Relationships (Civil Partnerships) and Other Acts Amendment Bill 2015 Part 2 Amendment of Relationships Act 2011 [s 10] Clause 10 Replacement of s 6 (How registered relationship is 1 entered into) 2 Section 6-- 3 omit, insert-- 4 6 How civil partnership is entered into 5 Two adults who are in a relationship as a couple, 6 regardless of their sex, and who meet the 7 eligibility criteria mentioned in section 5, may 8 enter into a civil partnership by-- 9 (a) having their relationship registered under 10 section 9; or 11 (b) making a declaration of civil partnership 12 under section 11 and having their 13 relationship registered under section 12. 14 Note-- 15 The registrar must enter particulars of a civil partnership 16 entered into under this Act in the register under the 17 Births, Deaths and Marriages Registration Act 2003, 18 part 5A. 19 Clause 11 Amendment of s 7 (Application for registration) 20 (1) Section 7(1) and (2), 'registered relationship'-- 21 omit, insert-- 22 civil partnership 23 (2) Section 7(1), 'section 6'-- 24 omit, insert-- 25 section 6(a) 26 (3) Section 7(2), 'must be accompanied'-- 27 omit, insert-- 28 accompanied 29 (4) Section 7(2)(b) and (c), 'under a regulation'-- 30 Page 8

Relationships (Civil Partnerships) and Other Acts Amendment Bill 2015 Part 2 Amendment of Relationships Act 2011 [s 14] (b) if the civil partnership notary mentioned in 1 paragraph (a) is not the registrar--the 2 registrar. 3 Note-- 4 The notice must be given not earlier than 12 months and 5 not later than 10 days before the declaration of civil 6 partnership is made--see section 11(2). 7 (2) The notice must be accompanied by-- 8 (a) a statutory declaration made by each person 9 stating-- 10 (i) that the person wishes to enter into a 11 civil partnership with the other person; 12 and 13 (ii) that the person is not married or in a 14 civil partnership; and 15 (iii) that the person believes the person and 16 the other person do not have a 17 prohibited relationship; and 18 (iv) where the person lives; and 19 (b) the documents prescribed by regulation to 20 prove each person's identity and age; and 21 (c) anything else prescribed by regulation. 22 (3) The notice must state the day on which the 2 23 persons intend to make a declaration of civil 24 partnership under section 11. 25 (4) As soon as practicable after receiving the notice 26 and statutory declarations, the civil partnership 27 notary must give each person a written notice in 28 the approved form setting out the legal effect of a 29 civil partnership. 30 11 Declaration of civil partnership 31 (1) Two persons who have given notice to a civil 32 partnership notary, and the registrar if required 33 Page 10

 


 

Relationships (Civil Partnerships) and Other Acts Amendment Bill 2015 Part 2 Amendment of Relationships Act 2011 [s 14] under section 10(1)(b), may make a declaration 1 of civil partnership before the civil partnership 2 notary and at least 1 other adult witness. 3 (2) The declaration must be made not earlier than 10 4 days, and not later than 12 months, after the day 5 the notice was given to the civil partnership 6 notary. 7 (3) The declaration must be made by each person to 8 the other and must contain a clear statement 9 that-- 10 (a) names both persons; and 11 (b) acknowledges that they are freely entering 12 into a civil partnership with each other. 13 12 Registration of relationship after declaration of 14 civil partnership 15 (1) As soon as practicable after the registrar becomes 16 aware, under the Births, Deaths and Marriages 17 Registration Act 2003, section 25B(3) or 18 otherwise, of the day that 2 persons have made a 19 declaration of civil partnership under section 11, 20 the registrar must-- 21 (a) register the relationship as a civil 22 partnership and make an endorsement to 23 that effect on the notice they gave the 24 registrar under section 10; or 25 (b) refuse to register the relationship as a civil 26 partnership. 27 (2) The registrar must register the relationship as a 28 civil partnership unless satisfied that the 2 29 persons have not made a declaration of civil 30 partnership under section 11. 31 (3) The endorsement must state the day on which the 32 registration has effect, which must be-- 33 Page 11

