s1 4 s3 Natural Resources Legislation Amendment Bill 2004 The Parliament of Queensland enacts-- 1 Part 1 Preliminary 2 Clause 1 Short title 3 This Act may be cited as the Natural Resources Legislation 4 Amendment Act 2004. 5 Part 2 Amendment of Land Protection 6 (Pest and Stock Route 7 Management) Act 2002 8 Clause 2 Act amended in pt 2 9 This part amends the Land Protection (Pest and Stock Route 10 Management) Act 2002. 11 3 Amendment of s 6 (Relationship with Nature 12 Conservation Act and Forestry Act) Clause 13 (1) Section 6, heading, `Nature Conservation Act and Forestry 14 Act'-- 15 omit, insert-- 16 `particular Acts'. 17 (2) Section 6(1) and (2), after `Act 1992'-- 18 insert-- 19 `, the Fisheries Act 1994'. 20

 


 

s4 5 s6 Natural Resources Legislation Amendment Bill 2004 4 Amendment of s 37 (Declaring declared pests by 1 emergency pest notice) Clause 2 (1) Section 37(2), `gazette'-- 3 omit. 4 (2) Section 37(7), `ceases to have effect 3 months after it is 5 gazetted'-- 6 omit, insert-- 7 `expires 3 months after it commences'. 8 Clause 5 Amendment of s 41 (Keeping declared pest) 9 Section 41-- 10 insert-- 11 `(2) A person does not commit an offence against subsection (1) if 12 the person keeps the declared pest for identification by-- 13 (a) for a declared pest that is an animal--Queensland 14 Museum; or 15 (b) for a declared pest that is a plant--Queensland 16 Herbarium.'. 17 Clause 6 Insertion of new s 41A 18 After section 41-- 19 insert-- 20 `41A Amnesty for keeping particular declared pests 21 `(1) This section applies if the chief executive becomes aware that 22 many persons are keeping animals of a particular type that is a 23 declared pest (a particular declared pest) other than under 24 declared pest permits. 25 `(2) The chief executive may, with the approval of the Minister, 26 declare an amnesty (an amnesty declaration) for the 27 particular declared pest. 28 `(3) A person who keeps a particular declared pest other than 29 under a declared pest permit does not commit an offence 30 against section 41 in relation to the particular declared pest if 31 the person surrenders the pest-- 32

 


 

s7 6 s8 Natural Resources Legislation Amendment Bill 2004 (a) during the amnesty period for the particular declared 1 pest; and 2 (b) in the way stated in the amnesty declaration. 3 `(4) The chief executive may destroy or dispose of, in a reasonable 4 way decided by the chief executive, a particular declared pest 5 surrendered under subsection (3). 6 `(5) Compensation is not payable for the destruction or disposal of 7 a declared pest under an amnesty declaration. 8 `(6) In this section-- 9 amnesty period, for a particular declared pest mentioned in an 10 amnesty declaration, means the period stated in the amnesty 11 declaration as the period for surrendering the particular 12 declared pest.'. 13 Clause 7 Amendment of s 44 (Supplying declared pest) 14 Section 44-- 15 insert-- 16 `(2) A person does not commit an offence against subsection (1) if 17 the person supplies the declared pest for identification to-- 18 (a) for a declared pest that is an animal--Queensland 19 Museum; or 20 (b) for a declared pest that is a plant--Queensland 21 Herbarium.'. 22 8 Amendment of s 45 (Supplying things containing 23 reproductive material of particular declared pests) Clause 24 (1) Section 45(3)-- 25 renumber as section 45(4). 26 (2) Section 45-- 27 insert-- 28

 


 

s9 7 s 10 Natural Resources Legislation Amendment Bill 2004 `(3) Both the supplier and the person to whom the thing is 1 supplied must keep a copy of the written notice given under 2 subsection (2) for 5 years after the notice is given. 3 Maximum penalty for subsection (3)--10 penalty units.'. 4 Clause 9 Amendment of s 79 (Extending compliance period) 5 (1) Section 79(1), (3) and (4), `person'-- 6 omit, insert-- 7 `landowner'. 8 (2) Section 79(2)-- 9 omit, insert-- 10 `(2) The request must-- 11 (a) be in writing; and 12 (b) state the reason for the request; and 13 (c) state the period of extension requested.'. 14 (3) Section 79(3)(a)(i), `and'-- 15 omit, insert-- 16 `or'. 17 (4) Section 79(3)(a)(ii), after `it is'-- 18 insert-- 19 `otherwise'. 20 (5) Section 79(4), after `period,'-- 21 insert-- 22 `or to extend the period other than as requested under 23 subsection (2)(c),'. 24 10 Amendment of s 80 (Noncompliance with pest control 25 notice) Clause 26 (1) Section 80-- 27 insert-- 28

