Gas Security Amendment Bill 2011 Part 1 Preliminary [s 1] The Parliament of Queensland enacts-- 1 Part 1 Preliminary 2 Clause 1 Short title 3 This Act may be cited as the Gas Security Amendment Act 4 2011. 5 Clause 2 Commencement 6 (1) Section 9 commences on 1 July 2011. 7 (2) Sections 11, 12, 14 to 16 and 28(3) commence on a day to be 8 fixed by proclamation. 9 Part 2 Amendment of Mineral 10 Resources Act 1989 11 Clause 3 Act amended 12 This part amends the Mineral Resources Act 1989. 13 Clause 4 Amendment of s 381A (Definitions for pt 10AA) 14 Section 381A, definition affected land-- 15 omit, insert-- 16 `affected land means land that, on 5 November 2008, was-- 17 (a) a part of the place given the name of Collingwood Park 18 and entered in the Gazetteer of Place Names under the 19 Place Names Act 1994; and 20 Page 6

Gas Security Amendment Bill 2011 Part 3 Amendment of National Gas (Queensland) Act 2008 [s 8] Clause 8 Amendment of s 7 (Application in Queensland of National 1 Gas Law) 2 Section 7-- 3 insert-- 4 `(1A) The National Gas Law, chapter 2, part 6, division 2A as set 5 out in the schedule to the South Australian Act applies to, and 6 in relation to, the State.'. 7 Clause 9 Insertion of new s 15A 8 After section 15-- 9 insert-- 10 `15A Carpentaria Gas Pipeline 11 `(1) The arrangements stated in this section apply for the pipeline 12 which-- 13 (a) is the subject of pipeline licence 41; and 14 (b) is known as the Carpentaria Gas Pipeline; and 15 (c) starts at Ballera and ends at Mt Isa. 16 `(2) From the commencement, the pipeline is taken to be a covered 17 pipeline and a transmission pipeline. 18 `(3) For the period starting on the commencement and ending on 19 30 April 2023, the services provided by the pipeline-- 20 (a) are taken to be the subject of a light regulation 21 determination; and 22 (b) can not be made the subject of a full access 23 arrangement. 24 `(4) In this section-- 25 commencement means the commencement of this section.'. 26 Page 8

 


 

Gas Security Amendment Bill 2011 Part 4 Amendment of Petroleum and Gas (Production and Safety) Act 2004 [s 10] Part 4 Amendment of Petroleum and 1 Gas (Production and Safety) 2 Act 2004 3 Clause 10 Act amended 4 This part amends the Petroleum and Gas (Production and 5 Safety) Act 2004. 6 Clause 11 Amendment of s 35 (Call for tenders) 7 Section 35(2)(e)-- 8 insert-- 9 `(v) if any part of the proposed area of the authority is 10 to be subject to an Australian market supply 11 condition--the part of the proposed area and the 12 condition.'. 13 Clause 12 Amendment of s 42 (Provisions of authority to prospect) 14 Section 42-- 15 insert-- 16 `(3A) The conditions of the authority may include an Australian 17 market supply condition applying to all or part of the area of 18 the authority.'. 19 Clause 13 Amendment of s 118 (Requirements for making 20 ATP-related application) 21 (1) Section 118(e)-- 22 renumber as section 118(g). 23 (2) Section 118-- 24 insert-- 25 `(e) include information to satisfy the requirements for grant 26 mentioned in section 121; and 27 Page 9

 


 

Gas Security Amendment Bill 2011 Part 4 Amendment of Petroleum and Gas (Production and Safety) Act 2004 [s 14] (f) include evidence of certification by an entity the chief 1 executive is satisfied is independent and appropriately 2 qualified to certify that the resources and reserves of 3 petroleum in the proposed area satisfy the requirements 4 of section 121(1)(b)(ii); and'. 5 (3) Section 118-- 6 insert-- 7 `(2) The chief executive may refuse to receive an application that 8 does not include-- 9 (a) the proposed development plan mentioned in subsection 10 (1)(d)(iv); and 11 (b) evidence of certification mentioned in subsection (1)(f). 12 `(3) If the chief executive refuses to receive an application, the 13 chief executive must-- 14 (a) give the applicant notice of the refusal that states the 15 reason for the refusal; and 16 (b) refund the fee accompanying the application.'. 17 Clause 14 Amendment of s 123 (Provisions of petroleum lease) 18 Section 123-- 19 insert-- 20 `(3A) The conditions of the lease may include an Australian market 21 supply condition applying to all or part of the area of the 22 lease.'. 23 Clause 15 Amendment of s 127 (Call for tenders) 24 Section 127(2)(e)-- 25 insert-- 26 `(v) if any part of the proposed area of the lease is to be 27 subject to an Australian market supply 28 condition--the part of the proposed area and the 29 condition.'. 30 Page 10

