2003 A BILL FOR An Act to amend the Residential Tenancies Act 1994 and other Acts

 


 

s1 8 s5 Residential Tenancies and Other Legislation Amendment Bill 2003 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title Clause 3 This Act may be cited as the Residential Tenancies and Other 4 Legislation Amendment Act 2003. 5 2 Commencement Clause 6 This Act commences on a day to be fixed by proclamation. 7 PART 2--AMENDMENT OF RESIDENTIAL 8 TENANCIES ACT 1994 9 3 Act amended in pt 2 and schedule Clause 10 This part and the schedule amend the Residential Tenancies Act 1994. 11 4 Omission of s 3B (Conciliator) Clause 12 Section 3B-- 13 omit. 14 5 Insertion of new ss 14A and 14B Clause 15 Chapter 1, part 3, after section 14-- 16 insert-- 17 `14A Provision stating that lessor or lessor's agent must do something 18 `(1) This section applies to a provision of this Act stating that the lessor 19 or lessor's agent must do something (the "required act"). 20

 


 

s6 9 s6 Residential Tenancies and Other Legislation Amendment Bill 2003 `(2) The reference in the provision to the lessor's agent is a reference to a 1 person who is the agent of the lessor to do the required act. 2 `(3) If the required act is done, whether by the agent or personally by the 3 lessor, both the lessor and the agent are taken to have complied with the 4 provision. 5 `(4) If the required act is omitted to be done, both the lessor and the 6 agent are taken to have contravened the provision and, if the contravention 7 is an offence-- 8 (a) each of them may be dealt with for the offence; and 9 (b) section 315(2)1 applies to a proceeding for the offence. 10 `14B Lessor's agent 11 `A reference in a provision of this Act to something being done by a 12 lessor, without mentioning an agent of the lessor, does not, by implication, 13 limit the extent to which the thing may be done by an agent of the lessor.'. 14 6 Amendment of s 27 (Approved supported accommodation) Clause 15 (1) Section 27, heading-- 16 omit, insert-- 17 `27 Headleases for approved supported accommodation'. 18 (2) Section 27(2), `subsection (1)'-- 19 omit insert-- 20 `subsection (2)'. 21 (3) Section 27(2)-- 22 renumber as section 27(3). 23 (4) Section 27(1)-- 24 omit, insert-- 25 `(1) This Act does not apply to an agreement relating to the letting of 26 premises (the "headlease") entered into by an entity as tenant for the 27 1 Section 315 (Responsibility for acts or omissions of representatives)

 


 

s7 10 s8 Residential Tenancies and Other Legislation Amendment Bill 2003 purpose of using the premises to provide approved supported 1 accommodation. 2 `(2) Subsection (1) does not prevent this Act from applying to a 3 residential tenancy agreement under which the tenant under the headlease 4 lets the premises to a person to provide the person with approved supported 5 accommodation.'. 6 7 Replacement of s 40 (Giving and signing written agreement) Clause 7 Section 40-- 8 omit, insert-- 9 `40 Giving and signing written agreement 10 `(1) The lessor or lessor's agent must give the document prepared for 11 section 39 to the tenant for signing. 12 `(2) Within 5 days after receiving the document, the tenant must sign the 13 document and return it to the lessor or lessor's agent. 14 `(3) Within 14 days after receiving the document signed by the tenant, 15 the lessor or lessor's agent must sign the document and return a copy 16 signed by both parties to the tenant. 17 Maximum penalty--10 penalty units. 18 `(4) This section does not apply to an agreement for a short tenancy 19 (moveable dwelling).'. 20 8 Amendment of s 43 (Information statement) Clause 21 Section 43(2)(b), `mediation'-- 22 omit, insert-- 23 `conciliation'. 24

 


 

s9 11 s 10 Residential Tenancies and Other Legislation Amendment Bill 2003 9 Amendment of s 53 (Rent increases) Clause 1 Section 53(7)-- 2 omit, insert-- 3 `(7) This section does not apply if the lessor is the Queensland Housing 4 Commission and the lease is given under the State Housing Act 1945, 5 section 26.2'. 6 10 Replacement of s 58 (Meaning of "rental bond contributor") Clause 7 Section 58-- 8 omit, insert-- 9 `58 Contributor for a rental bond 10 `(1) A person is a "contributor" for a rental bond-- 11 (a) if the person is the tenant and there are no cotenants; or 12 (b) if-- 13 (i) the person is a cotenant; and 14 (ii) the authority is satisfied the person is responsible for 15 payment of the bond or part of the bond. 16 `(2) Without limiting subsection (1)(b)(ii), the authority may be satisfied 17 a person is responsible for payment of a rental bond or part of a rental 18 bond-- 19 (a) because the rental bond notice for the agreement indicates the 20 person paid the bond or contributed to payment of the bond; or 21 (b) because a cotenant-- 22 (i) is shown on the rental bond notice for the agreement to have 23 paid the bond; and 24 (ii) has given the authority a written notice naming the person 25 as a contributor for the bond; or 26 (c) because a former cotenant-- 27 (i) is shown on the rental bond notice for the agreement to have 28 contributed to payment of the bond; and 29 2 State Housing Act 1945, section 26 (Letting or leasing of houses to eligible persons)

