s1 4 s6 Rural Adjustment Authority Amendment Bill 2004 The Parliament of Queensland enacts-- 1 Clause 1 Short title 2 This Act may be cited as the Rural Adjustment Authority 3 Amendment Act 2004. 4 Clause 2 Act amended 5 This Act amends the Rural Adjustment Authority Act 1994. 6 Clause 3 Amendment of title 7 Title, after `rural'-- 8 insert-- 9 `and regional'. 10 Clause 4 Replacement of s 1 (Short title) 11 Section 1-- 12 omit, insert-- 13 `1 Short title 14 `This Act may be cited as the Rural and Regional Adjustment 15 Act 1994.'. 16 Clause 5 Omission of s 2 (Commencement) 17 Section 2-- 18 omit. 19 Clause 6 Amendment of s 3 (Objective of Act) 20 (1) Section 3, heading-- 21 omit, insert-- 22

s 12 7 s 12 Rural Adjustment Authority Amendment Bill 2004 `9A Ministerial direction or notice 1 `(1) The Minister may give the authority a written direction about 2 the performance of the authority's functions or the exercise of 3 its powers, or written notice of a public sector policy, if the 4 Minister is satisfied it is necessary to give the direction or 5 notice in the public interest. 6 `(2) The authority must ensure the direction or policy is complied 7 with. 8 `(3) However, before giving the direction or notice the Minister 9 must-- 10 (a) consult with the authority; and 11 (b) ask the authority to advise whether, in its opinion, 12 complying with the direction or policy would not be in 13 its financial interest. 14 `(4) The Minister must gazette a copy of the direction or notice 15 within 21 days after the direction or notice is given. 16 `(5) The authority-- 17 (a) must include in its annual report, prepared under the 18 Financial Administration and Audit Act 1977, section 19 46J, details of any direction or notice given by the 20 Minister under subsection (1) during the financial year 21 to which the report relates; and 22 (b) may include in the report a comment on the effect on the 23 authority's activities of complying with the direction or 24 policy.'. 25 Clause 12 Amendment of s 11 (Approved assistance schemes) 26 (1) Section 11(1)(c)-- 27 omit, insert-- 28 `(c) is approved under a regulation.'. 29 (2) Section 11-- 30 insert-- 31 `(1A) A regulation approving a scheme must set out the scheme in 32 detail.'. 33

 


 

s 13 8 s 13 Rural Adjustment Authority Amendment Bill 2004 (3) Section 11(3)-- 1 omit, insert-- 2 `(3) A regulation may also approve a scheme if-- 3 (a) the scheme is established by the Commonwealth or 4 another State or an entity that represents the State, the 5 Commonwealth or another State; and 6 (b) the purpose of the scheme is consistent with the object 7 of this Act. 8 `(3A) An assistance scheme approved under subsection (4) is also 9 an approved assistance scheme for this Act.'. 10 (4) Section 11(1A) to (4)-- 11 renumber as section 11(2) to (6). 12 Clause 13 Insertion of new pt 3A 13 After part 3-- 14 insert-- 15 `Part 3A Review of decisions 16 `13A Who may apply for internal review 17 `A person who is dissatisfied by a decision of the authority 18 under section 12(1)(a) to (e) or section 43(2), in relation to an 19 approved assistance scheme, may apply to the chief executive 20 officer for an internal review of the decision. 21 `13B How to apply for internal review 22 `(1) An application for internal review of a decision must be-- 23 (a) made in the approved form; and 24 (b) supported by enough information to enable the chief 25 executive officer to decide the application; and 26 (c) made within 20 business days after the person receives 27 notice of the decision. 28

 


 

s 14 9 s 14 Rural Adjustment Authority Amendment Bill 2004 `(2) However, the chief executive officer may extend the time for 1 applying for an internal review. 2 `(3) The decision is stayed until the chief executive makes a 3 decison under section 13C. 4 `13C Review decision 5 `(1) The chief executive officer must, within 30 business days after 6 receiving the application-- 7 (a) review the decision (the original decision); and 8 (b) make a decision (the review decision) to-- 9 (i) confirm the original decision; or 10 (ii) amend the original decision; or 11 (iii) substitute another decision for the original 12 decision; and 13 (c) give the applicant notice (the review notice) of the 14 review decision. 15 `(2) If the review decision is not the decision sought by the 16 applicant, the review notice must also state the reasons for the 17 review decision. 18 `(3) If the chief executive officer does not comply with 19 subsection (1), the chief executive officer is taken to have 20 made a decision confirming the original decision.'. 21 Clause 14 Amendment of s 15 (Role of the board) 22 Section 15(2)-- 23 omit, insert-- 24 `(2) Without limiting subsection (1), it is the board's role-- 25 (a) to decide the strategies and the operational, 26 administrative and financial policies to be followed by 27 the authority; and 28

 


 

s 15 10 s 15 Rural Adjustment Authority Amendment Bill 2004 (b) to ensure the authority performs its functions1 in a 1 proper, effective and efficient way; and 2 (c) to review annually the performance of the authority's 3 chief executive officer.'. 4 Clause 15 Replacement of s 16 (Composition of board) 5 Section 16-- 6 omit, insert-- 7 `16 Composition of board 8 `(1) The board consists of the following persons (each of whom is 9 a director)-- 10 (a) the chief executive; 11 (b) the chief executive of the department in which the 12 Financial Administration and Audit Act 1977 is 13 administered; 14 (c) not more than 5 other persons, appointed by the 15 Governor in Council, who have the skills and experience 16 necessary to enable them to contribute effectively to the 17 board's ability to perform its functions. 18 19 Example of skills for paragraph (c)-- 20 financial skills, strategic and business planning skills, rural 21 industry skills `(2) The Governor in Council must appoint 1 of the directors 22 appointed under subsection (1)(c) as the chairperson. 23 `(3) The chairperson's term of appointment ends when the 24 person's term of appointment as a director ends. 25 `16A Chairperson to report to Minister 26 `(1) The chairperson must report to the Minister on the 27 performance of the authority's functions and the exercise of 28 its powers. 29 `(2) A report under subsection (1) must be given-- 30 1 See section 8 (Authority's functions).

