The Parliament of South Australia enacts as follows:

Short title

1. (1) This Act may be cited as the Controlled Substances (Cannabis) Amendment Act 2002.

(2) The Controlled Substances Act 1984 is referred to in this Act as "the principal Act".

Commencement

2. This Act will come into operation on a day to be fixed by proclamation.

Amendment of s. 45A—Expiation of simple cannabis offences

3. Section 45A of the principal Act is amended—

(a)by inserting in subsection (8) before the definition of "child" the following definition:

"artificially enhanced cultivation" means—

(a)cultivation in a solution comprised wholly or principally of water enriched with nutrients; or

(b)cultivation involving the application of an artificial source of light or heat;;

(b)by inserting in paragraph (d) of the definition of "simple cannabis offence" in subsection (8) "(not being artificially enhanced cultivation)" after "cultivation".

Transitional provision

4. Section 45A of the principal Act, as in force immediately before the commencement of this Act, continues to apply in relation to offences alleged to have been committed before that commencement.