 


 

s 11 12 s 12 Residential Tenancies and Other Legislation Amendment Bill 2003 (ii) has given the authority a written notice naming the person 1 as a contributor for the bond in place of the former cotenant. 2 `58A Share of a rental bond 3 `(1) This section applies if there is more than 1 contributor for a rental 4 bond. 5 `(2) If the authority is satisfied a contributor for a rental bond is 6 responsible for payment of a certain amount of the bond, that amount is the 7 contributor's "share" of the bond. 8 `(3) The authority may assume 2 or more contributors for a rental bond 9 are responsible for payment of the bond, or part of the bond, in equal shares 10 if the authority-- 11 (a) is satisfied the contributors are responsible for payment of the 12 bond or that part of the bond; but 13 (b) has not been notified, by a rental bond notice or a notice from the 14 contributors, of the amount for which each of the contributors is 15 responsible.'. 16 11 Insertion of new ch 2, pt 3, div 2, sdiv 1 hdg Clause 17 Chapter 2, part 3, after division 2 heading-- 18 insert-- 19 `Subdivision 1--Preliminary'. 20 12 Amendment of s 65 (Application for payment) Clause 21 Section 65-- 22 insert-- 23 `(2) An application may only direct a payment to be made to the lessor or 24 a contributor for the bond.'. 25

 


 

s 13 13 s 13 Residential Tenancies and Other Legislation Amendment Bill 2003 13 Replacement of ss 66-69 Clause 1 Sections 66 to 69-- 2 omit, insert-- 3 `Subdivision 2--Payment of bond if only 1 contributor 4 `66 Application of sdiv 2 5 `This subdivision applies to an application to the authority for payment 6 of a rental bond if there is only 1 contributor for the bond. 7 `67 Joint application by lessor and contributor 8 `If the application is made jointly by the lessor and the contributor, the 9 authority must make each payment directed by the application. 10 `68 Application by lessor 11 `(1) This section applies if the application is made by the lessor only. 12 `(2) If the application directs that a payment be made to the contributor, 13 the authority must make the payment. 14 `(3) If the application directs that a payment be made to the lessor-- 15 (a) section 69G applies to the directed payment; and 16 (b) the contributor is the interested person for the payment. 17 `69 Application by contributor 18 `(1) This section applies if the application is made by the contributor 19 only. 20 `(2) If the application directs that a payment be made to the lessor, the 21 authority must make the payment. 22 `(3) If the application directs that a payment be made to the 23 contributor-- 24 (a) section 69G applies to the directed payment; and 25 (b) the lessor is the interested person for the payment. 26

 


 

s 13 14 s 13 Residential Tenancies and Other Legislation Amendment Bill 2003 `Subdivision 3--Payment of bond if more than 1 contributor 1 `69A Application of sdiv 3 2 `This subdivision applies to an application to the authority for payment 3 of a rental bond if there is more than 1 contributor for the bond. 4 `69B Joint application by lessor and every contributor 5 `If the application is made jointly by the lessor and every contributor, the 6 authority must make each payment directed by the application. 7 `69C Joint application by lessor and some contributors 8 `(1) This section applies if the application is made jointly by the lessor 9 and some, but not all, of the contributors. 10 `(2) If there is only 1 non-applicant contributor and the application 11 directs that a payment be made to the non-applicant contributor, the 12 authority must make the payment. 13 `(3) If the application directs that payments be made to all of the 14 contributors in the same proportions as their shares of the bond, the 15 authority must make the payments. 16 `(4) If the application directs that each non-applicant contributor be paid 17 his or her entire share of the bond, the authority must make those payments 18 and any other payments directed by the application. 19 `(5) Otherwise-- 20 (a) section 69G applies to a payment directed by the application; and 21 (b) each non-applicant contributor is an interested person for the 22 payment. 23 `(6) In this section-- 24 "non-applicant contributor" means a contributor who is not an applicant. 25 `69D Application by lessor 26 `(1) This section applies if the application is made by the lessor only. 27

 


