1996 A BILL FOR An Act to amend the Justices of the Peace and Commissioners for Declarations Act 1991, and for other purposes

 


 

s1 4 s4 Justices of the Peace and Commissioners for Declarations Legislation Amendment The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short Clause 1. This Act may be cited as the Justices of the Peace and Commissioners 4 for Declarations Legislation Amendment Act 1996. 5 ART 2--AMENDMENT OF THE JUSTICES OF THE 6 P PEACE AND COMMISSIONERS FOR 7 DECLARATIONS ACT 1991 8 amended 9 Act Clause 2. This part amends the Justices of the Peace and Commissioners for 10 Declarations Act 1991. 11 of s 3 (Interpretation) 12 Amendment Clause 3. Section 3, definition "Council"-- 13 omit. 14 of ss 4-11 15 Replacement Clause 4. Sections 4 to 11-- 16 omit, insert-- 17 council 18 `Advisory `4.(1) The Minister may establish an advisory council to advise the 19 Minister in the administration of this Act. 20

 


 

s5 5 s6 Justices of the Peace and Commissioners for Declarations Legislation Amendment `(2) The advisory council is to consist of the members appointed to the 1 council by the Minister. 2 `(3) When appointing members to the council, the Minister must have 3 regard to-- 4 (a) a person's knowledge of the roles and functions of justices; and 5 (b) the special interest, knowledge or experience a person may bring 6 to the council, including, for example, a special interest in, or 7 knowledge or experience of-- 8 (i) the needs of particular areas of the State, including rural and 9 remote areas, to be serviced by justices and the special needs 10 of justices servicing the areas; or 11 (ii) the needs of Aboriginal or Torres Strait Islander 12 communities to be serviced by justices and the special needs 13 of justices servicing the communities. 14 `(4) The advisory council is to meet at the times and conduct its 15 proceedings in the way directed by the Minister. 16 `(5) In this section-- 17 "justices" means justices of the peace and commissioners for 18 declarations.'. 19 of s 16 (Qualifications of office) 20 Amendment Clause 5.(1) Section 16(1)(c), `unless'-- 21 omit. 22 (2) Section 16(2), from `a retired Magistrate' to `a Magistrate'-- 23 omit, insert-- 24 `a lawyer'. 25 of s 19 (Justices of the peace and commissioners for 26 Amendment declarations by virtue of office) 27 Clause 6.(1) Section 19(1), `and for so long as the person holds the office,'-- 28

 


 

s7 6 s7 Justices of the Peace and Commissioners for Declarations Legislation Amendment omit. 1 (2) Section 19-- 2 insert-- 3 `(1A) A person who has retired, or resigned, from office as a Supreme 4 Court or District Court judge or a magistrate is, without further 5 appointment, a justice of the peace.'. 6 (3) Section 19(4), from `(magistrates court)' to `1 November 1996'-- 7 omit, insert-- 8 `(magistrates court) while the person continues to be employed as a 9 public service officer in an office of the Supreme Court, a District Court or 10 a Magistrates Court'. 11 of new s 24A 12 Insertion Clause 7. After section 24-- 13 insert-- 14 in person's office 15 `Change `24A.(1) This section applies if a person holding office (the "existing 16 office") as an appointed justice of the peace or appointed commissioner for 17 declarations is later appointed to hold office (the "later office") as-- 18 (a) for an appointed justice of the peace--an appointed justice of the 19 peace of another category or an appointed commissioner for 20 declarations; or 21 (b) for an appointed commissioner for declarations--an appointed 22 justice of the peace. 23 `(2) The registrar is to remove the person's name from the register as the 24 holder of the existing office and insert an entry that the person holds the 25 later office. 26 `(3) When the entry is made, the person stops holding the existing office 27

 


 

s8 7 s9 Justices of the Peace and Commissioners for Declarations Legislation Amendment and holds the later office. 1 `(4) This section does not apply if section 42 or 44 applies.1'. 2 of s 27 (Return of certificate of registration and seal of 3 Amendment office) 4 Clause 8. Section 27(1), `by virtue of a provision of this Act other than 5 section 17(c)'-- 6 omit, insert-- 7 `under section 17(a), (b) or (d)2'. 8 of s 42 (Justice of the peace (commissioner for 9 Amendment declarations)) 10 Clause 9.(1) Section 42(1), `If at the expiration of 5 years from the 11 commencement of this Act'-- 12 omit, insert-- 13 `If at 30 June 2000'. 14 (2) Section 42-- 15 insert-- 16 `(3) Subsection (1) does not apply to a lawyer.'. 17 1 Sections 42 and 44 already provide transitional arrangements for certain office holders becoming justices of the peace (commissioner for declarations) and commissioners for declarations. 2 Section 17 (Disqualification from office)

 


 

s 10 8 s 11 Justices of the Peace and Commissioners for Declarations Legislation Amendment ART 3--AMENDMENT OF THE ELECTORAL ACT 1 P 1992 2 amended 3 Act Clause 10. This part amends the Electoral Act 1992. 4 of s 58 (Commission to keep electoral rolls) 5 Amendment Clause 11. Section 58-- 6 insert-- 7 `(3A) Each electoral roll may also set out, for each person who holds 8 office-- 9 (a) as a justice of the peace--the initials `JP' after the person's name; 10 or 11 (b) as a commissioner for declarations--the initials `Cd' after the 12 person's name.'. 13 14 © State of Queensland 1996
