2002 A BILL FOR An Act to amend Acts administered by the Treasurer, and for other purposes

 


 

s1 6 s3 Revenue and Other Legislation Amendment Bill 2002 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title Clause 3 This Act may be cited as the Revenue and Other Legislation Amendment 4 Act 2002. 5 2 Commencement Clause 6 (1) Part 5, other than sections 21 to 27, 29, 31 to 37, 39 and 40(1) 7 and (2), is taken to have commenced on 17 April 2001. 8 (2) Sections 21(1) and (2), 31 and 39 are taken to have commenced on 9 25 June 2001. 10 (3) Part 4, other than sections 13, 15 and 16, is taken to have commenced 11 on 9 October 2001. 12 (4) Sections 15 and 16 are taken to have commenced on 1 January 2002. 13 (5) Part 3, other than sections 9 and 10, is taken to have commenced on 14 1 March 2002. 15 (6) Sections 51 and 53 commence on 1 July 2002. 16 (7) Section 46 commences on 1 January 2003. 17 (8) The remaining provisions of this Act commence on assent. 18 PART 2--AMENDMENT OF DEBITS TAX ACT 1990 19 3 Act amended in pt 2 Clause 20 This part amends the Debits Tax Act 1990. 21

 


 

s4 7 s6 Revenue and Other Legislation Amendment Bill 2002 4 Amendment of s 7 (Liability to tax) Clause 1 (1) Section 7-- 2 insert-- 3 `(1A) If-- 4 (a) under section 4(1)(c), tax is imposed on an eligible debit to an 5 account kept outside Queensland; and 6 (b) the financial institution with which the account is kept promoted 7 the establishing and keeping of the account outside Queensland; 8 and 9 (c) it would be concluded that the sole or dominant purpose of the 10 promotion was to encourage avoidance of the liability for 11 payment of tax imposed by this Act; 12 the financial institution and the account holder (or, if there are 2 or more 13 account holders, the account holders) are jointly and severally liable to pay 14 the tax.'. 15 (2) Section 7(2), `an account other than a taxable'-- 16 omit, insert-- 17 `another'. 18 (3) Section 7(1A) and (2)-- 19 renumber as section 7(2) and (3). 20 5 Amendment of sch 2 (Modifications of Commonwealth Act) Clause 21 Schedule 2, section 17, `7(2)'-- 22 omit, insert-- 23 `7(3)'. 24 PART 3--AMENDMENT OF DUTIES ACT 2001 25 6 Act amended in pt 3 Clause 26 This part amends the Duties Act 2001. 27

 


 

s7 8 s9 Revenue and Other Legislation Amendment Bill 2002 7 Amendment of s 422 (What is a "de facto relationship Clause 1 instrument") 2 Section 422, from `property from'-- 3 omit, insert-- 4 `property-- 5 (a) a recognised agreement under the Property Law Act 1974, 6 section 266; 7 (b) an order of a court under the Property Law Act 1974, part 19; 8 (c) an instrument made under an instrument mentioned in 9 paragraph (a) or (b).'. 10 8 Amendment of s 423 (What is "de facto relationship property") Clause 11 Section 423, from `that is'-- 12 omit. 13 9 Insertion of new s 431A Clause 14 In chapter 10, part 4-- 15 insert-- 16 `431A Exemption--Queensland Treasury Corporation and its 17 affiliates 18 `(1) This section applies to a financial arrangement, or other 19 arrangement, entered into or made by the Queensland Treasury 20 Corporation or an affiliate of the corporation. 21 `(2) Subject to the conditions in subsection (3), duty is not imposed on 22 an instrument or transaction that gives effect to, or is a part of, the 23 arrangement. 24 `(3) The conditions are-- 25 (a) the corporation or affiliate must be a party to the instrument or 26 transaction or another instrument or transaction that gives effect 27 to, or is part of, the arrangement; and 28 (b) the Treasurer must certify the arrangement has as its objective-- 29 (i) the advancement of the State's financial interests; or 30

 


