2003 A BILL FOR An Act to provide for the salary payable to a person holding the office of Governor of the State of Queensland, the pensions payable to former Governors and their surviving partners, the ending of entitlements to pensions, and for related purposes

 


 

s1 4 s4 Governors (Salary and Pensions) Bill 2003 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title 3 This Act may be cited as the Governors (Salary and Pensions) Act 2003. 4 2 Dictionary 5 The dictionary in the schedule defines particular words used in this Act. 6 PART 2--SALARY 7 3 Salary of Governor 8 A salary is payable to the Governor at the rate prescribed under a 9 regulation. 10 4 Salary of Acting Governor 11 (1) For the period when a person is an Acting Governor, a salary is 12 payable to the person at the rate payable to the Governor. 13 (2) However, the amount of the salary payable under subsection (1) to a 14 person is to be reduced, including to zero, by the amount of salary payable 15 for the same period to the person as the Lieutenant-Governor, the Chief 16 Justice or a Supreme Court judge.1 17 1 See the Constitution of Queensland 2001, section 41(3) for the persons who must administer the Government of the State as Acting Governor.

 


 

s5 5 s7 Governors (Salary and Pensions) Bill 2003 PART 3--PENSIONS 1 Division 1--Introductory 2 5 Purposes of part 3 The purposes of this part are to provide for-- 4 (a) the entitlement of a former Governor to a pension; and 5 (b) the entitlement of a surviving partner of a deceased Governor to a 6 pension; and 7 (c) the rates of the pensions payable; and 8 (d) other matters relevant to the entitlement to pensions and the rate 9 of pensions. 10 6 Other divisions in this part 11 (1) Division 2 sets out the entitlement to, and rates of, pensions payable. 12 (2) Division 3 sets out provisions that may affect the entitlement to, and 13 amounts of, pensions payable. 14 (3) Division 4 sets out provisions that may result in the ending of an 15 entitlement to a pension. 16 (4) The provisions in division 2 are subject to the provisions in 17 divisions 3 and 4, and the provisions in division 3 are subject to the 18 provisions in division 4. 19 Division 2--Entitlements and rates of pensions payable 20 7 Pension relating to Governor appointed after commencement 21 (1) This section applies to a person appointed Governor after the 22 commencement of this section who is an Australian citizen at the time of 23 appointment. 24 (2) When the person ceases to hold the office, a pension is payable to the 25 person for the person's lifetime if-- 26 (a) the person has held the office for 5 years or more; or 27

 


 

s8 6 s8 Governors (Salary and Pensions) Bill 2003 (b) the Minister declares, under section 11,2 that the person is 1 entitled to a pension under this subsection. 2 (3) The rate of the pension is equal to 35% of the rate of salary payable 3 to the person as Governor immediately before the person ceases to hold the 4 office. 5 (4) If the person dies while holding the office, a pension is payable to the 6 person's surviving partner for the surviving partner's lifetime at the rate 7 equal to five-eighths of the rate of pension that would have been payable to 8 the person if the person-- 9 (a) ceased to hold the office immediately before the death; and 10 (b) had been entitled to a pension on ceasing to hold the office. 11 (5) If the person dies after ceasing to hold the office and, immediately 12 before the death, a pension is payable under subsection (2) to the person, a 13 pension is payable to the person's surviving partner for the surviving 14 partner's lifetime at a rate equal to five-eighths of the amount of the 15 pension payable to the person immediately before the death. 16 8 Pension relating to Governor holding office immediately 17 before commencement 18 (1) This section applies to the person holding the office immediately 19 before the commencement of this section. 20 (2) When the person ceases to hold the office, a pension is payable to the 21 person for the person's lifetime at a rate equal to 60% of the rate of salary 22 payable to the person as Governor immediately before the person ceases to 23 hold the office. 24 (3) If the person dies while holding the office, a pension is payable to the 25 person's surviving partner for the surviving partner's lifetime at the rate 26 equal to five-eighths of the rate of pension that would have been payable to 27 the person if the person-- 28 (a) ceased to hold the office immediately before the death; and 29 (b) had been entitled to a pension on ceasing to hold the office. 30 (4) If the person dies after ceasing to hold the office and, immediately 31 before the death, a pension is payable to the person, a pension is payable to 32 the person's surviving partner for the surviving partner's lifetime at a rate 33 2 Section 11 (If Governor ceases to hold office within 5 years of appointment)

