The Parliament of South Australia enacts as
follows:
This Act may be cited as the Architectural Practice (Continuing
Professional Development) Amendment Act 2019.
This Act comes into operation on a day to be fixed by
proclamation.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Architectural Practice

4—Amendment
of section 3—Interpretation
Section 3(1)—after the definition of nominated contact
address insert:
professional development rules—see
section 13(1)(f);
5—Amendment
of section 13—Functions of Board
(1) Section 13(1)(f)—delete paragraph (f) and
substitute:
(f) to make rules prescribing requirements for continuing professional
development for registered architects (the professional development
rules);
(2) Section 13(3)(b)—delete paragraph (b) and
substitute:
(b) professional development rules are made by the Board,
(3) Section 13(3)(c)—delete "guidelines" and substitute:
rules
(4) Section 13(3)(d)—delete "guidelines" and substitute:
rules
(5) Section 13(3)(e)—delete "guidelines" and substitute:
rules
(6) Section 13(3)—delete "or professional standard" second occurring
and substitute:

Section 15(1)—after paragraph (b) insert:

(c) the power to make professional development rules.
After section 31 insert:
31A—Requirement for further education and
training
(1) Subject to
subsection (2)
, a registered architect must, in each year of registration, undertake or
obtain further education, training and experience required or determined under
the professional development rules.
(2) The Board may
exempt a registered architect, or registered architects of a particular class,
from the requirement to comply with the professional development rules or
particular professional development rules specified by the Board.
(3) An exemption may be subject to such terms or conditions as the Board
thinks fit.
(4) If a registered architect fails to—
(a) undertake or obtain further education, training and experience as
required or determined under the professional development rules; or
(b) in the case of a registered architect who has been exempted from the
requirement to comply with the professional development rules or a particular
professional development rule—comply with a term or condition of the
exemption,
the registered architect ceases to be entitled to be registered on the
register.
8—Amendment
of section 32—Fees and returns
Section 32(2)(b)—delete paragraph (b) and substitute:
(b) furnish the Board with a return in a form approved by the Board
containing—
(i) information that, under the professional development rules, the
registered architect is required to provide to the Board as to compliance with
the professional development rules (or with the terms or conditions of an
exemption from the rules); and
(ii) other information required by the Board.
