The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Births, Deaths and Marriages Registration (Registration of Still-Births) Amendment Act 2012.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Births, Deaths and Marriages Registration Act 1996

3—Insertion of Part 3A

After Part 3 insert:

Part 3A—Optional registration of birth of certain still-born children of between 12 and 19 weeks' gestation

17A—Application of Part

This Part applies to the birth, on or after 1 January 2002, of a child of between 12 and 19 weeks' gestation (inclusive) that exhibits no sign of respiration or heartbeat, or other sign of life, after birth but does not include the product of a procedure for the termination of pregnancy.

17B—Registration of birth of still-born child of between 12 and 19 weeks' gestation

(1) A parent of a still-born child to which this Part applies may apply, in a form approved by the Registrar, to the Registrar to have the birth registered under this Act.

(2) Following receipt of an application under subsection (1), the Registrar must register the birth of the child.

(3) The Registrar registers a birth of a child to which this Part applies by making an entry about the birth in the Register including such particulars as the Registrar thinks fit.

(4) The register required to be kept under this Part may be kept as part of the Register.

17C—Part 7 to apply in relation to register under this Part

The provisions of Part 7 (other than Division 1) apply to the birth of a child to which this Part applies that is the subject of an application under section 17B as if the birth were a registrable event.