Relationships (Civil Partnerships) and Other Acts Amendment Bill 2015 Part 2 Amendment of Relationships Act 2011 [s 20] 20 Registration of civil partnership notary 1 (1) A person may apply to the registrar to be 2 registered as a civil partnership notary. 3 (2) The application must be-- 4 (a) in the approved form; and 5 (b) accompanied by the application fee 6 prescribed by regulation. 7 (3) The approved form may require specified 8 information or documents about the applicant's 9 relevant criminal history to be included in, 10 attached to or given with the form. 11 (4) The approved form may require the form, or 12 information or documents included in, attached 13 to or given with the form, to be verified by a 14 statutory declaration. 15 (5) On application by a person under this section, the 16 registrar may register the applicant if satisfied 17 that-- 18 (a) the applicant-- 19 (i) is an adult; and 20 (ii) is appropriately qualified to exercise 21 the functions of a civil partnership 22 notary; and 23 (iii) is a suitable person to be registered as a 24 civil partnership notary; or 25 (b) the applicant is registered as a marriage 26 celebrant under the Marriage Act 1961 27 (Cwlth). 28 (6) In deciding under subsection (5)(a)(iii) whether a 29 person is a suitable person to be registered as a 30 civil partnership notary-- 31 (a) the registrar must have regard to the relevant 32 criminal history of the person; and 33 Page 14

 


 

Relationships (Civil Partnerships) and Other Acts Amendment Bill 2015 Part 2 Amendment of Relationships Act 2011 [s 20] (b) the registrar may have regard to anything 1 else the registrar considers relevant. 2 (7) If the registrar is not satisfied under subsection 3 (5), the registrar must refuse to register the 4 applicant. 5 (8) In this section-- 6 relevant criminal history, of a person, means a 7 recorded conviction, other than a spent 8 conviction, for-- 9 (a) any offence against a law of the State, 10 another State or the Commonwealth that is 11 punishable by imprisonment for 1 year or 12 more; or 13 (b) any offence against this Act. 14 spent conviction means a conviction-- 15 (a) for which the rehabilitation period under the 16 Criminal Law (Rehabilitation of Offenders) 17 Act 1986 has expired under that Act; and 18 (b) that is not revived as prescribed by section 19 11 of that Act. 20 20A Annual registration fee and annual return 21 (1) A person registered as a civil partnership notary 22 under section 20 must-- 23 (a) give the registrar the annual registration fee 24 prescribed by regulation by the day 25 prescribed by regulation; and 26 (b) by the day prescribed by regulation, give the 27 registrar an annual return, in the approved 28 form, about the information given for the 29 application for the registration. 30 (2) The approved form may require the form, or 31 information or documents included in, attached 32 Page 15

 


 

Relationships (Civil Partnerships) and Other Acts Amendment Bill 2015 Part 2 Amendment of Relationships Act 2011 [s 20] to or given with the form, to be verified by a 1 statutory declaration. 2 21 Register of civil partnership notaries 3 (1) The registrar must keep a register of persons 4 registered as civil partnership notaries under this 5 Act. 6 (2) The register may be kept in any form, including 7 electronically, that the registrar decides. 8 (3) The register must include the following 9 information for each person registered as a civil 10 partnership notary-- 11 (a) the person's full name; 12 (b) the person's address and contact details; 13 (c) the date the person was registered; 14 (d) if the person's registration is cancelled or 15 otherwise ends--the date the registration 16 ends. 17 (4) The register must be published on the 18 department's website. 19 Division 2 Cancellation 20 22 Application of div 2 21 This division applies if the registrar considers 22 that a person registered as a civil partnership 23 notary-- 24 (a) is not, or is no longer, a suitable person to be 25 registered as a civil partnership notary; or 26 (b) has not complied with section 20A. 27 Page 16