 


 

s9 7 s 11 Governors (Salary and Pensions) Bill 2003 equal to five-eighths of the amount of the pension payable to the person 1 immediately before the death. 2 9 Provisions relating to each former Governor to whom a pension is 3 payable before commencement 4 (1) This section applies to each former Governor to whom a pension is 5 payable immediately before the commencement of this section. 6 (2) The former Governor continues to be entitled to be paid the pension 7 for the former Governor's lifetime. 8 (3) The amount of the pension payable continues to be the amount of the 9 pension payable to the former Governor immediately before the 10 commencement. 11 (4) When the former Governor dies, a pension is payable to the former 12 Governor's surviving partner for the surviving partner's lifetime at a rate 13 equal to five-eighths of the amount of pension payable to the former 14 Governor immediately before the death. 15 10 Provisions relating to each surviving partner of deceased 16 Governor, to whom a pension is payable before commencement 17 (1) This section applies to each surviving partner of a deceased Governor 18 if a pension was payable to the surviving partner immediately before the 19 commencement of this section. 20 (2) The surviving partner continues to be entitled to be paid the pension 21 for the surviving partner's lifetime. 22 (3) The amount of the pension payable to the surviving partner continues 23 to be the amount of the pension payable to the surviving partner 24 immediately before the commencement. 25 Division 3--Provisions that may affect pension entitlement or amount of 26 pensions 27 11 If Governor ceases to hold office within 5 years of appointment 28 (1) A person who held the office for less than 5 years may apply to the 29 Minister for the payment of a pension under section 7(2) on the ground that 30

 


 

s 12 8 s 12 Governors (Salary and Pensions) Bill 2003 the person was, immediately before ceasing to hold the office, incapable of 1 performing the duties of the office. 2 (2) The Minister may declare that the person is entitled to a pension 3 under section 7(2) if the Minister is satisfied the person ceased to hold the 4 office because, at the time of ceasing to hold the office, the person was 5 incapable of performing the duties of the office. 6 (3) If the Minister decides that the person ceased to hold the office for a 7 reason other than the person was incapable of performing the duties of the 8 office, the Minister must give the person written reasons for the decision. 9 12 Election for lump sum to meet surcharge liability 10 (1) This section applies to each of the following persons-- 11 (a) a former Governor to whom a pension is payable; 12 (b) a surviving partner of a person who died while holding the office 13 if a pension is payable after the death to the surviving partner. 14 (2) The person may elect to be paid a lump sum, instead of a part of the 15 pension payable. 16 (3) The maximum amount that may be paid as a lump sum under the 17 election is the amount of the surcharge liability attributable to holding the 18 office. 19 (4) The election must be-- 20 (a) made in writing to the Minister; and 21 (b) accompanied by a copy of the surcharge liability notice stating 22 the amount of the surcharge liability. 23 (5) The Minister must act on the election by reducing the pension by the 24 amount of the lump sum. 25 (6) The reduction must happen in the way decided by the Minister on the 26 advice of an actuary. 27 (7) In this section-- 28 "surcharge liability" means the amount a person is liable to pay to the 29 commissioner of taxation, under the Superannuation Contributions 30 Tax (Members of Constitutionally Protected Superannuation Funds) 31 Assessment and Collection Act 1997 (Cwlth), section 15. 32

 


 

s 13 9 s 13 Governors (Salary and Pensions) Bill 2003 "surcharge liability notice" means a notice given to a person by the 1 commissioner of taxation, under the Superannuation Contributions 2 Tax (Members of Constitutionally Protected Superannuation Funds) 3 Assessment and Collection Act 1997 (Cwlth), section 15. 4 13 Minimum benefit payable 5 (1) This section applies in relation to each of the following persons-- 6 (a) a person who ceases to hold the office; 7 (b) a person who dies while holding the office. 8 (2) If an actuary approved by the Minister decides there is an entitlement 9 to a minimum benefit for the person, the minimum benefit must be paid to 10 an approved deposit fund, or a superannuation fund, nominated by or for 11 the person, despite another provision of this Act. 12 (3) In this section-- 13 "approved deposit fund" see the Superannuation Industry (Supervision) 14 Act 1993 (Cwlth), section 10.3 15 "minimum benefit" means the amount of payment, pension or preserved 16 benefit entitlement that is necessary to ensure a superannuation 17 guarantee charge is not imposed on the State under the 18 Superannuation Guarantee Charge Act 1992 (Cwlth). 19 "superannuation fund" see the Superannuation Industry (Supervision) 20 Act 1993 (Cwlth), section 10.4 21 3 Superannuation Industry (Supervision) Act 1993 (Cwlth), section 10-- approved deposit fund means a fund that-- (a) is an indefinitely continuing fund; and (b) is maintained by an approved trustee solely for approved purposes. 4 Superannuation Industry (Supervision) Act 1993 (Cwlth), section 10-- superannuation fund means-- (a) a fund that: (i) is an indefinitely continuing fund; and (ii) is a provident, benefit, superannuation or retirement fund; or (b) a public sector superannuation scheme.

