s1 6 s4 Natural Resources and Other Legislation Amendment Bill 2004 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title Clause 3 This Act may be cited as the Natural Resources and Other Legislation 4 Amendment Act 2004. 5 PART 2--AMENDMENT OF ACQUISITION OF LAND 6 ACT 1967 7 2 Act amended in pt 2 Clause 8 This part amends the Acquisition of Land Act 1967. 9 3 Amendment of s 2 (Definitions) Clause 10 Section 2, definition "constructing authority", paragraph (b)-- 11 omit, insert-- 12 `(b) a local government; or 13 (c) a person authorised by an Act to take land for any purpose.'. 14 PART 3--AMENDMENT OF FORESTRY ACT 1959 15 4 Act amended in pt 3 Clause 16 This part amends the Forestry Act 1959. 17

 


 

s5 7 s5 Natural Resources and Other Legislation Amendment Bill 2004 5 Amendment of s 61J (Agreement about natural resource Clause 1 products) 2 (1) Section 61J-- 3 insert-- 4 `(1A) However, if the land is land held under the Land Act 1994, the 5 owner may enter into an agreement only if the natural resource product is 6 owned by the owner as an improvement, within the meaning of that Act, on 7 the land.'. 8 (2) Section 61J(4), `the Land Title Act 1994'-- 9 omit, insert-- 10 `the Land Act 1994 or the Land Title Act 1994'. 11 (3) Section 61J(5), from `the Land'-- 12 omit, insert-- 13 `the Land Act 1994 or the Land Title Act 1994. '. 1 14 (4) Section 61J(7), definition "owner"-- 15 omit. 16 (5) Section 61J(7)-- 17 insert-- 18 ` "land" means-- 19 (a) land held under the Land Act 1994 under a lease that allows the 20 land to be used for agricultural or timber plantation purposes; or 21 (b) land held under the Land Title Act 1994. 22 "owner" means-- 23 (a) for land held under the Land Act 1994--the lessee of the land; or 24 (b) for land held under the Land Title Act 1994--the registered owner 25 of the land.'. 26 1 See the Land Act 1994, chapter 6, part 4, division 8B (Profits a prendre) or the Land Title Act 1994, part 6, division 4B (Profits a prendre).

 


 

s6 8 s 10 Natural Resources and Other Legislation Amendment Bill 2004 PART 4--AMENDMENT OF LAND ACT 1994 1 6 Act amended in pt 4 Clause 2 This part amends the Land Act 1994. 3 7 Amendment of s 5 (Land to which Act applies) Clause 4 Section 5(2), from `dealt with'-- 5 omit, insert-- 6 `dealt with under this Act.2'. 7 8 Amendment of s 26 (Minister may decide boundaries of Clause 8 reservations) 9 (1) Section 26(1) and (2)(c), `in the deed of grant'-- 10 omit, insert-- 11 `in the lease, deed of grant'. 12 (2) Section 26(2), (3) and (4), `registered owner'-- 13 omit, insert-- 14 `lessee, registered owner'. 15 9 Amendment of s 33 (Revocation of reserves) Clause 16 Section 33(1)-- 17 insert-- 18 `(c) the Minister is satisfied a different tenure would be more 19 appropriate for the purpose for which the land is used.'. 20 10 Amendment of s 38 (Cancelling a deed of grant in trust) Clause 21 (1) Section 38-- 22 2 However, see section 14(3).

 


 

s 11 9 s 12 Natural Resources and Other Legislation Amendment Bill 2004 insert-- 1 `(3A) Each person who has a registered interest in the land must be 2 given-- 3 (a) a copy of the gazette notice; and 4 (b) if the Minister has allowed improvements to be 5 removed--written notice of the time by which the person must 6 remove the improvements. 7 `(3B) If the improvements are not removed within the time stated in the 8 notice, they become the property of the State.'. 9 (2) Section 38-- 10 insert-- 11 `(5) No person has a right to claim compensation for a cancellation 12 under subsection (1).'. 13 (3) Section 38(3A) to (5)-- 14 renumber as section 38(4) to (7). 15 11 Amendment of s 45 (Details of trustees) Clause 16 Section 45(1) and (2)-- 17 omit, insert-- 18 `(1) The names of all trustees appointed under this Act, and any change 19 to a name, must be recorded in the appropriate register. 20 `(2) A trustee must advise the chief executive of the trustee's address and 21 any change to the address.'. 22 12 Amendment of s 55 (Power to surrender) Clause 23 Section 55-- 24 insert-- 25 `(3) For land that is surrendered-- 26 (a) the land is released from the trust and all encumbrances and 27 interests; and 28 (b) the land may be dealt with as unallocated State land; and 29

 