 

s 10 9 s 11 Revenue and Other Legislation Amendment Bill 2002 (ii) the development of the State or a part of the State; or 1 (iii) the benefit of persons, or a class of person, resident in or 2 having or likely to have an association with the State. 3 `(4) In this section-- 4 "affiliate", of the Queensland Treasury Corporation, means an affiliate of 5 the corporation under the Queensland Treasury Corporation Act 1988. 6 "financial arrangement" means a financial arrangement under the 7 Queensland Treasury Corporation Act 1988. 8 "Queensland Treasury Corporation" means the Queensland Treasury 9 Corporation constituted under the Queensland Treasury Corporation 10 Act 1988.'. 11 10 Amendment of s 508 (Regulation-making power) Clause 12 Section 508-- 13 insert-- 14 `(3) A regulation may exempt from the imposition of duty an instrument 15 or transaction for a financial arrangement entered into by a statutory body 16 as defined in the Statutory Bodies Financial Arrangements Act 1982 as 17 provided in that or another Act.'. 18 11 Amendment of s 533 (Liability for mortgage duty for particular Clause 19 mortgages first signed before commencement day) 20 (1) Section 533(1), `Subsection (2)'-- 21 omit, insert-- 22 `This section'. 23 (2) Section 533(1)(c), after `Act'-- 24 insert-- 25 `or a corresponding Act'. 26 (3) Section 533-- 27 insert-- 28

 


 

s 12 10 s 13 Revenue and Other Legislation Amendment Bill 2002 `(1A) To remove any doubt, it is declared that the mortgage is a 1 mortgage for section 248 and section 252(2) applies to it.1'. 2 PART 4--AMENDMENT OF FIRST HOME OWNER 3 GRANT ACT 2000 4 12 Act amended in pt 4 Clause 5 This part amends the First Home Owner Grant Act 2000. 6 13 Amendment of s 9 (Meaning of "spouse") Clause 7 (1) Section 9(2), `living or'-- 8 omit, insert-- 9 `living together and'. 10 (2) Section 9(3), `subsection (2)'-- 11 omit, insert-- 12 `subsections (2) and (6)'. 13 (3) Section 9-- 14 insert-- 15 `(6) Subsection (7) applies if the commissioner is satisfied, when 16 deciding an application for a first home owner grant, an applicant for the 17 grant-- 18 (a) is living apart from the person who, under subsection (2), would 19 otherwise be the applicant's de facto spouse; and 20 (b) they intend to again live together as a couple. 21 `(7) The person must be regarded as the applicant's spouse.'. 22 1 Sections 248 (What is a "mortgage") and 252 (When liability for mortgage duty arises)

 


 

s 14 11 s 14 Revenue and Other Legislation Amendment Bill 2002 14 Amendment of s 25B (Meaning of "special eligible transaction" Clause 1 for div 5) 2 (1) Section 25B(1)(b)(i), `16 weeks after the commencement date,'-- 3 omit, insert-- 4 `the prescribed start period'. 5 (2) Section 25B(1)(b)(ii), `1 year after it is started'-- 6 omit, insert-- 7 `the prescribed building period'. 8 (3) Section 25B(1)(c) and (2), `1 May 2003'-- 9 omit, insert-- 10 `the prescribed completion date'. 11 (4) Section 25B(2), `that date'-- 12 omit, insert-- 13 `the prescribed completion date'. 14 (5) Section 25B-- 15 insert-- 16 `(6) In this section-- 17 "period 1 transaction" means an eligible transaction the commencement 18 date for which is between 9 March 2001 and 8 October 2001, both 19 dates inclusive. 20 "period 2 transaction" means an eligible transaction the commencement 21 date for which is between 9 October 2001 and 31 December 2001, 22 both dates inclusive. 23 "prescribed building period", for building work, means-- 24 (a) for a period 1 transaction--the period starting on the date the 25 work is started and ending 1 year after it is started; or 26 (b) for a period 2 transaction--the period starting on the date the 27 work is started and ending 18 months after it is started. 28 "prescribed completion date" means-- 29 (a) for a period 1 transaction--1 May 2003; or 30 (b) for a period 2 transaction--1 January 2004. 31

 


