2008 A Bill for An Act to amend the Classification of Computer Games and Images Act 1995, the Classification of Films Act 1991, the Classification of Publications Act 1991, the Commercial and Consumer Tribunal Act 2003, the Consumer Credit (Queensland) Act 1994 to make changes to the Consumer Credit Code, the Crime and Misconduct Act 2001 and the Property Agents and Motor Dealers Act 2000 for particular purposes

 


 

Justice Legislation Amendment Bill 2008 Part 1 Preliminary [s 1] The Parliament of Queensland enacts-- 1 Part 1 Preliminary 2 Clause 1 Short title 3 This Act may be cited as the Justice Legislation Amendment 4 Act 2008. 5 Clause 2 Commencement 6 The following provisions commence on a day to be fixed by 7 proclamation-- 8 · part 2, sections 7, 8 and 14(3) and (4) 9 · part 3, sections 19, 21, 23, 24 and 32 (to the extent it 10 inserts new section 72) 11 · part 6 12 · schedule. 13 Part 2 Amendment of Classification of 14 Computer Games and Images 15 Act 1995 16 Clause 3 Act amended in pt 2 17 This part amends the Classification of Computer Games and 18 Images Act 1995. 19 Page 6

Justice Legislation Amendment Bill 2008 Part 2 Amendment of Classification of Computer Games and Images Act 1995 [s 8] Note-- 1 The Commonwealth Act, section 31 provides for the Commonwealth 2 Minister, by legislative instrument, to determine a scheme for the 3 advertising of unclassified computer games.'. 4 Clause 8 Amendment of s 16 (Classified computer games 5 containing advertisements for other computer games) 6 Section 16(d) and penalty-- 7 omit, insert-- 8 `(d) if the computer game is classified as an MA 15+ 9 computer game--an objectionable computer game; or 10 (e) an unclassified computer game, unless the 11 advertisement is allowed under the Commonwealth Act. 12 Maximum penalty--10 penalty units. 13 Note for paragraph (e)-- 14 The Commonwealth Act, section 31 provides for the Commonwealth 15 Minister, by legislative instrument, to determine a scheme for the 16 advertising of unclassified computer games.'. 17 Clause 9 Replacement of pt 7, div 3 18 Part 7, division 3-- 19 omit, insert-- 20 `Division 3 Review by CCT of decision about 21 approval of entity and exemption 22 `60 Review by CCT 23 `(1) If the computer games classification officer makes a 24 decision-- 25 (a) refusing to approve an entity under section 56; or 26 (b) revoking the approval of an entity under section 56; or 27 (c) refusing to give an exemption under section 58 or 59; 28 Page 8

Justice Legislation Amendment Bill 2008 Part 2 Amendment of Classification of Computer Games and Images Act 1995 [s 13] insert-- 1 `Division 2 Justice Legislation Amendment Act 2 2008 3 `71 Definitions for div 2 4 `In this division-- 5 amending Act means the Justice Legislation Amendment Act 6 2008, part 2. 7 commencement means the commencement of this section. 8 `72 Existing appeals 9 `(1) This section applies to an appeal started under previous 10 section 8 or previous section 60(2) but not ended before the 11 commencement of this section. 12 `(2) The appeal may continue and be decided as if the amending 13 Act had not been enacted. 14 `(3) In this section-- 15 previous, followed by a provision number, means the 16 provision as in force immediately before the commencement. 17 `73 Existing entitlements to appeal 18 `(1) This section applies if, immediately before the 19 commencement-- 20 (a) a person was entitled to appeal against a decision 21 mentioned in section 8 or 60(2) (the relevant provision) 22 and had not started the appeal; and 23 (b) the period mentioned in the relevant provision for 24 starting the appeal had not ended. 25 `(2) This Act as amended by the amending Act applies to the 26 appeal. 27 Page 10

 


 

Justice Legislation Amendment Bill 2008 Part 2 Amendment of Classification of Computer Games and Images Act 1995 [s 14] `74 Existing proceedings for offences relating to 1 advertisements for computer games 2 `(1) This section applies if a proceeding for an offence against a 3 provision of part 4 was started, but had not ended, before the 4 commencement of the amending Act, section 14(3). 5 `(2) Despite the Criminal Code, section 11, the proceeding may 6 continue, and the provision may be enforced, as if the 7 amending Act, section 14(3) had not been enacted.'. 8 Clause 14 Amendment of sch 2 (Dictionary) 9 (1) Schedule 2, definition appeal body-- 10 omit. 11 (2) Schedule 2-- 12 insert-- 13 `CCT means the Commercial and Consumer Tribunal 14 established under the CCT Act. 15 CCT Act means the Commercial and Consumer Tribunal Act 16 2003. 17 convenor means the convenor of the review board.'. 18 (3) Schedule 2, definition advertisement, paragraph (c)-- 19 omit, insert-- 20 `(c) advertising on the internet;'. 21 (4) Schedule 2, definition advertisement-- 22 insert-- 23 `(g) advertising by way of a product that-- 24 (i) refers to, or is derived from, the computer game; 25 and 26 (ii) is primarily intended to be sold or distributed to the 27 general public or to a section of the general public; 28 and 29 Page 11

 


 