 


 

s 14 10 s 15 Governors (Salary and Pensions) Bill 2003 14 Competing claims for pension as surviving partner 1 (1) This section applies to a pension payable to a surviving partner of a 2 deceased Governor if the appointment as Governor was made on or after 3 29 July 1997. 4 (2) If, apart from this subsection, the pension would be payable to more 5 than 1 surviving partner because the deceased Governor left more than 1 6 surviving partner-- 7 (a) the pension is payable as decided by the Minister after 8 consultation with the member who is recognised in the 9 Legislative Assembly as the Leader of the Opposition; and 10 (b) the total amount of pension payable to the surviving partners at 11 any time must be equal to the amount of the pension that would 12 have been payable if the deceased Governor left only 1 surviving 13 partner. 14 (3) For subsection (2)(a), the Minister may decide-- 15 (a) that the pension is not payable to 1 or some, but not all, of the 16 surviving partners; or 17 (b) subject to subsection (2)(b), how the amount of the pension is to 18 be apportioned between the surviving partners. 19 (4) For subsection (3), the Minister must have regard to the needs of each 20 of the surviving partners and other matters the Minister reasonably 21 considers relevant. 22 15 Indexation 23 (1) This section applies to a pension payable to a person during a 24 financial year if the pension was payable to the person immediately before 25 the start of the financial year. 26 (2) After the start of the financial year, the Minister must reassess the 27 amount of the pension and either increase it or maintain it at the same level 28 as in the previous financial year, as follows-- 29 (a) if the June index for the previous financial year is higher than the 30 last adjustment index for the pension, the pension must be 31 increased by the percentage increase between the 2 indexes; 32 (b) otherwise, the pension remains the same. 33

 


 

s 16 11 s 16 Governors (Salary and Pensions) Bill 2003 (3) If the pension for the financial year is increased under the 1 reassessment, the pension is payable to the person at the increased level 2 from 1 July in the financial year and increased payments must begin from 3 the first full pay period in August in that financial year. 4 (4) A percentage increase between 2 indexes under subsection (2)(a) 5 must be calculated to 1 decimal place by increasing the percentage to the 6 next highest single decimal place. 7 (5) In this section-- 8 "June index", for a financial year, means the all groups consumer price 9 index for Brisbane, published by the Australian Statistician, for the 10 last quarter of the financial year. 11 "last adjustment index", for a pension, means-- 12 (a) if the pension has ever been increased under this section or 13 repealed section 4, the June index for the financial year 14 immediately before the financial year in which the pension was 15 last increased under this section or repealed section 4; or 16 (b) otherwise, the June index for the financial year immediately 17 before the financial year in which the pension began to be 18 payable. 19 "repealed section 4" means the Governors' Pensions Act 1977, section 4 20 as in force before the commencement of this section. 21 16 Reduction of pension payable if other relevant entitlement 22 (1) This section applies if-- 23 (a) a pension would, apart from this section, be payable to a former 24 Governor for a financial year; and 25 (b) a relevant entitlement is payable to the former Governor for the 26 financial year. 27 (2) If the amount of the relevant entitlement for the financial year is-- 28 (a) less than the amount of the pension that would be payable for the 29 financial year, the amount of the pension that would be payable 30 must be reduced for the financial year by the amount of the 31 relevant entitlement; or 32

 


