Revenue and Other Legislation Amendment Bill 2008 Part 1 Preliminary [s 1] The Parliament of Queensland enacts-- 1 Part 1 Preliminary 2 Clause 1 Short title 3 This Act may be cited as the Revenue and Other Legislation 4 Amendment Act 2008. 5 Clause 2 Commencement 6 (1) Part 3 commences on 30 June 2008. 7 (2) Part 2, divisions 1 and 2 and part 4 commence on 1 July 2008. 8 (3) Part 5 commences on 1 August 2008. 9 (4) Part 2, division 3 commences on 1 September 2008. 10 Part 2 Amendment of Duties Act 2001 11 Division 1 Preliminary 12 Clause 3 Act amended in pt 2 13 This part amends the Duties Act 2001. 14 Page 6

Revenue and Other Legislation Amendment Bill 2008 Part 2 Amendment of Duties Act 2001 [s 7] Clause 7 Amendment of s 188 (Deduction--mortgage duty) 1 (1) Section 188(1)(a)-- 2 omit, insert-- 3 `(a) shares are transferred, or agreed to be transferred, by 4 way of security; and'. 5 (2) Section 188(2)(a)-- 6 omit, insert-- 7 `(a) shares are transferred, or agreed to be transferred, by 8 way of security; and'. 9 (3) Section 188(4), `the mortgage duty paid'-- 10 omit, insert-- 11 `any mortgage duty paid on the transfer or agreement to 12 transfer'. 13 Clause 8 Insertion of new s 247A 14 Chapter 5, part 1-- 15 insert-- 16 `247A Abolition of mortgage duty from 1 July 2008 17 `(1) Despite anything to the contrary in this chapter, mortgage 18 duty is not imposed-- 19 (a) on a mortgage first signed, or that first affects property 20 in the State, on or after 1 July 2008; or 21 (b) in relation to an advance or further advance made on or 22 after 1 July 2008, under a mortgage first signed, or that 23 first affects property in the State, before 1 July 2008; or 24 (c) on an instrument that, on the deposit of instruments of 25 title to property in Queensland, first becomes a 26 mortgage or evidences the terms of a mortgage on or 27 after 1 July 2008. 28 `(2) This section is subject to chapter 17, part 9, division 1.'. 29 Page 8

Revenue and Other Legislation Amendment Bill 2008 Part 2 Amendment of Duties Act 2001 [s 18] `470A Cancellation of registration--type of duty abolished 1 `(1) The commissioner may cancel a self assessor's registration if 2 the type of duty to which the registration relates is no longer 3 imposed under this Act. 4 `(2) If the commissioner cancels a self assessor's registration, the 5 commissioner must give notice to the self assessor that the 6 registration is cancelled effective from the date stated in the 7 notice. 8 `(3) Sections 466 to 469 do not apply in relation to the cancellation 9 of a self assessor's registration under this section.'. 10 Clause 18 Amendment of s 491 (When is an instrument properly 11 stamped) 12 Section 491(3), after `455(4)'-- 13 insert-- 14 `as in force before 1 July 2008'. 15 Clause 19 Insertion of new ch 17, pt 9 16 Chapter 17-- 17 insert-- 18 `Part 9 Transitional provisions for the 19 Revenue and Other Legislation 20 Amendment Act 2008, part 2, 21 division 2 22 `Division 1 Transitional provisions for abolition 23 of mortgage duty 24 `590 Definition for div 1 25 `In this division-- 26 Page 11

 


 

Revenue and Other Legislation Amendment Bill 2008 Part 2 Amendment of Duties Act 2001 [s 19] previous, in relation to a provision of this Act, means the 1 provision as in force immediately before 1 July 2008. 2 `591 Requirement to lodge mortgage 3 `On and from 1 July 2008, section 255 continues to apply to a 4 mortgage if the liability for mortgage duty on the mortgage 5 arose before 1 July 2008. 6 `592 Mortgage packages 7 `(1) Subsection (2) applies if-- 8 (a) a mortgage package consists of 2 or more security 9 instruments signed before 1 July 2008; and 10 (b) the commissioner is satisfied that a mortgage signed on 11 or after 1 July 2008 was intended to be part of the 12 package. 13 `(2) Mortgage duty must be assessed on the mortgage package-- 14 (a) under previous chapter 5; and 15 (b) as if the instruments comprising the package were 1 16 mortgage first signed on the day the last of the 17 instruments signed before 1 July 2008 was signed. 18 `593 Reassessment--stamping before advance 19 `(1) This section applies if-- 20 (a) a mortgage was first signed before 1 July 2008; and 21 (b) the mortgage was, under section 257, properly stamped 22 for an amount of advances secured by the mortgage; and 23 (c) the advances were not all made before 1 July 2008. 24 `(2) The mortgagor may apply to the commissioner for a 25 reassessment of mortgage duty paid in relation to the 26 advances not made before 1 July 2008. 27 `(3) The application must-- 28 Page 12