 


 

Gas Security Amendment Bill 2011 Part 4 Amendment of Petroleum and Gas (Production and Safety) Act 2004 [s 16] Clause 16 Insertion of new ch 2, pt 2A 1 Chapter 2-- 2 insert-- 3 `Part 2A Prospective Gas Production 4 Land Reserve 5 `175A Meaning of Australian market supply condition 6 `An Australian market supply condition, for land, is a 7 condition under which-- 8 (a) gas produced from the land must not be supplied other 9 than to the Australian market; and 10 (b) any contract or other arrangement for the supply of the 11 gas must include a condition that the gas must not be 12 further supplied other than to the Australian market. 13 `175B Meaning of Australian market 14 `Australian market, in relation to the supply of gas, means an 15 entity or entities that will-- 16 (a) consume the gas within Australia; or 17 (b) supply the gas to an entity or entities that will consume 18 the gas within Australia. 19 `175C Supply of gas from PGPLR land 20 `(1) The holder of a petroleum tenure for PGPLR land-- 21 (a) must not supply gas produced from the land other than 22 to the Australian market; and 23 (b) must include in any contract or other arrangement for 24 the supply of the gas a condition that the gas must not be 25 further supplied other than to the Australian market. 26 Maximum penalty--1000 penalty units. 27 Page 11

 


 

Gas Security Amendment Bill 2011 Part 4 Amendment of Petroleum and Gas (Production and Safety) Act 2004 [s 16] `(2) However, if the application of the Australian market supply 1 condition to the land has been suspended under section 2 175G(1) for a stated period, subsection (1) does not apply to 3 the holder for the stated period. 4 `(3) An entity to which gas produced from PGPLR land is 5 supplied-- 6 (a) must not further supply the gas other than to the 7 Australian market; and 8 (b) must include in any contract or other arrangement for 9 the supply of the gas a condition that the gas must not be 10 further supplied other than to the Australian market. 11 Maximum penalty--1000 penalty units. 12 `(4) However, if the entity holds an exemption under section 13 175G(2) for a stated period in relation to the land, subsection 14 (3) does not apply to the entity, for the stated period, in 15 relation to gas produced from the land. 16 `(5) Subsection (3)(a) applies subject to section 175D. 17 `175D Urgent exemption from application of s 175C(3)(a) 18 `(1) Subsection (2) applies if-- 19 (a) an entity is a consumer of gas; and 20 (b) because of technical or operational problems, the entity 21 is unable to consume gas produced from PGPLR land 22 and supplied to the entity; and 23 (c) the entity has taken all reasonable steps to supply the gas 24 to the Australian market but the entity considers it is not 25 commercially viable to do so; and 26 (d) the entity supplies the gas other than to the Australian 27 market; and 28 (e) the entity gives notice of the supply of the gas, the 29 reason for the supply and the date the technical or 30 operational problem arose, to the chief executive within 31 5 days after starting to supply the gas. 32 Page 12

 


 

