Justice and Other Legislation Amendment Bill 2010 Part 2 Amendment of Acts Interpretation Act 1954 [s 6] cooperative scheme means the cooperative scheme as defined 1 under the Crimes at Sea Act 2001, section 3. 2 criminal laws means the substantive criminal law, and the law 3 of criminal investigation, procedure and evidence, within the 4 meaning of the cooperative scheme. 5 laws of the State means the laws, whether written or 6 unwritten and whether substantive or procedural, that are from 7 time to time in force in the State, but does not include-- 8 (a) laws of the Commonwealth; or 9 (b) criminal laws. 10 `47A Application of laws of the State to coastal waters 11 `The laws of the State apply in and in relation to-- 12 (a) the coastal waters of the State; and 13 (b) the seabed and subsoil beneath, and the airspace above, 14 the coastal waters of the State; 15 as if the coastal waters of the State, as extending from time to 16 time, were within the limits of the State. 17 `47B Laws with specific application not to apply 18 `(1) Nothing in this part makes a provision of the laws of the State 19 applicable in or in relation to a particular place-- 20 (a) to the extent the provision is incapable of applying in or 21 in relation to that place; or 22 (b) if those laws expressly provide that the provision does 23 not extend or apply in or in relation to that place; or 24 (c) if those laws expressly provide that the provision applies 25 only in a stated locality in the State that does not include 26 that place. 27 `(2) A provision of the laws of the State is not to be taken to be a 28 provision to which subsection (1) applies merely because it is 29 limited in its application to acts, matters and things within 30 Page 16

 


 

Justice and Other Legislation Amendment Bill 2010 Part 2 Amendment of Acts Interpretation Act 1954 [s 6] Queensland waters, coastal waters or the adjacent area, 1 however described, of the State. 2 `47C Extent of jurisdiction in relation to coastal waters 3 `(1) A person who has a function or power conferred on the person 4 under a law for the purposes of or in connection with a 5 provision of the laws of the State has and may perform the 6 function for the purposes of or in connection with that 7 provision, as applying because of this part, as if the coastal 8 waters of the State, as extending from time to time, were 9 within the limits of the State. 10 `(2) All courts of the State are invested with jurisdiction in all 11 matters arising under the provisions of the laws of the State, as 12 applying because of this part, as if the coastal waters of the 13 State, as extending from time to time, were within the limits 14 of the State. 15 `47D Constitutional basis 16 `In addition to any other power under which the provisions of 17 this part may be enacted, the provisions of this part are 18 enacted under the legislative power of Parliament as extended 19 by the Coastal Waters (State Powers) Act 1980 (Cwlth), 20 section 5 and the Coastal Waters (State Title) Act 1980 21 (Cwlth), section 4. 22 `47E Saving 23 `Nothing in this part limits any law, other than this part, that 24 provides for the application of the laws of the State, or any 25 part of those laws, beyond the limits of the State. 26 Note-- 27 Some Acts have special application provisions, for example, the 28 following-- 29 · Fisheries Act 1994, section 11 30 · Offshore Minerals Act 1998, section 16 31 Page 17