 


 

s 11 8 s 13 Natural Resources Legislation Amendment Bill 2004 `(1A) The entry notice must also state the period, of not more than 1 2 months, that the notice remains in force.'. 2 (2) Section 80(1A) and (2)-- 3 renumber as section 80(2) and (3). 4 Clause 11 Amendment of s 90 (Emergency quarantine notice) 5 (1) Section 90-- 6 insert-- 7 `(8A) Subsection (1) does not allow the chief executive officer of the 8 local government to give an emergency quarantine notice in 9 relation to State land in the area.'. 10 (2) Section 90(8A) and (9)-- 11 renumber as section 90(9) and (10). 12 Clause 12 Amendment of s 116 (Application for permit) 13 Section 116(2)(c)-- 14 omit, insert-- 15 `(c) both of the following apply-- 16 (i) the permit is for either-- 17 (A) if the issuing entity is a local government 18 prescribed for section 104--relevant land 19 identified in the issuing entity's stock route 20 network management plan as land containing 21 more pasture and water than is needed for 22 the use of travelling stock; or 23 (B) otherwise--relevant land the issuing entity is 24 satisfied contains more pasture and water 25 than is needed for the use of travelling stock; 26 (ii) the issuing entity has given notice that a person 27 may apply for a permit for the land.'. 28 Clause 13 Amendment of s 118 (Deciding application) 29 (1) Section 118(2)(a)-- 30

 


 

s 14 9 s 16 Natural Resources Legislation Amendment Bill 2004 omit, insert-- 1 `(a) if the issuing entity has a stock route network 2 management plan--the use of the land for agistment is 3 consistent with the plan; and'. 4 (2) Section 118(2)(b)(ii)-- 5 omit, insert-- 6 `(ii) there is more pasture and water available on the 7 land than is needed for the use of travelling stock; 8 and'. 9 Clause 14 Amendment of s 159 (Amounts payable by landowner) 10 Section 159, heading, `landowner'-- 11 omit, insert-- 12 `permit holder'. 13 Clause 15 Amendment of s 163 (Water facility agreements) 14 (1) Section 163(1)(e), `constructing'-- 15 omit, insert-- 16 `constructing or maintaining'. 17 (2) Section 163(1)-- 18 insert-- 19 `(f) allowing access to the owner's land for any purpose 20 mentioned in paragraphs (a) to (e).'. 21 16 Amendment of s 165 (Registration of particular 22 agreements) Clause 23 Section 165(2) and (3)-- 24 omit, insert-- 25 `(2) As soon as practicable after the agreement is entered, the chief 26 executive must give the land registrar written notice of the 27 agreement. 28

 


 

s 17 10 s 17 Natural Resources Legislation Amendment Bill 2004 `(3) The land registrar must keep records showing that the land 1 specified in the notice is the subject of a water facility 2 agreement. 3 `(4) The land registrar must keep the records in a way that allows a 4 search of the register kept by the registrar under any Act 5 relating to title to the land to show the existence of the 6 agreement. 7 `(5) As soon as practicable after the agreement is terminated, the 8 chief executive must give the land registrar written notice of 9 the termination. 10 `(6) As soon as practicable after receiving a notice under 11 subsection (5), the land registrar must remove the particulars 12 of the agreement from the registrar's records. 13 `(7) While the agreement is in force, the landowner's obligations 14 under the agreement attach to the land and bind the owner and 15 the owner's successors in title to the land. 16 `(8) In this section-- 17 land registrar means-- 18 (a) for freehold land--the registrar of titles; and 19 (b) for land leased from the State--the chief executive.'. 20 Clause 17 Insertion of new ss 195A and 195B 21 After section 195-- 22 insert-- 23 `195A Investigations about eligibility for appointment 24 `(1) The chief executive may make investigations about a person 25 to decide whether the person is eligible for appointment as a 26 member. 27 `(2) Without limiting subsection (1), the chief executive may ask 28 the commissioner of the police service for a written report 29 about the criminal history of the person. 30 `(3) The commissioner must give the report to the chief executive. 31 `(4) However, the report is required to contain only criminal 32 history in the commissioner's possession or to which the 33 commissioner has access. 34

 


