This Act may be cited as the Nature Conservation and Other 4
Legislation Amendment Act 2015. 5

(scientific) 24
(1) A national park (scientific) is to be managed to-- 25
(a) protect the area's exceptional scientific 26
values and, in particular-- 27

(i) to ensure that the processes of nature 1
continue unaffected in the area; and 2
(ii) to protect the area's biological diversity 3
to the greatest possible extent; and 4
(b) allow controlled scientific study and 5
monitoring of the area's natural resources. 6
(2) However, if threatened wildlife is a significant 7
natural resource for the area, management of the 8
area may include-- 9
(a) manipulation of the wildlife's habitat; and 10
(b) the control of threatening processes relating 11
to the wildlife, including threatening 12
processes caused by other wildlife. 13
(3) Subject to subsections (1) and (2), a national park 14
(scientific), or a part of a national park 15
(scientific), that is also an indigenous joint 16
management area is to be managed, as far as 17
practicable, in a way that is consistent with any 18
Aboriginal tradition applicable to the area, 19
including any tradition relating to activities in the 20
area. 21

(1A) However, if the whole or part of a national park is 26
declared as a special management area 27
(controlled action), the management of the park 28
or part may include the following-- 29
(a) the manipulation of the area's natural and 30
cultural resources to protect or restore the 31
area's natural or cultural values; 32

(b) the continuation of an existing use of the 1
area consistent with maintaining the area's 2
natural and cultural values. 3

(1) A conservation park is to be managed to-- 9
(a) conserve and present the area's cultural and 10
natural resources and their values; and 11
(b) provide for the permanent conservation of 12
the area's natural condition to the greatest 13
possible extent; and 14
(c) ensure that any commercial use of the area's 15
natural resources, including fishing and 16
grazing, is ecologically sustainable. 17
(2) Subject to subsection (1), a conservation park, or 18
a part of a conservation park, that is also an 19
indigenous joint management area is to be 20
managed, as far as practicable, in a way that is 21
consistent with any Aboriginal tradition 22
applicable to the area, including any tradition 23
relating to activities in the area. 24
21A Management principles of resources reserves 25
(1) Subject to subsection (2), a resources reserve is to 26
be managed to-- 27
(a) recognise and, if appropriate, protect the 28
area's cultural and natural resources; and 29
(b) provide for the controlled use of the area's 30
cultural and natural resources; and 31

(c) ensure that the area is maintained 1
predominantly in its natural condition. 2
(2) The felling of timber for a commercial purpose 3
must not be conducted in a resources reserve. 4
(3) Subject to subsections (1) and (2), a resources 5
reserve, or a part of a resources reserve, that is 6
also an indigenous joint management area is to be 7
managed, as far as practicable, in a way that is 8
consistent with any Aboriginal tradition 9
applicable to the area, including any tradition 10
relating to activities in the area. 11

This division applies despite any provision of division 2

On the commencement, each special management area 6
(scientific) under the unamended Act is taken to be a 7
national park (scientific). 8
208 Regional park (general) taken to be 9
conservation park 10
On the commencement, each regional park (general) 11
under the unamended Act is taken to be a conservation 12
park. 13
209 Regional park (resource use area) taken to be 14
resources reserve 15
On the commencement, each regional park (resource 16
use area) under the unamended Act is taken to be a 17

From the commencement, in an Act or document-- 20
(a) a reference to a special management area 21
(scientific) may, if the context permits, be 22
taken to be a reference to a national park 23

211 Trustees of regional park (general) 7
(1) This section applies if, immediately before the 8
commencement, an area was a regional park 9
(general) under the management of trustees under 10
this Act. 11
(2) A person who was, immediately before the 12
commencement, a trustee of the area under this 13
Act, continues to be a trustee of the area as a 14
conservation park under this Act. 15
(3) The trust over the area continues as a trust under 16
this Act over the area as a conservation park. 17
212 Trustees of regional park (resource use area) 18
(1) This section applies if, immediately before the 19
commencement, an area was a regional park 20
(resource use area) under the management of 21
trustees under this Act. 22
(2) A person who was, immediately before the 23
commencement, a trustee of the area under this 24
Act, continues to be a trustee of the area as a 25
resources reserve under this Act. 26
(3) The trust over the area continues as a trust under 27
this Act over the area as a resources reserve. 28

213 Change in class does not affect instruments 1
applying to an area 2
(1) This section applies if, under this division, an 3
area is changed from an old class of protected 4
area to another class of protected area (the new 5
class). 6
(2) Any of the following (each a relevant 7

before the commencement continues to apply to 9
the area as a protected area of the new class-- 10
(a) a lease, agreement, licence, permit or other 11
authority under this Act or another Act; 12
(b) a management statement; 13
(c) a management plan; 14
(d) a direction, requirement, notice or decision 15
given or made, in writing, under this Act. 16
(3) The relevant instrument continues in force for the 17
area until it expires, is terminated or repealed or 18
otherwise ends under its terms, under this Act or 19
another Act. 20
(4) Subsections (2) and (3) apply even if the relevant 21
instrument authorises the carrying out of 22
activities in the area that are not consistent with 23
the management principles for protected areas of 24
the new class. 25
214 Deciding application for relevant authorities 26
(1) This section applies to an application for a lease, 27
agreement, licence, permit or other authority (the 28
relevant authority) that-- 29
(a) was made, but not decided, under this Act 30
before the commencement; and 31

(b) is for a protected area of an old class that, 1
under this division, is changed to a protected 2
area of another class (the new class). 3
(2) The application is to be decided, as an 4
application for the relevant authority for a 5
protected area of the old class-- 6
(a) under this Act as in force before the 7
commencement; and 8
(b) as if the Nature Conservation and Other 9
Legislation Amendment Act 2015 had not 10
been enacted. 11
(3) If the application is granted, the chief executive 12
must give or grant to the applicant the relevant 13
authority for the area as a protected area of the 14
new class. 15
(4) To remove any doubt, it is declared that 16
subsection (3) applies even if the carrying out of 17
the activities under the relevant authority is not 18
consistent with the management principles for 19
protected areas of the new class. 20
(5) However, the grounds on which the chief 21
executive may refuse an application to renew the 22
relevant authority include the ground that the 23
carrying out of the activities under the authority 24
is not consistent with the management principles 25
for protected areas of the new class. 26
