prosecute, made in the 12 criminal justice process in relation to the offence, including-- 13 (a) a decision in connection with the investigation, committal for trial 14 or prosecution of the defendant; and 15 (b) a decision in connection with the appointment of investigators or 16 inspectors for the purposes of such an investigation; and 17 (c) a decision in connection with the issue of a warrant, including a 18 search warrant or a seizure warrant; and 19 (d) a decision requiring the production of documents, the giving of 20 information or the summoning of persons as witnesses; and 21 (e) a decision in connection with an appeal arising out of the 22 prosecution.'. 23 of s 42B (Jurisdiction of lower courts) 24 Amendment Clause 20. Section 42B(1), `as it applies as a law of Queensland'-- 25 omit. 26 of s 43 (Appeals) 27 Amendment Clause 21.(1) Section 43(1), `or to the Federal Court or to the Family Court'-- 28 omit. 29

s 22 15 s 22 Federal Courts (Consequential Amendments) pending in the Supreme Court of a State or the Capital Territory 1 (the "relevant jurisdiction"), the court must transfer the proceeding to the 2 Federal Court unless the matter for determination in it arises out of, or 3 relates to, another proceeding pending in any court of the relevant 4 jurisdiction-- 5 (a) that arises, or a substantial part of which arises, under the 6 Corporations Law of a State or the Capital Territory; and 7 (b) that is not with respect to a matter referred to in section 42(1A); 8 regardless of which proceeding was commenced first. 9 `(4) Even if the Supreme Court of a State or the Capital Territory is not 10 required by subsection (3) to transfer a proceeding with respect to a matter 11 referred to in section 42(1A) to the Federal Court, it may nevertheless do so 12 if it considers that to be appropriate, having regard to the interests of justice, 13 including the desirability of related proceedings being heard in the same 14 jurisdiction. 15 `(5) If a proceeding with respect to a matter referred to in section 42(1A) 16 is pending in the Federal Court, the Federal Court may only transfer the 17 proceeding, or an application in the proceeding, to the Supreme Court of a 18 State or the Capital Territory (the "relevant jurisdiction") if-- 19 (a) the matter arises out of, or relates to, another proceeding pending 20 in any court of the relevant jurisdiction-- 21 (i) that arises, or a substantial part of which arises, under the 22 Corporations Law of a State or the Capital Territory; and 23 (ii) that is not a proceeding with respect to a matter referred to in 24 section 42(1A); 25 regardless of which proceeding was commenced first; and 26 (b) the Federal Court considers the transfer to be appropriate, having 27 regard to the interests of justice, including the desirability of 28 related proceedings being heard in the same jurisdiction. 29 `(6) Nothing in this section confers on a court jurisdiction that the court 30 would not otherwise have. 31 `(7) The fact that some references in this section to the interests of justice 32 include the desirability of related proceedings being heard in the same 33