 

s 17 12 s 17 Governors (Salary and Pensions) Bill 2003 (b) the same as or more than the amount of the pension that would be 1 payable for the financial year, a pension is not payable for the 2 financial year. 3 (3) In this section-- 4 "relevant entitlement" means a pension or retiring allowance payable, 5 whether under a law or otherwise, out of moneys wholly or partially 6 provided by the State, the Commonwealth or another State in relation 7 to a remunerative activity undertaken by a former Governor before the 8 person held the office, and does not include an amount payable by 9 way of pension, benefit or allowance under-- 10 (a) the Veterans' Entitlements Act 1986 (Cwlth); or 11 (b) the Social Security Act 1991 (Cwlth); or 12 (c) another Act of the State, the Commonwealth or another State that 13 is prescribed under a regulation for this section. 14 Division 4--Provisions that may result in end of entitlements to pensions 15 17 Definitions for div 4 16 In this division-- 17 "accountable Governor" means either of the following-- 18 (a) a former Governor if-- 19 (i) the former Governor is entitled to a pension, including a 20 former Governor appointed to the office before the 21 commencement of this section; and 22 (ii) there is a finding of an established tribunal that the former 23 Governor misbehaved in a way that justifies ending the 24 entitlement as mentioned in section 18(2), including 25 misbehaviour before, during or after the appointment to the 26 office; 27 (b) a deceased Governor if-- 28 (i) the deceased Governor was, immediately before the death, 29 entitled to a pension, including a deceased Governor who 30 was appointed to the office before the commencement of 31 this section; and 32

 


 

s 18 13 s 18 Governors (Salary and Pensions) Bill 2003 (ii) there was an appointment resolution in relation to the 1 deceased Governor before the death; and 2 (iii) there is a finding that the deceased Governor misbehaved in 3 a way that would justify ending the prescribed entitlement 4 as mentioned in section 18(2), including misbehaviour 5 before, during or after the appointment to the office. 6 "appointment resolution" means a resolution of the Legislative 7 Assembly, appointing the members of an established tribunal. 8 "established tribunal" means a tribunal established under an Act as 9 mentioned in section 18(3)(a). 10 "lump sum" means an amount paid in relation to a former Governor-- 11 (a) under section 12; or 12 (b) under the Governors' Pensions Act 1977, section 5A, as in force 13 before the commencement of this section. 14 "prescribed entitlement" means either of the following but does not 15 include an entitlement to a payment under section 135-- 16 (a) when used in relation to a former Governor--the former 17 Governor's entitlement to a pension under this Act; 18 (b) when used in relation to a deceased Governor--the entitlement 19 of a surviving partner of the deceased Governor to a pension 20 under this Act. 21 18 Entitlement to pension may end 22 (1) A prescribed entitlement ends if the Legislative Assembly resolves 23 that there is proved misbehaviour justifying ending the prescribed 24 entitlement. 25 (2) Misbehaviour justifying ending a prescribed entitlement is proved 26 only if the Legislative Assembly accepts a finding of an established 27 tribunal, stated in a report of the established tribunal, that, on the balance of 28 probabilities, the accountable Governor misbehaved in a way that justifies 29 ending the prescribed entitlement. 30 (3) A tribunal relating to a former Governor-- 31 5 Section 13 (Minimum benefit payable)

 


 

s 19 14 s 19 Governors (Salary and Pensions) Bill 2003 (a) is to be established under an Act and has the functions, powers, 1 protection and immunity given under an Act; and 2 (b) is to consist of at least 3 members, appointed by appointment 3 resolution. 4 (4) A person may be appointed to the established tribunal relating to a 5 former Governor only if-- 6 (a) the person is a former judge or justice of a State or Federal 7 superior court in Australia; and 8 (b) the person and the former Governor were not members of the 9 same court at the same time. 10 (5) The established tribunal must report to the Legislative Assembly 11 whether, on the balance of probabilities, the accountable Governor 12 misbehaved in a way that justifies ending the prescribed entitlement. 13 (6) For this section, each of the following is not relevant-- 14 (a) when an accountable Governor was appointed to the office; 15 (b) when the misbehaviour took place; 16 (c) the death of a person who, immediately before the death, was a 17 former Governor to whom an appointment resolution related. 18 19 Example for subsection (6)-- 20 A tribunal may be established about a former Governor appointed before this section 21 commenced relating to the former Governor's behaviour that took place before, during 22 or after the person held the office. The established tribunal may make a report about the 23 former Governor even though the former Governor dies before the established tribunal 24 makes its report. 19 Amounts previously paid as pension or lump sum if accountable 25 Governor's entitlement ends 26 (1) Either or both of the following may include a provision about 27 recovering all or a stated part of an amount paid to or for an accountable 28 Governor as a pension or as a lump sum-- 29 (a) a resolution of the Legislative Assembly under section 18(1); 30 (b) a report of an established tribunal under section 18(5). 31 (2) If a resolution under section 18(1) provides that a stated amount is to 32 be recovered, that amount is a debt due to the State and may be recovered 33 in a way prescribed under a regulation. 34

