The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Development (Public Consultation) Amendment Act 2013.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Development Act 1993

3—Amendment of section 38—Public notice and consultation

(1) Section 38(2)(a)—delete "or to Category 2" and substitute:

, Category 2 or Category 3

(2) Section 38(3)(a)—delete paragraph (a) and substitute:

(a) unless the development is internal building work of a prescribed kind—the relevant authority must ensure that the person making the application has taken reasonable steps to display a notice of the proposed development at the site of the development in accordance with the regulations; and

(3) Section 38—after subsection (6) insert:

(6a) In addition to the requirements of subsections (4) and (5), the relevant authority must, subject to any exclusion prescribed by the regulations in relation to proposed internal building work of a prescribed kind, ensure that the person making the application has taken reasonable steps to display a notice of the proposed development at the site of the development in accordance with the regulations.
