1996 A BILL FOR An Act to amend a number of Acts administered by the Attorney-General and Minister for Justice, and for other purposes

 


 

s1 10 s4 Justice Legislation (Miscellaneous Provisions) The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short Clause 1. This Act may be cited as the Justice Legislation (Miscellaneous 4 Provisions) Act 1996. 5 6 Commencement Clause 2. Other than as expressly provided, this Act commences on a day to be 7 fixed by proclamation. 8 ART 2--AMENDMENT OF COOPERATIVE AND 9 P OTHER SOCIETIES ACT 1967 10 amended in pt 2 11 Act Clause 3. This part amends the Cooperative and Other Societies Act 1967. 12 of s 8 (Annual report by registrar) 13 Replacement Clause 4. Section 8-- 14 omit, insert-- 15 report on operation of Act 16 `Annual `8. The department's annual report for a financial year must include a 17 report on the operation of this Act during the year.'. 18

 


 

s5 11 s8 Justice Legislation (Miscellaneous Provisions) PART 3--AMENDMENT OF CORONERS ACT 1958 1 amended in pt 3 2 Act Clause 5. This part amends the Coroners Act 1958. 3 of title 4 Amendment Clause 6. Title, after `coroners'-- 5 insert-- 6 `, to regulate the process of cremation,'. 7 of new s 59C 8 Insertion Clause 7. After section 59B-- 9 insert-- 10 power 11 `Regulation-making `59C. The Governor in Council may make regulations under this Act.'. 12 of new s 61A 13 Insertion Clause 8. After section 61-- 14 insert-- 15 to Cremation Act 16 `References `61A. In an Act or document, a reference to the Cremation Act 1913 17 may, if the context permits, be taken to be a reference to this Act.'. 18

 


 

s9 12 s 11 Justice Legislation (Miscellaneous Provisions) PART 4--AMENDMENT OF COURT FUNDS ACT 1 1973 2 amended in pt 4 3 Act Clause 9. This part amends the Court Funds Act 1973. 4 of s 4 (Definitions) 5 Amendment Clause 10.(1) Section 4, definitions "Court", "order" and "registrar"-- 6 omit. 7 (2) Section 4-- 8 insert-- 9 ` "court" means the Supreme Court or a District Court or Magistrates 10 Court into which an amount that is money in court is paid. 11 "order", of a court, includes-- 12 (a) a judgment of the court, a Supreme Court or District Court judge 13 or a magistrate; and 14 (b) a report, certificate or direction of the court, a Supreme Court or 15 District Court judge, a magistrate or an officer of a court 16 prescribed under a regulation. 17 "registrar" means-- 18 (a) for the Supreme Court--the registrar or deputy registrar of the 19 court at Brisbane, Rockhampton, Townsville or a district registry 20 of the court; or 21 (b) for a District Court or Magistrates Court--the registrar of the 22 court. 23 "suitors fund" see section 5.'. 24 of ss 5 and 6 25 Replacement Clause 11. s 12 13 s 14 Justice Legislation (Miscellaneous Provisions) ourt Suitors Fund 1 `C `5.(1) A Court Suitors Fund (the "suitors fund") is established. 2 `(2) Amounts paid to a court to the credit of a cause, matter, or an 3 account relating to a proceeding in the court must be paid into the suitors 4 fund at the times and in the way prescribed under a regulation. 5 `(3) Payment, delivery and transfer of amounts from the suitors fund 6 must be made in accordance with this Act.'. 7 of s 7 (Dealings with money in Court) 8 Amendment Clause 12.