 


 

s 15 11 s 15 Rural Adjustment Authority Amendment Bill 2004 (a) within 1 month after the end of each quarter; and 1 (b) at any other time at the Minister's request. 2 `(3) Also, if the chairperson becomes aware of a matter the 3 chairperson is satisfied may adversely affect the authority's 4 ability to perform its functions, the chairperson must 5 immediately report the matter to the Minister. 6 `(4) In subsection (2)-- 7 quarter means a 3 month period ending on 31 March, 8 30 June, 30 September or 31 December. 9 `16B Chairperson to give business plan to Minister 10 `(1) The chairperson must give the Minister a copy of each 11 business plan, prepared by the chief executive officer, by 12 30 April in the year for which the plan is prepared. 13 `(2) The chairperson must not give a copy of a business plan to the 14 Minister unless the board has approved the business plan. 15 `16C Reporting and accountability 16 `(1) The Minister may, at any time, require the chairperson to give 17 the Minister stated information and reports in the way, and 18 within the time, the Minister requires. 19 `(2) The chairperson must comply with the requirement to the 20 extent the chairperson is able to comply with it. 21 `(3) If the chairperson can not comply with the requirement, the 22 chairperson must give the Minister reasons for not being able 23 to comply. 24 `(4) The chairperson must give the Minister a report on any matter 25 of which the chairperson becomes aware that may 26 significantly affect the authority's ability to perform its 27 functions. 28 `(5) The chairperson must give the Minister a report mentioned in 29 subsection (4) as soon as practicable but within 1 month after 30 the chairperson first becomes aware of the matter. 31

 


 

s 16 12 s 18 Rural Adjustment Authority Amendment Bill 2004 `Division 1A Other provisions about directors'. 1 Clause 16 Amendment of s 17 (Duration of appointment) 2 (1) Section 17(1)-- 3 omit, insert-- 4 `(1) A director appointed under section 16(1)(c) is appointed for 5 the term, of not more than 3 years, stated in the director's 6 instrument of appointment. 7 `(1A) The terms of appointment must be staggered so that, as far as 8 practicable, half the directors' terms end every 18 months.'. 9 (2) Section 17(2), after `director', first mention-- 10 insert-- 11 `appointed under section 16(1)(c)'. 12 17 Replacement of s 31 (Chief executive appointed under 13 this Act) Clause 14 Section 31-- 15 omit, insert-- 16 `31 Chief executive officer appointed under this Act 17 `The chief executive officer is to be appointed under this Act, 18 and not under the Public Service Act 1996.'. 19 Clause 18 Insertion of new s 35A 20 Part 5, division 1-- 21 insert-- 22 `35A Chief executive officer to prepare business plan 23 `(1) Without limiting section 28(2), the chief executive officer 24 must-- 25 (a) prepare a business plan for each year; and 26 (b) give the plan to the board by 31 March in the year for 27 which the plan is prepared. 28

 


 

s 19 13 s 21 Rural Adjustment Authority Amendment Bill 2004 `(2) The business plan must cover the authority's operations for 1 the year in which the plan is prepared and the following 2 2 years.'. 3 Clause 19 Insertion of new s 45 4 Part 6-- 5 insert-- 6 `45 Review of Act 7 `(1) The Minister must review this Act within 5 years after the 8 commencement of this section to decide whether its 9 provisions remain appropriate. 10 `(2) The Minister must, as soon as practicable after finishing the 11 review, table a report about the outcome of the review in the 12 Legislative Assembly.'. 13 20 Amendment of pt 7, hdg (Savings, transitional and 14 validation provisions) Clause 15 Part 7, heading, after `Provisions'-- 16 insert-- 17 `for Act No. 50 of 1994'. 18 Clause 21 Insertion of new pt 8 19 After part 7-- 20 insert-- 21 `Part 8 Other transitional provisions 22 `52 Continuance of authority 23 `The Queensland Rural Adjustment Authority established 24 under this Act, as in force immediately before the 25 commencement of this section, is continued in existence as 26 QRAA. 27

 


 

s 21 14 s 21 Rural Adjustment Authority Amendment Bill 2004 `53 Transitional appointments of directors of board 1 `(1) This section applies to a person holding appointment as a 2 director immediately before the commencement of this 3 section. 4 `(2) The term of appointment stated in the person's instrument of 5 appointment as a director continues to apply as if section 17 6 had not been amended by the Rural Adjustment Authority 7 Amendment Act 2004. 8 `54 Existing approved assistance schemes 9 `(1) A transitional scheme is, for the transitional period for the 10 scheme, taken to be an approved assistance scheme. 11 `(2) A transitional scheme may be read with the changes necessary 12 to-- 13 (a) make it consistent with this Act; and 14 (b) adapt its operation to the provisions of this Act. 15 `(3) In this section-- 16 transitional period, for a transitional scheme, means the 17 period from the commencement of this section until-- 18 (a) 2 years after the commencement; or 19 (b) the transitional scheme is earlier approved under 20 section 11(1)(c). 21 transitional scheme means an approved assistance scheme in 22 existence under this Act immediately before the 23 commencement of this section.'. 24 © State of Queensland 2004
