s1 4 s5 Native Title Resolution The Parliament of Queensland enacts-- 1 ART 1--PRELIMINARY 2 P title 3 Short Clause 1. This Act may be cited as the Native Title Resolution Act 2000. 4 5 Commencement Clause 2. This Act commences on a day to be fixed by proclamation. 6 ART 2--AMENDMENT OF LAND AND RESOURCES 7 P TRIBUNAL ACT 1999 8 amended in pt 2 9 Act Clause 3. This part amends the Land and Resources Tribunal Act 1999. 10 of pt 4, div 2, hdg 11 Amendment Clause 4. After section 51A-- 4 insert-- 5 of tribunal for registered indigenous land use agreements 6 `Jurisdiction `51B.(1) This section applies if-- 7 (a) there is a registered indigenous land use agreement under the 8 Commonwealth Native Title Act; and 9 (b) the State is a party to the agreement; and 10 (c) the agreement provides for a matter arising under the agreement 11 to be referred to the tribunal for-- 12 (i) mediation of the matter; or 13 (ii) the making of a recommendation about the matter; or 14 (iii) the making of a decision about the matter. 15 `(2) The tribunal has jurisdiction-- 16 (a) if subsection (1)(c)(i) applies--to mediate the matter under part 4, 17 division 5; or 18 (b) if subsection (1)(c)(ii) applies--to make a recommendation about 19 the matter; or 20 (c) if subsection (1)(c)(iii) applies--to make a decision about the 21 matter.'. 22 of s 83 (Proceeding not finished before commencement) 23 Amendment Clause 7. s8 6 s 10 Native Title Resolution ART 3--AMENDMENT OF MINERAL RESOURCES 1 P ACT 1989 2 amended in pt 3 3 Act Clause 8. This part amends the Mineral Resources Act 1989. 4 of s 657 (Ending of additional requirements) 5 Amendment Clause 9. Section 657-- 6 insert-- 7 `(2) However, if the Governor in Council grants the proposed mining 8 lease, and there are 1 or more registered native title parties, the holder of the 9 mining lease must, within 28 days after the holder receives notice of the 10 grant, give a written notice complying with subsection (3) to each registered 11 native title party. 12 Maximum penalty--100 penalty units. 13 `(3) The written notice must advise the granting of the mining lease and 14 state any conditions of the mining lease.'. 15 of s 666 (Process for consultation and 16 Amendment negotiation--negotiated agreement with or without conditions 17 attached) 18 Clause 10. Section 666-- 19 insert-- 20 `(4) However, if the Governor in Council grants the proposed mining 21 lease, the holder of the mining lease must, within 28 days after the holder 22 receives notice of the grant, give a written notice complying with 23 subsection (5) to each registered native title party. 24 Maximum penalty--100 penalty units. 25 `(5) The written notice must advise the granting of the mining lease and 26 state any conditions of the mining lease.'. 27

Section 707-- 2 insert-- 3 `(5A) Without limiting subsection (1), the tribunal, in arriving at a 4 compensation decision or compensation trust decision, must apply all 5 relevant principles applicable under this Act for deciding amounts of 6 compensation.'. 7 of s 725 (Application of div 2) 8 Amendment Clause 12.(1) Section 725, `commencement of this section'-- 9 omit, insert-- 10 `native title provisions start day for the application'. 11 (2) Section 725-- 12 insert-- 13 `(3) The Minister may by gazette notice notify, in relation to an 14 application, a native title provisions start day. 15 `(4) The Minister, in notifying the native title provisions start day-- 16 (a) must have regard to when the native title provisions relevant to the 17 application start to have application; and 18 (b) accordingly, is not stopped from notifying as the native title 19 provisions start day a day that is earlier than the day the gazette 20 notice is published.'. 21 of s 726 (Definitions for div 2) 22 Amendment Clause 13. 51 Native Title Resolution SCHEDULE 2 (continued) `Consultation period and consultation period advice day 1 `546.(1) The "consultation period", for entry to an area-- 2 (a) starts 1 month after the consultation period advice day for entry to 3 the area; and 4 (b) ends 2 months after it starts. 5 `(2) The "consultation period advice day", for entry to an area, is the 6 day the notice is given under subsection (4). 7 `(3) The consultation period advice day must not be less than 3 months 8 after the application notice relating to the low impact mineral development 9 licence was given, or, if a replacement notice was given under section 543, 10 the day the replacement notice was given. 11 `(4) The licence holder must give notice of the day on which the 12 consultation period for entry to the area is to start, and the area to which the 13 consultation in the consultation period is to relate, to-- 14 (a) each entity that is a registered native title party for land included in 15 the area; and 16 (b) the mining registrar. 17 `(5) The notice given under subsection (4) must contain a clear 18 description of the area to be entered and its location, and a description of the 19 nature of the low impact activities proposed for the area.'. 20 59. Section 547(3), `a native title notification party'-- 4 omit, insert-- 5 `the registered native title party'. 6 62. Section 548-- 7 omit, insert-- 8 `Decision by tribunal 9 `547A.(1) If an access agreement for entry to an area is not obtained 10 within 1 month after the mining registrar has been asked to hold a 11 conference for mediation about the agreement, the licence holder or the 12 registered native title party may ask the mining registrar to refer the matter 13 to the tribunal for a decision. 14 `(2) The tribunal may decide the terms of the access agreement. 15 `(3) If the tribunal decides the terms of the access agreement-- 16 (a) subject to any order made by the tribunal in the matter, the access 17 agreement decided by the tribunal has effect as an access 18 agreement as if the registered native title party and the licence 19 holder had executed it; and 20 (b) the tribunal must also make a compensation decision or 21 compensation trust decision for the registered native title party 22 under part 18. 23 `Notice of access agreement 24 `548.
