2002 A BILL FOR An Act to amend various Acts administered by the Attorney-General and Minister for Justice, and for other purposes

 


 

s1 8 s3 Justice and Other Legislation (Miscellaneous Provisions) Bill 2002 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title Clause 3 This Act may be cited as the Justice and Other Legislation 4 (Miscellaneous Provisions) Act 2002. 5 2 Commencement Clause 6 (1) Sections 8, 56 and 571 commence on a day to be fixed by 7 proclamation. 8 (2) Section 342 is taken to have commenced on 14 May 2002. 9 (3) Section 453 is taken to have commenced on 1 July 1999. 10 (4) Schedule 6,4 to the extent it amends the Corporations (Queensland) 11 Act 1990, is taken to have commenced on 1 January 1991. 12 (5) Schedule 6, to the extent it amends the Electoral and Other Acts 13 Amendment Act 2002, is taken to have commenced on 5 June 2002. 14 PART 2--AMENDMENT OF ATTORNEY-GENERAL 15 ACT 1999 16 3 Act amended in pt 2 Clause 17 This part amends the Attorney-General Act 1999. 18 1 Sections 8 (Insertion of new s 23G), 56 (Amendment of s 119 (Enforcement by imprisonment)) and 57 (Amendment of s 137 (Enforcement order)) 2 Section 34 (Amendment of s 86 (Assumption by tribunal of role of warden and Wardens Court under certain Acts) 3 Section 45 (Insertion of new s 19A) 4 Schedule 6 (Other amendments)

 


 

s4 9 s8 Justice and Other Legislation (Miscellaneous Provisions) Bill 2002 4 Insertion of new s 9A Clause 1 Part 3, after section 9-- 2 insert-- 3 `9A Relator application 4 `An application for the Attorney-General's fiat under section 7(1)(g) 5 must be made to the Attorney-General in the way prescribed under a 6 regulation.'. 7 PART 3--AMENDMENT OF CORONERS ACT 1958 8 5 Act amended in pt 3 Clause 9 This part amends the Coroners Act 1958. 10 6 Amendment of s 22 (No cremation when post-mortem Clause 11 examination directed) 12 Section 22(2), `the Cremation Act 1913, or'-- 13 omit. 14 7 Amendment of s 23 (Orders for burial and certificates of Clause 15 cremation) 16 Section 23(5)-- 17 omit, insert- 18 `(5) This section does not limit or otherwise affect the other provisions 19 of this Act about cremation.'. 20 8 Insertion of new s 23G Clause 21 Part 9, after section 23F-- 22 insert-- 23

 


 

s9 10 s9 Justice and Other Legislation (Miscellaneous Provisions) Bill 2002 `23G When particular provisions do not apply after post-mortem 1 `(1) This section applies if-- 2 (a) a person removes a part of the body of a deceased as part of a 3 post-mortem examination or a special examination of the body 4 made under a coroner's order under section 18; and 5 (b) the removed part of the body ("remains") is not buried or 6 cremated with the body. 7 `(2) Sections 20, 21, 23 and 23A to 23F do not apply to the disposal of 8 the remains. 9 `(3) For disposing of the remains, the entity possessing the remains may 10 issue a certificate stating a coroner no longer requires the remains to be 11 kept. 12 `(4) The certificate authorises the entity or, if the entity gives the remains 13 to someone else for disposal, the person to whom the remains are given for 14 disposal, to dispose, or arrange for the disposal, of the remains by burial or 15 cremation.'. 16 9 Insertion of new ss 59AA Clause 17 After section 59A-- 18 insert-- 19 `59AA National coronial database 20 `(1) The Minister may, for the State, enter into an arrangement with a 21 government or non-government entity responsible for maintaining a 22 database about coronial inquiries and investigations for the inclusion in the 23 database of stated information obtained under this Act ("relevant 24 information"). 25 `(2) The Minister may enter into the arrangement only if satisfied-- 26 (a) the entity has a legitimate interest in storing relevant information 27 in the database; and 28 (b) the entity will make relevant information available only to 29 persons with a legitimate interest in obtaining it; and 30 (c) the conditions for making relevant information available to 31 database users are reasonable. 32

 


 

s 10 11 s 12 Justice and Other Legislation (Miscellaneous Provisions) Bill 2002 `(3) The Minister may delegate the Minister's powers under this section 1 to the chief executive. 2 `(4) For this section, each coroner must give the chief executive the 3 reports and other information the chief executive reasonably requires.'. 4 PART 4--AMENDMENT OF DISTRICT COURT 5 ACT 1967 6 10 Act amended in pt 4 and sch 1 Clause 7 This part and schedule 1 amend the District Court Act 1967. 8 11 Amendment of s 14 (Retirement of judges) Clause 9 Section 14(2), `attaining 70 years of age'-- 10 omit, insert-- 11 `retiring, whether or not because of subsection (1)'. 12 12 Replacement of s 36 (Appointment and salary of registrar and Clause 13 deputy registrars) 14 Section 36-- 15 omit, insert-- 16 `36 Registrar, deputy registrars and other officers 17 `(1) The Governor in Council may appoint, for the court-- 18 (a) registrars; and 19 (b) deputy registrars; and 20 (c) the other officers, including associates; 21 the Governor in Council considers appropriate. 22 `(2) An associate is appointed under this Act and not under the Public 23 Service Act 1996. 24

 


 

s 13 12 s 14 Justice and Other Legislation (Miscellaneous Provisions) Bill 2002 `(3) If the Public Service Act 1996 does not apply to a person appointed 1 under subsection (1), the Governor in Council is to decide the person's 2 salary and conditions of appointment.'. 3 13 Replacement of s 85 (Procedure where proceedings beyond Clause 4 jurisdiction are commenced in District Court) 5 Section 85-- 6 omit, insert-- 7 `85 Procedure if proceeding started in wrong court 8 `(1) This section applies if the District Court considers the court does not 9 have jurisdiction to hear and decide a proceeding started in the court. 10 `(2) If the District Court considers the Supreme Court has jurisdiction to 11 hear the proceeding, the District Court may, by order, transfer the 12 proceeding to the Supreme Court. 13 `(3) Subsection (2) does not apply to a proceeding that may or must be 14 struck out under subsection (4) or (5). 15 `(4) If the District Court considers that the party who started the 16 proceeding knew, or should have known, that the court did not have 17 jurisdiction to hear the proceeding, the court may strike out the proceeding 18 and order the party who started the proceeding to pay the costs of the other 19 party to the proceeding. 20 `(5) If the District Court does not have jurisdiction and the proceeding 21 may not be transferred under subsection (2) or struck out under 22 subsection (4), the court-- 23 (a) must strike out the proceeding; and 24 (b) may order the party who started the proceeding to pay the costs 25 of the other party to the proceeding. 26 `(6) In this section-- 27 "proceeding" includes appeal.'. 28 14 Insertion of new s 140 Clause 29 Part 12, after section 139-- 30 insert-- 31