 

s 15 12 s 16 Revenue and Other Legislation Amendment Bill 2002 "prescribed start period", for building work, means-- 1 (a) for a period 1 transaction--the period starting on the 2 commencement date and ending 16 weeks after that date; or 3 (b) for a period 2 transaction--the period starting on the 4 commencement date and ending 26 weeks after that date.'. 5 15 Amendment of s 25B (Meaning of "special eligible transaction" Clause 6 for div 5) 7 (1) Section 25B(1), and 25B(6), definition "period 2 transaction", 8 `31 December 2001'-- 9 omit, insert-- 10 `30 June 2002'. 11 (2) Section 25B(6), definition "prescribed completion date", 12 paragraph (b)-- 13 omit, insert-- 14 `(b) for a period 2 transaction for which the commencement date is 15 between 9 October 2001 and 31 December 2001, both dates 16 inclusive--1 January 2004; or 17 (c) for a period 2 transaction for which the commencement date is 18 between 1 January 2002 and 30 June 2002, both dates 19 inclusive--1 July 2004.'.2 20 16 Amendment of s 25C (Amount of grant) Clause 21 Section 25C(b)-- 22 omit, insert-- 23 `(b) if-- 24 (i) the commencement date for the transaction is between 25 9 March 2001 and 31 December 2001, both dates 26 inclusive--$14 000; or 27 2 The amendments of section 25B made by this section commence at a later date than the amendments of the section made by section 14, see section 2(3) and (4).

 


 

s 17 13 s 20 Revenue and Other Legislation Amendment Bill 2002 (ii) the commencement date for the transaction is between 1 1 January 2002 and 30 June 2002, both dates 2 inclusive--$10 000.'. 3 17 Omission of s 25D (Expiry of div 5) Clause 4 Section 25D-- 5 omit. 6 18 Omission of pt 7 (Transitional provisions for First Home Owner Clause 7 Grant Amendment Act 2001) 8 Part 7-- 9 omit. 10 PART 5--AMENDMENT OF FUEL SUBSIDY ACT 1997 11 19 Act amended in pt 5 Clause 12 This part amends the Fuel Subsidy Act 1997. 13 20 Amendment of s 8 (Meaning of "off-road purpose") Clause 14 Section 8(1)-- 15 omit, insert-- 16 `(1) An "off-road purpose", for diesel, means a purpose other than-- 17 (a) to propel a diesel engine road vehicle on-- 18 (i) a public road; or 19 (ii) another road if the purpose is merely to enable the vehicle to 20 access a public road and is incidental to gaining access to 21 the public road; or 22 (b) a purpose that is merely incidental to a purpose mentioned in 23 paragraph (a).'. 24

 


 

s 21 14 s 22 Revenue and Other Legislation Amendment Bill 2002 21 Amendment of s 19 (Calculating provisional subsidy) Clause 1 (1) Section 19(2), after `July'-- 2 insert-- 3 `and August'. 4 (2) Section 19(2), `month'-- 5 omit, insert-- 6 `June'. 7 (3) Section 19(4)-- 8 omit, insert-- 9 `(4) However, the commissioner may decide the anticipated annual 10 subsidy if-- 11 (a) the commissioner is not satisfied the anticipated annual subsidy 12 calculated under subsection (3) accurately reflects the subsidy to 13 which the retailer is likely to be entitled for the financial year; or 14 (b) the anticipated annual subsidy can not properly be calculated 15 under subsection (3); or 16 (c) the commissioner is not satisfied the anticipated annual subsidy 17 decided under paragraph (a) or (b), or previously decided under 18 this paragraph, accurately reflects the subsidy to which the 19 retailer is likely to be entitled for the financial year.'. 20 (4) Section 19-- 21 insert-- 22 `(6A) A licensed retailer may make a request under subsection (6) more 23 than once in a financial year.'. 24 (5) Section 19(6A) and (7)-- 25 renumber as section 19(7) and (8). 26 22 Replacement of s 20 (Changing dates for paying provisional Clause 27 subsidies) 28 Section 20-- 29 omit, insert-- 30

 