 


 

Revenue and Other Legislation Amendment Bill 2008 Part 2 Amendment of Duties Act 2001 [s 19] (a) be in the approved form; and 1 (b) include the mortgage document; and 2 (c) be made by 31 December 2008. 3 `(4) The commissioner must make the reassessment. 4 `594 Mortgage duty on caveats 5 `(1) This section applies if-- 6 (a) before 1 July 2008, mortgage duty was imposed on a 7 mortgage but was not paid; and 8 (b) on or after 1 July 2008, a caveat claimed an interest in 9 land or a water allocation under the mortgage. 10 `(2) On and from 1 July 2008, section 268 continues to apply to 11 impose mortgage duty on the caveat. 12 `(3) Mortgage duty is imposed on the caveat at the rate applicable 13 at the time the duty was imposed on the mortgage. 14 `595 Mortgage duty on releases of mortgages 15 `(1) This section applies if-- 16 (a) before 1 July 2008, mortgage duty was imposed on a 17 mortgage but was not paid; and 18 (b) on or after 1 July 2008, the mortgage is released. 19 `(2) On and from 1 July 2008, section 269 continues to apply to 20 impose mortgage duty on the release of the mortgage. 21 `(3) Mortgage duty is imposed on the release at the rate applicable 22 at the time the duty was imposed on the mortgage. 23 `596 Reassessment--Victorian and Tasmanian property 24 `(1) This section applies if, before 1 July 2008, the commissioner 25 was required under section 290A or 290B to make a 26 reassessment to impose mortgage duty on a mortgage. 27 Page 13

 


 

Revenue and Other Legislation Amendment Bill 2008 Part 2 Amendment of Duties Act 2001 [s 19] `(2) Sections 290A and 290B apply to require the reassessment to 1 impose duty based on the dutiable proportion at the liability 2 date. 3 `597 Reassessment--concessions for home mortgages 4 and first home mortgages 5 `(1) This section applies if-- 6 (a) before 1 July 2008, mortgage duty on a home mortgage 7 was assessed on the basis of a concession under chapter 8 5, part 6; and 9 (b) on or after 1 July 2008, one of the events mentioned in 10 section 291(1) happens. 11 `(2) Section 291(2) to (4) applies to enable the commissioner to 12 make a reassessment to impose mortgage duty on the 13 mortgage at the rate applicable at the time that, but for the 14 concession, the liability for mortgage duty would have arisen. 15 `598 Reassessment--concessions for cooperatives 16 `(1) This section applies if-- 17 (a) before 1 July 2008, a mortgage was given to secure an 18 advance to a cooperative registered under the 19 Cooperatives Act 1997; and 20 (b) mortgage duty was not imposed on the mortgage; and 21 (c) on or after 1 July 2008, the advance or part of it was 22 used for a noncomplying use within the meaning of 23 section 292(1). 24 `(2) Section 292(2) to (4) applies to enable the commissioner to 25 make a reassessment to impose mortgage duty on the 26 mortgage at the rate applicable at the time that, but for the 27 exemption, the liability for mortgage duty would have arisen. 28 Page 14

 


 

