2001 A BILL FOR An Act to amend the Gas Act 1965
s1 4 s5 Gas Amendment Bill (No. 2) 2001 The Parliament of Queensland enacts-- 1 1 Short title Clause 2 This Act may be cited as the Gas Amendment Act (No. 2) 2001. 3 2 Act amended Clause 4 This Act amends the Gas Act 1965. 5 3 Amendment of s 2 (Relationship to prescribed Acts) Clause 6 (1) Section 2(2)-- 7 insert-- 8 `(ab)Gas Pipelines Access (Queensland) Law; or'. 9 (2) Section 2(2)(ab) to (c)-- 10 renumber as section 2(2)(b) to (d). 11 4 Amendment of s 5 (Definitions) Clause 12 (1) Section 5, definition "contestable consumer", `section 5B'-- 13 omit, insert-- 14 `section 33A'. 15 (2) Section 5, definition "non-contestable consumer", `section 5C'-- 16 omit, insert-- 17 `section 33B'. 18 5 Relocation and renumbering of s 5B (Meaning of "contestable 19 consumer") Clause 20 Section 5B-- 21 relocate and renumber, in part 5, as inserted by this Act, as section 33A. 22

s9 6 s9 Gas Amendment Bill (No. 2) 2001 (ii) a transmission pipeline, to the extent its operation or use 1 affects the operation or use of a covered distribution 2 pipeline; and 3 4 Examples of `arrangements' that may be provided for-- 5 1. The registration and identification of, or access to, delivery points. 6 2. The provision of meters and telemetry equipment. 7 3. The nature and storage of information and the communication of, and 8 access to, that information. 9 4. Gas nomination and balancing. 10 5. Consumer transfer processes. (b) impose stated terms on the arrangements; and 11 (c) provide for the legal effect or enforcement of the terms, 12 including, for example, by dispute resolution, arbitration or court 13 proceedings. 14 `(2) The regulation may apply, adopt or incorporate a code of conduct, or 15 an amendment of a code of conduct, made by the Minister about the 16 arrangements mentioned in subsection (1). 17 `(3) The code, or amendment of the code, does not take effect unless it is 18 approved under a regulation. 19 `(4) In this section-- 20 "covered distribution pipeline" means a distribution pipeline within the 21 meaning of the Gas Pipelines Access (Queensland) Law that is a 22 covered pipeline within the meaning of that law. 23 "transmission pipeline" means a transmission pipeline within the 24 meaning of the Gas Pipelines Access (Queensland) Law.1 25 `33F Tabling and inspection of code of conduct 26 `(1) This section applies if, under section 33E(2), a regulation applies, 27 adopts or incorporates a code of conduct, or an amendment of a code of 28 conduct. 29 1 See the Gas Pipelines Access (Queensland) Law, schedule 1, section 2, definitions "distribution pipeline" and "transmission pipeline". For coverage under that law, see schedule 2 of the law, part 1 (Coverage) and section 10.8, definition "covered pipeline".
s 10 7 s 11 Gas Amendment Bill (No. 2) 2001 `(2) The Minister must, within 14 sitting days after the regulation is 1 gazetted, table a copy of the code, or the amendment or amended code, in 2 the Legislative Assembly. 3 `(3) The Minister must keep a copy of the code, as in force from time to 4 time, open for inspection, free of charge, by members of the public during 5 office hours on business days at-- 6 (a) the department's head office; and 7 (b) other places the Minister considers appropriate. 8 `(4) A failure to comply with this section does not invalidate or 9 otherwise affect the code or the regulation.'. 10 10 Relocation and renumbering of ss 52D and 52E Clause 11 Sections 52D and 52E-- 12 relocate and renumber, in part 5, as inserted by this Act, as sections 33C 13 and 33D. 14 11 Amendment of s 64 (Regulation-making power) Clause 15 Section 64(2A)-- 16 omit. © State of Queensland 2001