 


 

s 20 15 s 23 Governors (Salary and Pensions) Bill 2003 PART 4--MISCELLANEOUS MATTERS 1 20 Accrual and payment of pensions 2 A pension accrues daily and is payable fortnightly or, subject to the 3 Treasurer's approval, at other intervals. 4 21 Appropriation 5 (1) This section applies to amounts payable-- 6 (a) under part 2 as salary; and 7 (b) under part 3 as a pension, lump sum stated in an election under 8 section 126 or other form of payment. 9 (2) The amounts are payable out of the consolidated fund, which is 10 appropriated to the extent necessary. 11 22 Minister is manager for Commonwealth Act 12 (1) This section applies for the Superannuation Contributions Tax 13 (Members of Constitutionally Protected Superannuation Funds) 14 Assessment and Collection Act 1997 (Cwlth), section 38, definition 15 "trustee" in relation to the scheme as a constitutionally protected 16 superannuation fund under the Commonwealth Act. 17 (2) The Minister is taken to manage the scheme. 18 (3) In this section-- 19 "scheme" means the scheme established by this Act for providing pensions 20 to former Governors and the surviving partners of deceased 21 Governors. 22 23 Regulation-making power 23 The Governor in Council may make regulations under this Act. 24 6 Section 12 (Election for lump sum to meet surcharge liability)

 


 

s 24 16 s 26 Governors (Salary and Pensions) Bill 2003 PART 5--TRANSITIONAL PROVISIONS 1 24 Salary payable to Governor immediately before commencement 2 (1) This section applies to the person who holds the office immediately 3 before the commencement of this section. 4 (2) The salary payable to the person immediately before the 5 commencement continues to be the salary payable to the person as 6 Governor, despite section 3.7 7 25 No entitlement to pension if no pension payable under the 8 Governors' Pensions Act 1977 9 If, immediately before the commencement of this section, a pension 10 under the Governors' Pensions Act 1977 was not payable to a former 11 Governor or a surviving partner of a deceased Governor, a pension does not 12 become payable to the former Governor or surviving partner on the 13 commencement. 14 PART 6--REPEALS 15 26 Repeal of Acts 16 The following Acts are repealed-- 17 · Governors' Pensions Act 1977 No. 1 18 · Governor's Salary Act 1872 36 Vic No. 9. 19 7 Section 3 (Salary of Governor)

 


 

17 Governors (Salary and Pensions) Bill 2003 SCHEDULE 1 DICTIONARY 2 section 2 3 "accountable Governor", for part 3, division 4, see section 17. 4 "actuary" means a person with actuarial knowledge and experience. 5 "appointment resolution", for part 3, division 4, see section 17. 6 "cease to hold the office" does not including dying while holding the 7 office. 8 "deceased Governor" means-- 9 (a) a person who died while holding the office; or 10 (b) a person who died after the person ceased to hold the office. 11 "established tribunal", for part 3, division 4, see section 17. 12 "former Governor" means a person who held the office but who is not 13 deceased. 14 "Governor" means the person holding the office. 15 "lump sum" see section 17. 16 "office" means the office of Governor of the State of Queensland. 17 "payable", relating to a pension, means payable under this Act, including 18 continuing to be payable under this Act. 19 "prescribed entitlement", for part 3, division 4, see section 17. 20 "surviving partner" means the following-- 21 (a) a person who was married to a deceased Governor at the time of 22 the deceased Governor's death; 23 (b) a defacto partner of a deceased Governor if before the death of 24 the deceased Governor-- 25 (i) the defacto partner and the Governor or former Governor 26 had a defacto relationship for a continuous period of at least 27 2 years ending on the death; or 28