 

s 13 10 s 14 Natural Resources and Other Legislation Amendment Bill 2004 (c) the trust is at an end; and 1 (d) all appointments of trustees for the land and all trustee leases and 2 trustee permits over the land are cancelled. 3 `(4) If the Minister has allowed improvements to be removed from the 4 surrendered land-- 5 (a) the trustee and each person who has a registered interest in the 6 land must be given written notice of the time by which the trustee 7 or person must remove the improvements; and 8 (b) if the improvements are not removed within the time stated in the 9 notice, they become the property of the State. 10 `(5) Every cancellation of trustees, a trustee lease or trustee permit over a 11 deed of grant in trust must be registered in the appropriate register. 12 `(6) No person has a right to claim compensation from the Minister or 13 the State for a surrender under subsection (1).'. 14 13 Amendment of s 57 (Trustee leases) Clause 15 Section 57-- 16 insert-- 17 `(5) If the trustee lease is for only part of the trust land, the appropriate 18 form for the trustee lease must also include-- 19 (a) a sketch plan the chief executive is satisfied identifies the land 20 being leased; or 21 (b) if required by the chief executive--a plan of survey identifying 22 the land being leased. 23 `(6) However, the chief executive may allow the land being leased to be 24 identified by a description alone if the chief executive is satisfied the land is 25 adequately identified by the description.'. 26 14 Insertion of new s 57A Clause 27 After section 57-- 28 insert-- 29

 


 

s 15 11 s 16 Natural Resources and Other Legislation Amendment Bill 2004 `57A Amending a trustee lease 1 `(1) A registered trustee lease may, with the Minister's approval, be 2 amended by registering an amendment of the trustee lease. 3 `(2) However, the document of amendment must not-- 4 (a) increase or decrease the area leased; or 5 (b) add or remove a party to the lease; or 6 (c) increase the term of the lease.'. 7 15 Amendment of s 58 (Other transactions a trustee may allow) Clause 8 (1) Section 58, heading-- 9 omit, insert-- 10 `58 Other transactions relating to trustee leases'. 11 (2) Section 58-- 12 insert-- 13 `(4A) All or part of a trustee lease or a sublease of a trustee lease may be 14 surrendered only if each registered mortgagee and registered sublessee of 15 the interest being surrendered has given written agreement to the 16 surrender.'. 17 (3) Section 58-- 18 insert-- 19 `(6) Section 342 applies, with necessary changes, to the release of a 20 mortgage of a trustee lease or sublease of a trustee lease.'. 21 (4) Section 58(4A) to (6)-- 22 renumber as section 58(5) to (7). 23 16 Amendment of s 101 (Minister to consider objections) Clause 24 Section 101(2)-- 25 omit, insert-- 26 `(2) The Minister may approve the road closure application, with or 27 without conditions, or refuse the application.'. 28

 


 

s 17 12 s 19 Natural Resources and Other Legislation Amendment Bill 2004 17 Replacement of s 105 (Cancellation or surrender of road licence) Clause 1 Section 105-- 2 omit, insert-- 3 `105 Cancellation or surrender of road licence 4 `(1) The Minister may cancel all or part of a road licence after giving the 5 licensee reasonable written notice of the Minister's intention to cancel. 6 `(2) No compensation is payable for the cancellation of a road licence. 7 `(3) A licensee, with the Minister's written approval, may surrender all 8 or part of a road licence. 9 `(4) If a road licence is cancelled or surrendered, any improvements on 10 the road become the property of the State and no compensation is payable. 11 `(5) However, the Minister may allow the licensee to remove any 12 improvements within the time stated on the cancellation notice or the 13 surrender approval. 14 `(6) If a road licence is cancelled or surrendered, the road remains 15 temporarily closed.'. 16 18 Amendment of s 122 (Deeds of grant of unallocated State land) Clause 17 (1) Section 122-- 18 insert-- 19 `(1A) A deed of grant of unallocated State land may be granted without 20 competition to a local government if the Minister decides the land is 21 needed for a public purpose.'. 22 (2) Section 122(1A) to (3)-- 23 renumber as section 122(2) to (4). 24 19 Amendment of s 123 (Priority criteria) Clause 25 (1) Section 123, definition "priority criteria"-- 26 insert-- 27 `(ba)the applicant held a significant interest in the land before it 28 became unallocated State land; or 29

8 Natural Resources and Other Legislation Amendment Bill 2004 insert-- `Division 3--Transitional provision for Natural Resources and Other Legislation Amendment Act 2004 `102 Valuations affected by unusual circumstances `(1) Section 37(2), as in force immediately after the commencement of section 56A of the amending Act, is taken to have applied to the making of annual valuations having force and effect for the period of 12 months commencing on 30 June 2004. `(2) If, because of unusual circumstances, the chief executive did not, before 1 April 2004, make an annual valuation of land in an area having force and effect for the period of 12 months commencing on 30 June 2004, the chief executive is not stopped from making the valuation, to be used only for land tax purposes, if the unusual circumstances no longer exist. `(3) For making the valuation-- (a) sections 40 and 41(1)(b) do not apply; (b) section 41A(1) does not apply, to the extent it requires notice to be given no later than 31 March 2004; (c) section 41A(1)(a) requires notice to be given only to an owner whose land in the area has been valued for land tax purposes; (d) section 73(1) does not apply, to the extent it requires a copy of the valuation roll to be given not less than 3 months before 30 June 2004. `(4) The valuation is taken to have force and effect, for land tax purposes only, for the period of 12 months commencing on 30 June 2004. `(5) However, the last preceding valuation of the land continues to have force and effect for rating and rental purposes until-- (a) an annual valuation having force and effect for the period commencing on 30 June 2005 is made; or (b) the valuation is sooner altered under this Act. `(6) Subsection (1) does not otherwise affect the operation of section 37 as in force before the commencement of section 56A of the amending Act.