Revenue and Other Legislation Amendment Bill 2008 Part 2 Amendment of Duties Act 2001 [s 19] `599 Saving of previous provisions for exempt institutions 1 `(1) This section applies to an assessment for mortgage duty on a 2 mortgage given to secure an advance made-- 3 (a) to an exempt institution on the basis of an exemption 4 under chapter 10, part 2, division 1; and 5 (b) before 1 July 2008. 6 `(2) On and after 1 July 2008, previous sections 417 and 419 7 continue to apply in relation to the advance. 8 `(3) For subsection (2), a reassessment made as required under 9 previous section 419(3) imposing duty in relation to the 10 advance must be made as if the Revenue and Other 11 Legislation Amendment Act 2008, part 2 had not commenced. 12 `(4) If mortgage duty was imposed in relation to the advance 13 because the use requirements under chapter 10, part 2, 14 division 2 would not be complied with, previous section 418 15 continues to apply in relation to the advance. 16 `600 Cancellation of registration to defer 17 endorsement--s 446A 18 `(1) This section applies if, immediately before 1 July 2008, a self 19 assessor was registered under previous section 446A to defer 20 endorsement, under section 455(1)(c), of mortgages for 21 further advances under the mortgages. 22 `(2) On 1 July 2008, the registration is cancelled. 23 `(3) However, the self assessor must, by 1 January 2009, comply 24 with section 455(1)(c) in relation to any endorsement deferred 25 under previous section 455(4). 26 `601 Lapsing of application for registration to defer 27 endorsement 28 `(1) This section applies to an application to be registered under 29 previous section 446A made but not finally decided before 1 30 Page 15

 


 

Revenue and Other Legislation Amendment Bill 2008 Part 2 Amendment of Duties Act 2001 [s 19] July 2008. 1 `(2) On 1 July 2008, the application lapses. 2 `602 Requirement to lodge returns 3 `On and from 1 July 2008, section 455 continues to apply, to a 4 self assessor registered under part 2 or 3 for mortgage duty, in 5 relation to a return period that started before 1 July 2008. 6 `603 Reassessment of duty in particular circumstances 7 `(1) This section applies if-- 8 (a) before 1 July 2008, a person paid mortgage duty on a 9 mortgage; and 10 (b) on or after 1 July 2008, an event mentioned in section 11 499(2)(f) happens. 12 `(2) Section 499(5) to (8) continues to apply in relation to a 13 reassessment of the duty paid. 14 `604 Impact of div 1 15 `The inclusion in this division of a provision affecting the 16 application of a provision of chapter 5 or chapter 10 following 17 the abolition of mortgage duty on 1 July 2008 does not by 18 implication limit the continuing application of another 19 provision of the chapter. 20 `Division 2 Other transitional provisions 21 `605 Application of amendments about rates of transfer 22 duty, land rich duty and corporate trustee duty 23 `Schedule 3 as in force on 1 July 2008 applies to dutiable 24 transactions and relevant acquisitions if liability for transfer 25 duty, land rich duty or corporate trustee duty arises on or after 26 1 July 2008. 27 Page 16

 


 

Revenue and Other Legislation Amendment Bill 2008 Part 2 Amendment of Duties Act 2001 [s 20] `606 Application of amendments about concession for 1 transfer duty--residential land 2 `(1) The relevant provisions, as in force on 1 July 2008, apply to 3 dutiable transactions only if liability for transfer duty arises on 4 or after 1 July 2008. 5 `(2) The relevant provisions, as in force immediately before 1 July 6 2008, apply to a dutiable transaction that is the transfer, or 7 agreement for the transfer, of residential land made on or after 8 1 July 2008 if-- 9 (a) the transfer or agreement replaces a transfer, or an 10 agreement for the transfer, that included the land and 11 was made before 1 July 2008; or 12 (b) the transferee had an option to purchase the land, or the 13 transferor had an option to require the transferee to 14 purchase the land, granted before 1 July 2008 and 15 exercised on or after 1 July 2008; or 16 (c) another arrangement was made before 1 July 2008 the 17 sole or main purpose of which was to defer the making 18 of the transfer or agreement until 1 July 2008 or later so 19 the concession for transfer duty under the relevant 20 provisions, as in force on or after 1 July 2008, would 21 apply in relation to the dutiable transaction. 22 `(3) In this section-- 23 relevant provisions means the following provisions-- 24 · chapter 2, part 9, divisions 2 and 3 25 · chapter 2, part 14, division 1 26 · schedule 4A.'. 27 Clause 20 Replacement of sch 3 (Rates of duty on dutiable 28 transactions and relevant acquisitions for land rich and 29 corporate trustee duty) 30 Schedule 3-- 31 omit, insert-- 32 Page 17