 

s 23 15 s 24 Revenue and Other Legislation Amendment Bill 2002 `20 When commissioner may change date for paying, or decide not 1 to pay, provisional subsidy 2 `(1) This section applies if the commissioner reasonably believes a 3 licensed retailer-- 4 (a) has not complied with, or is likely not to comply with, a 5 condition of the retailer's licence; or 6 (b) may not be entitled to a subsidy for a month; or 7 (c) may not operate as a licensed retailer for the whole of a month. 8 `(2) Despite section 18, the commissioner may decide-- 9 (a) a different date for paying a provisional subsidy to the retailer; or 10 (b) not to pay a provisional subsidy to the retailer. 11 `(3) If the commissioner makes a decision under subsection (2)(a), 12 because the retailer has not complied with licence conditions, the 13 commissioner is not required to decide a date until the commissioner is 14 satisfied the retailer has complied with the conditions. 15 `(4) The commissioner must give the licensed retailer an information 16 notice about the commissioner's decision under subsection (2).'. 17 23 Amendment of s 22 (When subsidies are claimed) Clause 18 (1) Section 22, heading-- 19 omit, insert-- 20 `When subsidies are claimed--provisional subsidy paid or payable'. 21 (2) Section 22(3), `different dates'-- 22 omit, insert-- 23 `a different date'. 24 24 Insertion of new s 22A Clause 25 After section 22-- 26 insert-- 27 `22A When subsidies are claimed--no provisional subsidy payable 28 `If, under section 20(2)(b), the commissioner decides not to pay a 29 provisional subsidy to a licensed retailer for a month, the retailer may lodge 30

s 28 19 s 28 Revenue and Other Legislation Amendment Bill 2002 `(2) However, if the commissioner is not satisfied the user's subsidy for 1 the previous financial year accurately reflects the subsidy to which the user 2 is likely to be entitled for the financial year, the commissioner may decide 3 the provisional subsidy. 4 `(3) The amount decided under subsection (2) must not be more than the 5 prescribed subsidy amount. 6 `(4) In making the decision, the commissioner must have regard to the 7 following-- 8 (a) storage sites acquired or disposed of by the user during or after 9 the previous financial year; 10 (b) the quantity of bulk end user fuel reasonably expected to be used 11 by the user in the financial year; 12 (c) any other matter the commissioner considers relevant. 13 `(5) If the commissioner makes a decision under subsection (2), the 14 commissioner must give the user an information notice about the decision. 15 `Subdivision 3--Claiming and paying subsidies 16 `34D Paying subsidy 17 `(1) After lodgment of the bulk end user's return under section 38 for the 18 financial year, the commissioner must pay to the user the subsidy to which 19 the commissioner is satisfied the user is entitled less the provisional 20 subsidy paid to the user for the year. 21 `(2) If the user does not lodge the return as required under section 38, the 22 commissioner may decide the subsidy to which the user is entitled as if the 23 user had lodged the return. 24 `(3) If the commissioner makes a decision under subsection (2), the 25 commissioner must give the user an information notice about the decision. 26 `Subdivision 4--Overpaid and underpaid provisional subsidy amounts 27 `34E Overpaid provisional subsidy amount 28 `(1) If the provisional subsidy paid to the bulk end user for the financial 29 year is more than the user's subsidy for the year, the amount of the 30

 


 

s 28 20 s 28 Revenue and Other Legislation Amendment Bill 2002 difference (the "amount") is payable by the user to the commissioner 1 when the next provisional subsidy payment is made to the user. 2 `(2) However, the commissioner may, by written notice, require the user 3 to pay the amount to the commissioner if the commissioner reasonably 4 believes a provisional subsidy will not be paid to the user for the next 5 financial year. 6 `(3) The person must pay the amount to the commissioner in the 7 reasonable time stated in the notice. 8 `(4) An amount not paid as required under subsection (1) or (3) is a debt 9 owing to the commissioner. 10 `34F Underpaid provisional subsidy amount 11 `(1) If the provisional subsidy paid to the bulk end user for a financial 12 year is less than the user's subsidy for the year, the commissioner does not 13 have to pay the amount of the difference (the "amount") until making the 14 next provisional subsidy payment to the user. 15 `(2) However, if the commissioner reasonably believes a provisional 16 subsidy will not be paid to the user for the next financial year, the amount 17 is payable by the commissioner before the end of the month after the month 18 in which the user lodges an annual return for the financial year for which 19 the provisional subsidy was paid. 20 `(3) Also, if the commissioner reasonably believes the user has not 21 complied with the user's licence conditions, the commissioner is not 22 required to pay the amount until the commissioner is satisfied the user has 23 complied with the conditions. 24 `(4) If the commissioner makes a decision under subsection (3), the 25 commissioner must give the user an information notice about the decision. 26 `Subdivision 5--Changing from provisional subsidy payments to subsidy 27 payments in arrears 28 `34G Commissioner may decide subsidy payments to be made in 29 arrears 30 `(1) The commissioner may decide this division ceases to apply to the 31 bulk end user for the financial year if-- 32

