This part amends the Adoption Act 2009. 4

`290A Application for notice of adoptions in another country 8
`(1) This section applies if-- 9
(a) an adoption is granted in a country other than Australia 10
or New Zealand; and 11
(b) before the adoption, the adoptive parents were-- 12
(i) assessed or re-assessed as suitable under part 6; or 13
(ii) favourably assessed as a prospective adopter under 14
the repealed Adoption of Children Act 1964. 15
`(2) An interested person may apply, in the approved form, to the 16
chief executive to give notice to the registrar to record the 17
adoption in the adopted children register. 18
`(3) The interested person must give to the chief executive any 19
documents relating to the adoption, or the identification of the 20
adopted person, that the chief executive reasonably requires. 21
`(4) In this section-- 22
interested person, for an adoption, means-- 23
(a) the adopted person; 24
(b) if the adopted person is a child, deceased, or does not 25
have capacity to make the application--a relative of the 26
adopted person. 27

`290B Deciding applications for notice of adoptions in 1
another country 2
`(1) If, on application under section 290A, the chief executive is 3
reasonably satisfied that the adopted person was adopted in 4
the other country under arrangements made between the chief 5
executive and the competent authority for the other country, 6
the chief executive must give notice to the registrar to record 7
the adoption in the adopted children register. 8
`(2) If the chief executive decides not to give notice to the 9
registrar, the chief executive must give the applicant an 10
information notice for the decision. 11
`(3) The chief executive may not make a decision mentioned in 12
subsection (2) having regard to information other than the 13
information received from the applicant unless the chief 14
executive-- 15
(a) gives notice of the information to the applicant; and 16
(b) allows the applicant a reasonable opportunity to make 17
submissions to the chief executive about the 18
information. 19
`290C Registrar to record information about adoptions 20
granted in another country 21
`(1) This section applies if the chief executive gives the registrar 22
notice under section 290B(1) about an adoption in another 23
country. 24
`(2) The registrar must record the adoption by incorporating the 25
notice about the adoption in the adopted children register.'. 26
