AN AGREEMENT made on between THE STATE OF 19
NEW SOUTH WALES and THE STATE OF QUEENSLAND. 20

WHEREAS-- 1
(a) an agreement was made between the States on 27 November 2
1946 (the "original agreement") that was approved and ratified 3
under-- 4
(i) the New South Wales-Queensland Border Rivers Act 1947 5
of the State of New South Wales; and 6
(ii) the New South Wales-Queensland Border Rivers Act 1946 7
of the State of Queensland; and 8
(b) an agreement amending the original agreement was made 9
between the States on 4 November 1968 (the "first amending 10
agreement") that was approved and ratified under-- 11
(i) the New South Wales-Queensland Border Rivers 12
(Amendment) Act 1968 of the State of New South Wales; 13
and 14
(ii) the New South Wales-Queensland Border Rivers Act 15
Amendment Act 1968 of the State of Queensland; and 16
(c) an agreement amending the original agreement as amended by 17
the first amending agreement was made between the States on 18
15 March 1993 (the "second amending agreement") that was 19
approved and ratified under-- 20
(i) the New South Wales-Queensland Border Rivers 21
(Amendment) Act 1993 of the State of New South Wales; 22
and 23
(ii) the New South Wales-Queensland Border Rivers Act 24
Amendment Act 1993 of the State of Queensland; and 25
(d) the States desire to make further amendments of the original 26
agreement as amended by the first amending agreement and the 27
second amending agreement. 28
NOW IT IS AGREED as follows-- 29

PART 1--PRINCIPAL AGREEMENT 1
1 Definition 2
In this agreement-- 3
"principal agreement" means the original agreement as amended by the 4
first amending agreement and the second amending agreement. 5
2 Binding of States 6
The principal agreement continues to bind the States subject to the 7
amendments of the principal agreement made by this agreement. 8
PART 2--RATIFICATION OF AGREEMENT 9
3 Ratification 10
(1) This agreement-- 11
(a) is subject to ratification by the Parliaments of the States; and 12
(b) comes into effect when so ratified. 13
(2) Each State is to take all practicable steps to have this agreement 14
ratified. 15
PART 3--AMENDMENT OF PRINCIPAL AGREEMENT 16

The principal agreement is amended as set out in this agreement. 18
5 Amendment of clause 37 (Determination of anticipated available 19
quantity) 20

omit subclause and insert the following new subclause. 1
"(2) In determining the supply of water a party hereto is, for any 2
complete year, entitled, the Commission may allocate to that party any part 3
of the supply of water to which that party was entitled in respect of any 4
previous period of time and which was not expended by that party.". 5