Justice Legislation Amendment Bill 2008 Part 3 Amendment of Classification of Films Act 1991 [s 15] (iii) a reasonable person would not consider to be a 1 primary source of classification information for 2 consumers about the computer game.'. 3 Part 3 Amendment of Classification of 4 Films Act 1991 5 Clause 15 Act amended in pt 3 6 This part amends the Classification of Films Act 1991. 7 Clause 16 Amendment of s 3 (Definitions) 8 (1) Section 3-- 9 insert-- 10 `convenor means the convenor of the review board.'. 11 (2) Section 3, definition advertisement, paragraph (c)-- 12 omit, insert-- 13 `(c) advertising on the internet;'. 14 (3) Section 3, definition advertisement-- 15 insert-- 16 `(g) advertising by way of a product that-- 17 (i) refers to, or is derived from, the film; and 18 (ii) is primarily intended to be sold or distributed to the 19 general public or to a section of the general public; 20 and 21 (iii) a reasonable person would not consider to be a 22 primary source of classification information for 23 consumers about the film.'. 24 Page 12

 


 

Justice Legislation Amendment Bill 2008 Part 3 Amendment of Classification of Films Act 1991 [s 17] Clause 17 Insertion of new s 3B 1 After section 3A-- 2 insert-- 3 `3B Treatment of single device consisting only of 4 classified films 5 `(1) For this Act, a film-- 6 (a) contained on a single device; and 7 (b) consisting only of 2 or more classified films; 8 is to be treated as if each of the classified films were on a 9 separate device. 10 `(2) Subsection (1) applies despite any other provision of this 11 Act.'. 12 Clause 18 Amendment of s 21 (Prohibition against exhibition of 13 certain films in public places) 14 (1) Section 21-- 15 insert-- 16 `(2A) Subsection (2) does not apply to a film contained on a single 17 device consisting only of 2 or more classified films.'. 18 (2) Section 21-- 19 insert-- 20 `(4) Subsection (3) does not apply in relation to an alteration or 21 addition that consists of the removal or addition of-- 22 (a) navigation functions; or 23 Example-- 24 an interactive menu 25 (b) material that-- 26 (i) provides a description or translation of the audio or 27 visual content of the film; and 28 (ii) would not be likely to cause the film to be given a 29 higher classification. 30 Page 13

Justice Legislation Amendment Bill 2008 Part 3 Amendment of Classification of Films Act 1991 [s 24] Clause 24 Amendment of s 31 (Classified films containing 1 advertisements for other films) 2 (1) Section 31(a) to (d), `or an unclassified film'-- 3 omit. 4 (2) Section 31(e) and penalty-- 5 omit, insert-- 6 `(e) if a film is classified as an R 18+ film--a film classified 7 as an X 18+ or RC film; or 8 (f) an unclassified film, unless the advertisement is allowed 9 under the Commonwealth Act. 10 Maximum penalty--10 penalty units. 11 Note for paragraph (f)-- 12 The Commonwealth Act, section 31 provides for the Commonwealth 13 Minister, by legislative instrument, to determine a scheme for the 14 advertising of unclassified films.'. 15 Clause 25 Insertion of new s 36A 16 Part 4-- 17 insert-- 18 `36A Prohibition against sale of certain films 19 `(1) A person must not display for sale or sell, or attempt to 20 display for sale or sell, a film unless the film is displayed for 21 sale or sold with the same title as the title under which it is 22 classified. 23 Maximum penalty--50 penalty units. 24 `(2) Subsection (1) does not apply to a film contained on a single 25 device consisting only of 2 or more classified films. 26 `(3) A person must not display for sale or sell, or attempt to 27 display for sale or sell, an unclassified film other than in the 28 form, without alteration or addition, in which it is classified. 29 Maximum penalty--50 penalty units. 30 Page 16

Justice Legislation Amendment Bill 2008 Part 6 Amendment of Consumer Credit Code [s 47] `10B Deciding application of Code to particular contracts 1 for the sale of goods by instalments 2 `(1) This section applies to a contract for the sale of goods if the 3 amount payable to purchase the goods under the contract-- 4 (a) is payable by instalments; and 5 (b) exceeds the cash price of the goods. 6 `(2) This section does not apply to a contract for the hire of goods 7 even if the hirer has a right or obligation to purchase the 8 goods. 9 `(3) For the purpose of deciding whether the contract is a credit 10 contract and, if it is a credit contract, of applying this Code 11 (including part 6) to it-- 12 (a) a debt is to be regarded as having been incurred, and 13 credit provided, in the circumstances mentioned in 14 subsection (1); and 15 (b) the debtor is the person who is to make the payments; 16 and 17 (c) the credit provider is the person who is to receive the 18 payments; and 19 (d) the charge for providing the credit is the amount by 20 which the amount payable to purchase the goods, 21 together with any other amount payable under the 22 contract, exceeds the cash price of the goods. 23 `(4) This section does not affect the application of this Code to a 24 contract that is, apart from this section, a credit contract. 25 `10C Deciding application of Code to particular contracts 26 for the sale of goods by instalments under related 27 contracts 28 `(1) For the purpose of this section, a contract is a related contract 29 to a contract for the sale of goods (the goods contract) if-- 30 (a) the sale of the goods is financed, wholly or partly, by the 31 provision of credit under the contract; and 32 Page 29