 

s 13 15 s 13 Residential Tenancies and Other Legislation Amendment Bill 2003 `(2) If the application directs that payments be made to all of the 1 contributors in the same proportions as their shares of the bond, the 2 authority must make the payments. 3 `(3) Otherwise-- 4 (a) section 69G applies to a payment directed by the application; and 5 (b) each contributor is an interested person for the payment. 6 `69E Application by every contributor 7 `(1) This section applies if the application is made by every contributor 8 but not jointly with the lessor. 9 `(2) If the application directs that a payment be made to the lessor, the 10 authority must make the payment. 11 `(3) If the application directs that a payment be made to a contributor-- 12 (a) section 69G applies to the directed payment; and 13 (b) the lessor is the interested person for the payment. 14 `69F Application by some contributors 15 `(1) This section applies if the application is made by some, but not all, 16 of the contributors and not jointly with the lessor. 17 `(2) If the application directs that a payment be made to the lessor-- 18 (a) section 69G applies to the directed payment; and 19 (b) each non-applicant contributor is an interested person for the 20 payment. 21 `(3) If the application directs that a payment be made to a contributor-- 22 (a) section 69G applies to the directed payment; and 23 (b) the lessor and each non-applicant contributor are interested 24 persons for the payment. 25 `(4) In this section-- 26 "non-applicant contributor" means a contributor who is not an applicant. 27

s 13 17 s 13 Residential Tenancies and Other Legislation Amendment Bill 2003 7 days after the notice under subparagraph (iii) is 1 given; or 2 (B) an application to a tribunal under 3 sub-subparagraph (A) is made but is withdrawn. 4 `(4) If there is more than 1 interested person, the authority must make the 5 directed payment-- 6 (a) if none of the interested persons makes a dispute resolution 7 request to the authority about the payment within 14 days after 8 notice is given under subsection (2); or 9 (b) if 1 or more dispute resolution requests under paragraph (a) are 10 made but all are withdrawn; or 11 (c) if-- 12 (i) 1 or more dispute resolution requests under paragraph (a) 13 are made; and 14 (ii) the conciliation process ends without a conciliated 15 resolution having been reached; and 16 (iii) the authority gives the interested person or persons who 17 made the dispute resolution request a written notice about 18 the ending of the conciliation process; and 19 (iv) either-- 20 (A) none of the interested persons applies to a tribunal for 21 an order about the payment, and gives the authority a 22 written notice informing it of the application, within 23 7 days after the notice under subparagraph (iii) is 24 given; or 25 (B) 1 or more applications to a tribunal under 26 sub-subparagraph (A) are made but all are withdrawn. 27 `(5) In this section-- 28 "interested person", for a payment mentioned in a notice provision, 29 means a person stated in the provision to be an interested person for 30 the payment. 31 "notice provision" means a provision mentioned in subsection (1).'. 32

Y is listed on a tenancy database for a reason relating to damage 9 caused to premises by Y's spouse in the course of an incident of 10 domestic violence. Because of the listing, Y can not obtain appropriate 11 and affordable accommodation. 12 2. Z is listed on a tenancy database for a reason relating to an amount of 13 rent that remained unpaid for 2 months after it was payable. During 14 that period, Z was in hospital recovering from a serious accident and 15 unable to make arrangements for payment. `284F Application to tribunal about proposed listing 16 `(1) A person (the "tenant") who is aware of a proposed listing of the 17 tenant on a tenancy database may apply to a tribunal for an order under this 18 section. 19 `(2) The tribunal may-- 20 (a) order a person not to make the proposed listing; or 21 (b) order a person not to make the proposed listing except with stated 22 changes or on stated conditions; or 23 (c) make another order it considers appropriate. 24 `(3) The tribunal may make the order only if it is satisfied that, if the 25 proposed listing were made, the tribunal could make an order about the 26 listing under section 284D or 284E. 27 `284G Offence of contravening tribunal order 28 `(1) A person must comply with an order of a tribunal made under this 29 chapter. 30 Maximum penalty--50 penalty units. 31

s 46 42 s 46 Residential Tenancies and Other Legislation Amendment Bill 2003 (a) if the interested person does not make a dispute resolution 1 request to the authority about the payment within 14 days after 2 notice is given under subsection (2); or 3 (b) if a dispute resolution request under paragraph (a) is made but is 4 withdrawn; or 5 (c) if-- 6 (i) a dispute resolution request under paragraph (a) is made; 7 and 8 (ii) the conciliation process ends without a conciliated 9 resolution having been reached; and 10 (iii) the authority gives the interested person a notice about the 11 ending of the conciliation process; and 12 (iv) either-- 13 (A) the interested person does not apply to a tribunal for an 14 order about the payment, and give the authority a 15 notice informing it of the application, within 7 days 16 after the notice under subparagraph (iii) is given; or 17 (B) an application to a tribunal under 18 sub-subparagraph (A) is made but is withdrawn. 19 `(4) If there is more than 1 interested person, the authority must make the 20 directed payment-- 21 (a) if none of the interested persons makes a dispute resolution 22 request to the authority about the payment within 14 days after 23 notice is given under subsection (2); or 24 (b) if 1 or more dispute resolution requests under paragraph (a) are 25 made but all are withdrawn; or 26 (c) if-- 27 (i) 1 or more dispute resolution requests under paragraph (a) 28 are made; and 29 (ii) the conciliation process ends without a conciliated 30 resolution having been reached; and 31 (iii) the authority gives the interested person or persons who 32 made the dispute resolution request a notice about the 33 ending of the conciliation process; and 34