Gas Security Amendment Bill 2011 Part 4 Amendment of Petroleum and Gas (Production and Safety) Act 2004 [s 16] Example of a technical or operational problem for paragraph (b)-- 1 the failure of the entity's plant or machinery 2 `(2) Section 175C(3)(a) does not apply to the entity for 30 days 3 after the technical or operational problem arises. 4 `175E Suspension of application of, or exemption from, 5 Australian market supply condition 6 `(1) The holder of a petroleum tenure for PGPLR land may apply 7 to the Minister for a suspension, for a stated period, of the 8 application of the Australian market supply condition to the 9 land if-- 10 (a) market analysis indicates that, during the stated period, 11 sufficient gas may be produced from existing and 12 proposed petroleum tenures in the State to supply both 13 the Australian market and export demand; or 14 (b) the holder has taken all reasonable steps to supply the 15 gas produced from the PGPLR land to the Australian 16 market but it is not commercially viable to do so. 17 `(2) An entity to which gas produced from PGPLR land is 18 supplied may apply to the chief executive for an exemption, 19 for a stated period, from section 175C(3) in relation to the 20 land if-- 21 (a) market analysis indicates that, during the stated period, 22 sufficient gas may be produced from existing and 23 proposed petroleum tenures in the State to supply both 24 the Australian market and export demand; or 25 (b) the entity has taken all reasonable steps to supply the gas 26 produced from the PGPLR land to the Australian market 27 but it is not commercially viable to do so. 28 `175F Assessing commercial viability 29 `In assessing commercial viability of the supply of gas 30 produced from PGPLR land for section 175E, the Minister or 31 the chief executive may have regard to the following-- 32 Page 13

 


 

Gas Security Amendment Bill 2011 Part 4 Amendment of Petroleum and Gas (Production and Safety) Act 2004 [s 16] (a) whether the rate of return on the investment of money 1 required to produce gas from the land and supply it to 2 the Australian market at least meets the rate of return 3 considered acceptable by a reasonable petroleum 4 producer or a lender to a petroleum producer; 5 (b) the market conditions at the time the application is made 6 under section 175E including, for example, access to 7 markets, the expected duration of a contract or other 8 arrangement for the supply of the gas, the price likely to 9 be paid for the gas and the certainty and timing of 10 market opportunities; 11 (c) whether, if commercial viability is dependent on the 12 applicant reaching agreement with another entity or 13 using the other entity's facilities or technology, the 14 applicant can complete the agreement or use the 15 facilities or technology on terms the applicant considers 16 provide a reasonable rate of return for the applicant. 17 `175G Deciding application 18 `(1) The Minister may grant an application mentioned in section 19 175E(1) only if the Minister is satisfied about a matter 20 mentioned in section 175E(1)(a) or (b). 21 `(2) The chief executive may grant an application mentioned in 22 section 175E(2) only if the chief executive is satisfied about a 23 matter mentioned in section 175E(2)(a) or (b). 24 `(3) If the Minister or chief executive refuses to grant an 25 application, the applicant must be given an information notice 26 for the decision. 27 `175H Requirement to keep and give records 28 `(1) This section applies to the following (each a selling entity)-- 29 (a) the holder of a petroleum lease for PGPLR land who 30 supplies gas produced from the land; 31 (b) another entity that supplies gas produced from PGPLR 32 land. 33 Page 14

 


 

Gas Security Amendment Bill 2011 Part 4 Amendment of Petroleum and Gas (Production and Safety) Act 2004 [s 16] `(2) A selling entity must, for the period and in the way prescribed 1 under a regulation, keep the records prescribed under a 2 regulation for each supply by the selling entity of gas 3 produced from PGPLR land. 4 Maximum penalty--500 penalty units. 5 `(3) If the chief executive gives a selling entity a notice asking for 6 a copy of a record kept under subsection (2), the selling entity 7 must give a copy of the record to the chief executive within 8 the reasonable period stated in the notice. 9 Maximum penalty--500 penalty units. 10 `175I Order to enforce compliance with s 175C 11 `(1) This section applies if, on the application of the chief 12 executive, the District Court is satisfied-- 13 (a) the holder of a petroleum tenure for PGPLR land is 14 supplying gas produced from the land other than to the 15 Australian market, contrary to section 175C(1)(a); or 16 (b) an entity to which gas produced from PGPLR land was 17 supplied is further supplying the gas other than to the 18 Australian market, contrary to section 175C(3)(a). 19 `(2) The court may make either or both of the following orders-- 20 (a) an order granting an injunction, on terms the court 21 considers appropriate, restraining the holder or other 22 entity from supplying the gas other than to the 23 Australian market; 24 (b) another order the court considers appropriate. 25 `(3) The court may decide not to make an order under this section 26 in relation to the holder if the court considers that section 27 790(1)(b) or (c) provides a more appropriate way of dealing 28 with the issue.'. 29 Page 15