 

s 18 11 s 19 Natural Resources Legislation Amendment Bill 2004 `195B Criminal history is confidential document 1 `(1) An officer, employee or agent of the department must not, 2 directly or indirectly, disclose to anyone else a report, or 3 information contained in a report, given under section 195A. 4 Maximum penalty--100 penalty units. 5 `(2) However, the officer, employee or agent does not commit an 6 offence against subsection (1) if-- 7 (a) disclosure of the report or information to someone else 8 is authorised by the chief executive; or 9 (b) the disclosure is otherwise required or permitted by law. 10 `(3) The chief executive may authorise disclosure under 11 subsection (2)(a) only to the extent necessary to perform a 12 function under or in relation to this Act. 13 `(4) The chief executive must destroy the report as soon as 14 practicable after considering the person's eligibility.'. 15 Clause 18 Amendment of s 224 (Qualifications for appointment) 16 Section 224-- 17 insert-- 18 `(3) Also, a regulation establishing a pest operational board may 19 prescribe residential or land ownership or occupation 20 requirements as qualifications for appointment as a director.'. 21 Clause 19 Insertion of new ss 224A and 224B 22 After section 224-- 23 insert-- 24 `224A Investigations about eligibility for appointment 25 `(1) The chief executive may make investigations about a person 26 to decide whether the person is eligible for appointment as a 27 director. 28 `(2) Without limiting subsection (1), the chief executive may ask 29 the commissioner of the police service for a written report 30 about the criminal history of the person. 31 `(3) The commissioner must give the report to the chief executive. 32

3 Natural Resources Legislation Amendment Bill 2004 (ii) changes the location of the area proposed to be cleared; and (c) from the day the development approval has effect, the approval can not be changed in any way that-- (i) increases the size of the area approved to be cleared; or (ii) changes the location of the area approved to be cleared; or (iii) extends the currency period for the approval. `(2) Subsection (1)(b)(ii) does not apply to an application decided before the commencement of this section if an appeal against the decision was started before the commencement. `(3) Subsection (1)(c) applies to a development approval even if the approval had effect before the commencement of this section. `(4) Despite the Planning Act, section 3.5.21,3 the currency period for a development approval for an existing application (pre VACA) must end no later than 31 December 2006. `(5) In this section-- existing application (pre VACA) means a development application, as defined under the Planning Act, involving the clearing of vegetation and made before midday 16 May 2003. location, of an area proposed to be cleared in an existing application (pre VACA), means-- (a) the boundary delineating the area in the property vegetation management plan for the application; or (b) if the application was amended before it was decided--the boundary of the area described in the amendment. 3 Planning Act, section 3.5.21 (When approval lapses)

 


 

4 Natural Resources Legislation Amendment Bill 2004 `77 Existing applications (pre VACA) and permits under the Land Act 1994 `(1) An existing application (pre VACA) must be dealt with under the Land Act 1994, as in force on 20 May 2004. `(2) Despite subsection (1)-- (a) before an existing application (pre VACA) is decided, the application can not be changed in any way that increases the size of the area proposed to be cleared; and (b) from the day the application is decided until the end of the appeal period, the application can not be changed in any way that-- (i) increases the size of the area proposed to be cleared; or (ii) changes the location of the area proposed to be cleared; and (c) from the end of the appeal period, the permit can not be changed in any way that-- (i) increases the size of the area approved to be cleared; or (ii) changes the location of the area approved to be cleared; or (iii) extends the term of the permit. `(3) Subsection (2)(b)(ii) does not apply to an application decided before the commencement of this section if an appeal against the decision was started before the commencement. `(4) Subsection (2)(c) applies to a tree clearing permit even if the appeal period, in relation to the permit, ended before the commencement of this section. `(5) Despite the Land Act 1994, section 264,4 the term of a tree clearing permit for an existing application (pre VACA) must end no later than 31 December 2006. `(6) In this section-- end of the appeal period means-- 4 Land Act 1994, section 264 (Terms of tree clearing permit)

6 Natural Resources Legislation Amendment Bill 2004 (a) the proposed tree clearing is necessary for 1 or more of the following-- (i) a project declared to be a significant project under the State Development and Public Works Organisation Act 1971, section 26;7 (ii) a project that is of major significance because of its regional, State or national benefit; (iii) supplying fodder for stock in a drought declared area; (iv) weed control; (v) ensuring public safety; (vi) establishing a necessary fence, road or other built infrastructure if there is no suitable alternative site for the fence, road or infrastructure; or (b) the area proposed to be cleared is an area of regrowth vegetation. `(3) In this section-- existing application (post VACA) means an application for a tree clearing permit made at or after midday 16 May 2003 under the Land Act 1994, chapter 5, part 6, as in force at that time. tree has the same meaning as in the Forestry Act 1959.'.'. © State of Queensland 2004 7 State Development and Public Works Organisation Act 1971, section 26