 


 

s 28 21 s 28 Revenue and Other Legislation Amendment Bill 2002 (a) at any time after a provisional subsidy is paid to the user for the 1 year, the subsidy to which the commissioner is satisfied the user 2 is entitled for the year exceeds the provisional subsidy paid; and 3 (b) the commissioner is satisfied the subsidy to which the user is 4 entitled for the year will significantly exceed the provisional 5 subsidy; and 6 (c) by written notice dated after 30 September in the financial year 7 given to the commissioner, the user asks for subsidy payments to 8 be made under division 2; and 9 (d) under division 2, the user lodges a claim for the user's subsidy 10 for the period (the "relevant period")-- 11 (i) if subparagraph (ii) does not apply--starting on 1 July in the 12 year and ending on the last day of the month before the date 13 of the notice; or 14 (ii) if the user has previously lodged a claim under division 2 15 for a period in the year--starting on the day after the end of 16 the period for which the previous claim has been lodged and 17 ending on the last day of the month before the date of the 18 notice. 19 `(2) If, under subsection (1), the commissioner decides this division 20 ceases to apply to the user for the financial year-- 21 (a) the relevant period is a claim period for section 35 for which a 22 subsidy is payable to the user; and 23 (b) the commissioner must, under section 36, pay the subsidy for the 24 period less the provisional subsidy paid to the user; and 25 (c) claim periods for the user after the relevant period are determined 26 under section 35. 27 `(3) If, under subsection (1), the commissioner decides this division does 28 not cease to apply to the user for the financial year, the commissioner must 29 give the user an information notice about the decision. 30

s 43 31 s 43 Revenue and Other Legislation Amendment Bill 2002 `(7) If the commission has not made a decision about the gaming 1 application by 31 January 2003, the application lapses at the end of that day 2 unless the commission fixes a date under subsection (8) for it to lapse. 3 `(8) Before 31 January 2003, the commission may fix a date after 4 31 January 2003 as the date for a gaming application to lapse if-- 5 (a) the chief executive receives an application for deferment of the 6 lapsing of the gaming application before or at 5 p.m. on 7 31 December 2002; and 8 (b) the commission is, after considering the application for 9 deferment, satisfied there are exceptional circumstances for a 10 deferment of the lapsing of the gaming application; and 11 (c) the date fixed is no later than 30 June 2003. 12 `(9) If the commission fixes a date under subsection (8) as the date for a 13 gaming application to lapse and the commission has not made a decision 14 about the gaming application immediately before the end of that day, the 15 gaming application lapses at the end of that day. 16 `(10) An applicant for deferment must include as part of the application 17 all supporting information and material the applicant considers relevant to 18 establish the exceptional circumstances for the deferment. 19 `(11) This section is not limited by section 56 or division 5. 20 `(12) In this section-- 21 "application for removal of a liquor licence" means an application 22 continued under the Liquor Act 1992, section 238A,5 that has not been 23 disposed of before the commencement day. 24 "application period" means the period starting on the commencement day 25 and ending on 1 October 2002. 26 "commencement day" means the day on which the Revenue and Other 27 Legislation Amendment Act 2002, part 6, commences. 28 "gaming application" means an application made under subsection (2). 29 "liquor premises" means-- 30 (a) premises that, as the result of an application for removal of a 31 liquor licence, are licensed premises within the meaning of the 32 Liquor Act 1992; or 33 5 Liquor Act 1992, section 238A (Disposal of applications for removal)
